I was refused visa on section 212(a)(4)

I don't mean to sound insensitive, but to begin with, the attitude that USCIS/US Embassy has no right to determine whether or not someone should be approved or denied for a visa is the wrong attitude to have. That's literally their job. And there are countless factors - some that a person may never even be aware of - that are used in making this decision. People get denied every day for reasons they feel are unfounded or unfair. When it comes to financial support, it's more than just a person's sole income. They review assets. Savings. Would someone be able to support the beneficiary across multiple platforms. Are they stable. How long have they had their job? How long have they been making that particular income? It's more than just about the numbers. And the beneficiary's assets basically mean absolutely nothing. They don't care about someone's assets outside of the United States. They don't even question that topic at the interview level, I believe. (My fiancé had already left his job at the end of 2017 since he's leaving, paid off his debts and bills, and is living off savings until he leaves for the states. They could NOT have cared less.)

 

A few people have already stated that Ghana is a high fraud country, so it's safe to assume they are going to scrutinize things a LOT more than some other countries. That's just the way it is - they don't care about you or your relationship. You are a case number to them. You are no different than any other couple applying. Nobody is guaranteed a visa at the end of this journey, no matter where they are from. It could be because of the smallest thing.

 

If you so strongly feel illegal action has been implemented, then I suggest you seek legal counsel. Do we feel for you here? Of course. Nobody likes to be denied and we don't like seeing someone get denied. But nobody here is going to sugarcoat it for you, either. Because that won't get you your visa in the end. You're going to get honest answers here. Take it or leave it.

Their excuses makes no sense in a legal stand ground. For example, the US Citizen wife worked enough to pay into Social Security that God forbid if the wife drops dead her Husband in Ghana will get $1700 monthly from Social Security. This public charge is bogus and they know it!! Next

Pretty strong words there.  But don't other people get visas from Ghana?  Why would they single you out?

Correct. In fiscal year 2017, Ghana had a "B" visa  refusal rate of 56.8 % per this list:

One of the first things we did before we ever submitted an application (granted we went the K1 route opposed to CR1) was do research to see how Sweden registers in general when it comes to approvals. We wanted to know what we were up against. Fortunately, Sweden is a pretty neutral country. So it's easy for me to say what I would do in a different situation. However, I would like to think if we were dealing with a less than neutral country, such as a high fraud area, we would do our best to prepare for that. Extra research. Extra information. Double checking once, twice, maybe three times that every T is crossed and every I is dotted. Expect pushback. Expect them to be tough on us. But on the other hand, it is easy to go into it knowing your relationship is valid and expect that to speak for itself. Unfortunately, that is not always the case.

I would recommend  that your wife gets her state representative involved. They can further inquire about the situation.

No the Embassy have no right to determine that our married was not legitime because they know it true because we have been living together.

 

it was pointed out that 2 visits and sleeping together does not mean living together as any 2 (or more) people can share a bed
