Filed: K-1 Visa Country: Sweden
Timeline

We got a letter from the US embassy in Sweden refusing us of K1 Visa due to controlled substance violation and it's without a waiver. Anyone know if we can appeal? Or what to do next? My plan right now is to go there after I graduate and marry him and file a petition I130 and have a lawyer go through it but I was wondering if there is any way before we do all of that as far as appealing or reconsidering the application. Moving there is the last option so Id rather wanna hear all other advices besides that. Thanks so much for all the help.

What is the nature of the conviction, and when did it happen?

Sounds like it was not a small amount of MJ, so yes a US Immigrant Visa will not be in your future.

Timeline

Simply getting married and filing a new petition will not change the fact of the drug charge. My friend just went through this. Her fiancé was refused with no waiver available. That left them without any other options for immigration.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If moving to Sweden is not really an option I would hold off on getting married as it's not going to solve anything.

You need to give the people here with experience more information so they can help you figure out the next step.

I know it might not be something you want to talk about but if you want to get proper help it's important that they know what substance, how much etc.

There also is some lying on the ESTA form about drug use (They answered NO to drug use on the form) if I remember correctly..

"I'm a little bit troubled about my fiance's police record. In it he was caught having narcotics in his system 4 years ago which he had to pay a fine. Next year supposedly the record would be clear from the system. We're not sure how this is gonna go and if we should still proceed to the visa interview. We were confused whether that was a convicted crime or not. Any suggestions?"

If the CO denied your K1 visa then its on records. Going to the US as a visitor with intention to marry knowing that your K1 was denied, I doubt it is going to be helpful. If you do make it to the US and hire a lawyer, then you better be prepared for a long haul and lots of money to spend on a lawyer...

I wish that a moderator or Admin can make comments on this issue just to make it clear.
