I751 taking too long and no status update

Hi everyone! I'll try to make this very easy to understand so maybe someone can help or for those in the same situation. 

I applied for my i751 removal of conditions on residence on December 2016 and also got a year extension letter for my green card. And in January 2017 i had my biometrics taken. So far everything okay. A year passed and still no answer or update on my case other than "fees were waived" which it was never waived because i paid for my application, apparently that was some kind of glitch. In December 2017 i got a i551 stamp on my passport extending my green card for another year, they also took my expired green card. At that point i was aware that the i751's were taking longer than usual to be processed. A few months after that i checked my status online and it said that on march 4th 2018 my case was received at my local office and thats what is there until now. In July 2018 i received a letter extending that stamp for 18 months, instead of 12 because of process delays. So now let's get to the "issues".. it's been 21 months since i applied and i still havent got any kind of uptade, mine receipt number is wac170xxxxxx (apparently those first 3 numbers mean something). In August i submitted an inquire for outside normal processing time and they answer that the case is still pending. Today when i called uscis, the officer said that my case is at the california service center, not at my local office (probably another glitch), she also said that CSC are still working on cases from march 2015, and that it takes from 22 to 44 months to get to December 2016 (when i applied). But in the uscis website it says that they are currently working on cases from January 2017, and i saw a bunch of people here that applied in 2017 and already got their cards. She also said that the law changed last year and the backlog is due to the fact that now EVERYONE needs to be interviewed. But again, i saw a lot people here that just got their cards in the mail without interview, and i also didnt see any law stating that. In their website it says that it MAY BE required. Bottom line is, who knows whats going on! 

So my question is, anyone going through something similar? Anyone that applied in December 2016 that got an answer or some kind of update?

We applied in August 2016 with CSC and are still waiting. If you applied for your N400, this is very common as they will only move forward and adjudicate the petitions together. As our case has been outside processing times, we've filed and e-request and spoken with our Representative who inquired on the case. Although it was outside of processing times, they will not adjudicate it as scheduled once an N400 is submitted. 

 

Only 40% of VJ'ers from your month have reported their case being processed.

I didnt apply for N400. I thought about it but i was told it would delay even more, so i didnt.

No - that if you had applied for an N400, they wait on processing the I751 until your N400 is ready to be processed - basically resulting in a longer wait.

I don’t know how true that is because some people file for n-400 and their petitions are approved. Not everyone who file both petitions are interviewed. Because each case is different and often times at the officer in charge of your case discretion.

Whether the N400 slows things down depends on your local office as those applications are handled there.  My wife applied for the N400 in January 2018 after filing her ROC in December 2016 and had her oath ceremony in June.  The thing to remember is the N400 and ROC are different processing clocks, they do not have to run in series, so why not start the N400 clock as soon as you can if that is the end goal.

We definitely did not see a longer wait with the N400 being filed.  Also, with the filing of the N400, the I751 file will definitely be transferred to the local office.

So in looking at your timeline, you were approved for N400 before I751?  That’s amazing!

Generally speaking if the N-400 is processed at a decent rate of speed, they MUST process the I-751 before you can have the N-400 actually approved.  So it can speed it up.  However, sometimes it slows it down if your local office is slower than dickens.

Just to be clear. I never mentioned anything about N400. I didnt apply for that, and all my responses are pretty much talking about that 😅😅

Because people have noted you are within the 60% on VJ who are still waiting who have filed same month as you, so your original question was answered pretty quickly. I linked the thread in which you can find others to commiserate with. 

 

But you don't have to ever file the N-400 if ya dont want to.

It's not a glitch to pay for biometrics and not be required to take it. That's common.

 

Your processing times aren't outside of normal. It's a shame that it's taking so long, but there's nothing you can do about it. (Outside of applying for n400 and maybe getting them both processed simultaneously). Just keep waiting..

That's not what OP is saying. Their status updated to "fees waived" which is what people with financial hardship try to apply for if they can't afford the $600ish that ROC costs. A bunch of people randomly got that status a while ago even though they didn't apply for a waiver. 

 

OP, considering you didn't file for citizenship, you really have been waiting way too long. At this point, I would get my senator involved because sometimes they're privy to more specific information than they give to the actual petitioner, which makes no sense but it is a thing. I only got my green card printed because my senator intervened. 

 

I'll also add that the staff at USCIS who state everyone requires an interview are either lying on orders from above or are grossly misinformed. There is no such blanket requirement and likely won't be given how slow they are without that happening.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
