CO refused my visa again after submitting joint sponsor financial docs

The consular officer has refused my visa again by saying I will be a public charge when I come to the state  after submitted my joint sponsor financial documents I was confused bcos my joint sponsor make enough money to sponsor me he make 59,317$ in 2017,2016 28094$ and 2015 33,754$ he is single. Here are the questions the co asked me yesterday

 who is my wife ? I tell him

 does she have children ? I tell him

who is my joint sponsor.? I tell him

where does she stay..? I tell him New York

he the ask me where my wife stays I tell him mississippi 

He asked me what is the distance From Mississippi to New York ..I tell him I don’t know the distance ...

he go ahead and ask me how can my friend who is my joint sponsor help my wife...and also how can my friend help me when I’m there and end up saying my joint sponsor didn’t qualify to sponsor me that I will still be a public charge when I come to the state..what else should I do now..thank you

Mississippi is the poorest state in America.

 

Does your wife have a job at all?

Is the joint sponsor a personal friend of yours?

Do you plan on staying in MS?

What is the story behind the joint sponsor? How you come to know him?

 

The CO can use discretion to determine if a joint sponsor is acceptable. The CO may have seen something with this particular joint sponsor. It isn't just about how much money they make.

 

You should begin a search for another sponsor.

Read between line bro...you joint sponser is far away from where you gonna be living..the CO see it this way..your joint sponser is living far away to offer help if you d need one...so I suggest you get a someone in the same city or state where you and your wife gonna be living if possible get your wife relations or someone living in the same city..I know it hard to get some ...but you got no choice bro..

As someone else said, it isn't always just about the amount of income. They review other factors, and it may very well be because of the distance. Also, not knowing the distance when they asked may have been a red flag...I'm not sure. They may have viewed that as... Well, how well do you know them if you don't know that?... sort of thing. Is that a reliable sponsor, with that being said. Just speculating.

 

I agree in exploring the options of obtaining a different sponsor.

I agree.  That's why I'm curious how the OP answered the last two questions...

 

If the OP just shrugged his shoulders in response or said "I don't know", it would have sounded like he didn't know anything about the joint sponsor at all.

Right. The petitioner alone being familiar with the sponsor is probably not good enough. After all, they are technically sponsoring the beneficiary, not the petitioner. They are agreeing to be responsible for the beneficiary financially. If there doesn't seem to be a strong relation there of any kind, could be considered insufficient.

also note that your joint sponsor lives in new york and to be honest, a 59k income is not much there. if the sponsor has a family, no way that income will be enough.

 

Edit: ok, maybe if they live in the outskirts of new york it can work, but still. that is probably what the CO was also thinking when considering the public charge issue.

New York is extremely expensive (madly so). If your friend is in New York City, that is not enough money to support you in the event. (even with $60,000) his take home pay with Federal/State Taxes in NY are highest in the country/NYC taxes of 5%, his take home income would be around $40,000. Not enough. IF upstate, IF this is the case it is easier, but still could not make the cut.

 

Mississippi, has very low income indeed, unless your Spouse is in the Professions

1. How long did your reaffirmed case take at the NVC and then later scheduled for interview.

 

2. Just been curious, do you have any children with your spouse? I think apart from the joint sponsor issue that pop up. Did you present more evidence or did your Wifey front load more bona fide evidence.  The consulate consider sooo many things before they take certain decisions. 

 

3. Were you informed that your case will be sent back to the USCIS?

Is a sad situation to experience. some of us have seen the worse from the embassy before. Like someone said already, we have to apply common sense sometimes because this counselor officers are so picky. I would have never ever recommend a joint sponsor living in another state. The responsibility of a sponsor goes beyond financial aid to them, so how can someone who will not be seeing you on daily or weekly basis to make sure you have the necessary support till you get on your feet be your sponsor?  And secondly why is your wife not making effort to get a joint sponsor and you are the one doing that? If your wife needs you in the states she need to be serious than you, not the other way round.
