K1 Visa Question regarding Roommate

However, they both believe that me being a roommate with him would put that at risk. Is this the case? I have tried looking into it and I cannot find a single thing. Because moving on short notice (I was just told they were looking to do this 2 days ago?) would put me as a college student in a huge financial bind. So trying to see if it is true, what is the likeliness of their denial because of that. Or were they given mis-information. 

My fiance and I applied for a K1 visa while he was living with one of his best friends. Our petition was approved without issues and I'm just waiting for my interview. 

 

You living there won't affect their petition/visa application.

Your roommate and his fiancée will be fine.  They are probably just overwhelmed with the whole process, and that’s totally normal.  The attorney likely put them on edge too.  Encourage them to do a whole lot more research, like visiting visajourney. The collective knowledge and experiences of people here will be tremendously helpful and reassuring for them during their journey.

If your roommate is looking ahead to getting his own place once his fiancee is in the US, that is probably close to a year from filing the K1 petition, so no need to even panic about that, in terms of living arrangements.  Have you spoken with him about future plans, once she comes to the US, and the possible timing of that?  Those would be more relevant questions if you have a roommate situation that works for both of you right now.  He may be looking for an excuse to get you to move, but that doesn't have to happen for a long, long, time.

Nah, he isn't in college. He has a job that pays well enough imo. As in he can keep the place going without a roommate should he want. With zero issue.

While you're at it, you can tell him that in most cases there is no need whatsoever for using a lawyer to file a petition for the K-1.  Having legal assistance does not speed up the process or effect an approval in any way.  In fact, VJ is FULL of stories about how the lawyer created problems or delays, or issued inaccurate advice, as it sounds like his did regarding a roommate. 

 

And as others have said, if he is just getting ready to file the petition, his GF will not be moving to the US for at least a year, if not more.

In addition to what everyone said above, if nothing else, have them look at the 129F form. It's actually pretty straight forward and nowhere does it mention roommates or your living situation.

Sounds like the roommate is subtly (or not so subtly) trying to tell you to move out because he wants the place to be a lovenest for him and his bride and you will be in the way. He’s trying to “blind you with science” by pretending that it will affect the process if you continue to live together. 

 

I remember someone being concerned about having a roommate of the opposite sex when applying for a K-1 because they were worried that the adjudicator or interviewer might think they were more than roommates and that the relationship with the intending immigrant is not genuine.

If they just started looking at this 2 days ago, they probably know nothing about the K-1 visa and haven't done enough research if they truly believe that you being a roommate will somehow impact their case. That's like saying that a petitioner who lives with his parents will get denied because his parents live with him.

 

They are VERY misinformed. 

 

Perhaps they just want you to move out so they could have the place to themselves? If that's the case, they have a long way to go because the K-1 is a long process.

 

Tell them to do some research and not stress you out because you have nothing to do with their K-1 :)

No one has suggested this yet, but why don't you point your roommate and fiancée to this website!  The guides on here are a great starting point, and people are super helpful in the forums.  I didn't do the K-1, but this forum got me through CR-1 and filing for ROC with confidence.

Someone did suggest leading them this way, I might just do that. It would certainly help with questions they have. And proper information from the sounds of it.

There are no questions about roommates on any K1 applications. Having roommates has no bearing on adjudication of the K1 Visa process. Maybe, he's just trying to prepare ahead before his fiancee comes but he's going to shocked how long the process will take. Explain it the couple.
