I’m new to the AOS game so maybe I’m missing something when I see people upset about having to wait on USCIS for AOS. Maybe it’s the fact that my wife doesn’t plan on working or leaving the US that makes us not care how long USCIS takes?

 

I would like to know why people seem to be upset that AOStakes a long time? I cared how long the K1 process took because I was separated from my Love, but for AOS I don’t care at all how long AOS takes because we are together. Should I care? Is there something I am missing that would make me care? When I see people seemingly upset over the wait I get paranoid that I am missing something.

Timeline

Exept info above I think GC as a proof of your legal stay in states gives you a sense of security.. I would like to have mine right away. After permanently entering states there is so many formalities ppl have to deal with.. adding a stress of awaiting for GC for such a long time! I can fully understand others impatience regarding this topic :)

I asked because I was concerned that there might be real risks associated with this phase of the process, that I was missing, like getting deported. The frown emoticons, etc, lead me here, with this question. This is a family based immigration thread which means that the primary intent is being united with a loved one. I am in no way trying to discredit a person wanting to go to school, work, etc. I am simply trying to determine if I am missing something critical that would result in us being separated. If you took what I said to mean something else then you are wrong.

Timeline

Some of us had higher plans for our partners, as did they themselves besides being able to just look at each other on the daily. Not that this isn't great, but still. I know my spouse was stuck in 2 years of standstill during his AOS and was unable to persue education in the states for example, something that greatly upset us both. Some states and cities are less than accommodating to giving driver licenses to those with just and EAD....one would only have to search VJ for a mountain of those threads. The immigrant living in one year incriments is also nerve racking, for both parties usually. Icould name more but I digress.

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

(AOS AFTER TERMINATION)

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

HAPPY 2YR ANNIVERSARY TO US!!

Infopass #1 at local office: Dec. 19, 2016- Case pending background/security checks, advised when to renew EAD #2

Well, it's also enough to grind someone's gears when their AOS has been pending almost a year, and you see a few token people being done in 4mo (no hate, those 4mo folks are so lucky). Kind of a feel good thing to come together and commiserate, wallow and complain among others who get it.

Primary intent is bing united with a loved one THE LEGAL WAY. Not worth being together if there is an uncertainty of having a legal status.

 

We constantly see post of people doing things the wrong way. We try to steer them the right way. Also, AOS can be denied. That sucks also. We've seen people have family emergencies back home and had to leave and abandon their AOS. There is always a risk in this process. 

 

By by the way. What you "intended" and how your post actually came off are two different things. Like you said in your own words, maybe you are missing something.

I get that. That’s why I clarified that IMO these (school, work,etc) are all legitimate concerns. However, I asked the question because of legitimate concerns I have and I see no reason why this would be considered a “wasted thread”, etc.  This thread was about me, which in no way implies that I think another’s concern is invalid.

 

The government bureaucracies suck plain and simple.

I asked an open ended question trying to gather any information about things that might affect  me, nothing more.

 

I would say that how it came across depends on the person reading. You took it personally, it seems.

Concerns about deportation, no, because the immigrant is in what is termed stay authorized by the attorney general. Can that stay make major headaches for some other things like driving, buying a car, leasing a home, etc? You better believe it, especially if you're living in a smaller city where they have never dealt with an EAD. Example, it took my husband over 6mo and going an hour away to a major city to finally get our state DMV to give him a driver license, despite being entitled to it from day one with the pending AOS paperwork as per calling the state capital. 

 

What may be enough to grind my and my spouse's gears about the process might be trivial to you and your spouse and vice versa, because everyone's plans for married life and family reunification differ

I got all of this before I posted, about others wanting to work, drive, etc, all legit concerns for some. I am in no way saying it’s trivial for others, even though it is for us. Different strokes for different folks. I think I got the answer to my question, you guessed it, deportation.Thanks ☺️

Timeline

I knew what you meant TriloByte and I felt the same way. I had EAD, AP, and a driver license so didn't hover over the greencard. I just got on with everyday life and didn't check status  or join a 'how much longer?' thread.  I was confident it would come so didn't worry or get angry about it. Everybody is different.
