Marriage on tourist business visa

So the man I love (same sex marriage) lives in Central America.  We have met a few times before; him here in the states while he was working and me down there just last week to visit him. 

 

We can not be apart much longer and need to be together. He will be in the states next month on a business visa b1 b2. I would like to marry him And have him stay here and not go back home as the distance will kill us. 

 Would it be okay if he comes in April we get married and he stays? What is the process like for this?

No......He can not enter the US via a non-immigrant path with the intent to remain and adjust status.  Your options are:

1.  K-1 which takes 9-12 months

2.  CR-1 which takes 12-14 months.

Seconding Missileman. If he enters using one visa with intent to stay and adjust status after marriage that is visa fraud.

 

As to "being apart"... everyone here almost deals with extended periods of time apart...

Being apart doesn't "kill you" - no one has died from a visa in progress. 

We all want to marry and be with the person we love as soon as possible. You are lucky that you live close and are able to visit during the process, but do so LEGALLY or you could have big problems later. 

 

My husband lives 7000 miles away. I'll probably see him only one week the whole 2018. It doesnt mean I love him any less, I just recognize we have to do things the way we have to do them for the benefit in the end.

You mean his company is financing his trip to the US for business purposes, presumably helping him get a b1/b2 business visa, and he's considering just staying in America with you after doing his business thing, i.e. abandoning his job and employer?

Let me rephrase. If he was here on business (work) and I so happen to ask him to marry me and have him stay with me is this possible? A lawyer said yes so I am not sure why you are all saying no.

In spontaneous sense, yes it can be done... but honestly, if it isn't planned out, who in their right mind can't literally abandon everything back home to stay here? 

 

So in general most are pre-planned, and again then it is visa fraud.

 

But again no one here will tell you to go through with your 'idea'.

You are already planning it. Which means it is illegal.

 

When he turns up at the POE and is asked for purpose of visit, make sure he tells the truth, to get married and stay in the USA. He will quickly find out if your lawyer was right or wrong.

Yeah. Be honest about it. Lying to immigration is not safe. You will feel much better at the end. 9-12 months is better than being banned forever.

I am not sure if anyone understands. I want to propose to him while he is here for work, and if he accepts i want to marry him while he is here. Why are you guys saying this is illegal? I would also like for him to live with me instead of going back home. So none of these are options?

No i would ask him to marry me while he is here in the states without him knowing this. What would be the next step?

After re-reading all your posts, it appears to me that you are trying to avoid the normal immigration route for your marriage to a non-citizen because you don't want to be apart. Most of us here have waited many months to be with our loved ones.  AOS is not meant as a route to bring a fiance INTO the country for marriage.
