I thought the Affidavit of Support really means that if the sponsored person/immigrant receives Government assistance (housing, food stamps, whatever), then the sponsor will be obligated to reimburse the Government. I don't think it means spousal support. I think that would be decided by the divorce courts...is this correct?

Basically yes.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

One more point about the Affadavidit of Support that was alluded to above. It is valid for ten years or once 40 quarters of social security credit are earned (Up to four quarters per year can be earned) This is not strictly the immigrant but can be the sponsor and it is my understanding that it can be the immigrant and sponsor combined (meaning it can be as little as five years). Given they have been married over nine years and assuming the husband has worked steadily the Affadavidit of Support will soon no longer be valid. Further, it is my understanding that if you apply for a IR-1 visa after having been married ten years and can show social security credit for all those years you do not need to even submit an AOS.

Well no, plenty of threads on the I 864 and you can read the form on line.

Incorrect information. it is the immigrant only that had to have work 40 hours of SS credit or become citizen before The AOS is no longer in effect

Hi Labryinth, it is sad to read your thread but you really need to get a job asap before you go about starting to file divorce. It is going to be tough for you because you have not been employed for some time and in Chicago I believe it is quite competitive there in career market. But do not worry, I am sure you will be able to find something, be it any kind of job as long as there is some income first, you need to go create a personal bank account of your own. For now since he is hiding all these electronics, do you go to asian supermarket? As what I know and came across, asian supermarkets usually hang a board at the exit with alot of job postings, you might want to give that a try. Other than that, try Ph community websites, some might have career offers or assistance. I hope things will work out for you soon. Take care of your health as now you need to be strong for your son.

Some people seem to forget that until very recently it was not acceptable to be gay in the US. No, cheating is never acceptable but see it from his side too. It can't be easy to have to hide who you are.

For God's sake, I almost think you just like to comment for the sake of making a comment. Is it difficult to be who you are in a country that predominantly believing in religion? Yes. Does it give you the right to be dishonest and marry someone for almost 10 years and never talked about it? No! It's hard to express your sexuality but it's not that hard to remain single. He does not need anyone to pretend to be his 'beard'. The overall pressure from society does not justify wrong deeds, which in this case, not being gay but marrying a female. It doesn't matter how many else are doing it, it's never the excuse.

This is getting off-topic but the key language is "or can receive credit for" in the the I-864

This law site gives a good explanation of how the I-864 is fufilled in the case of divorce.

I agree with Nolo, did not agree with your post.

I'm not saying it gives someone the right to do this. I'm just saying being gay in a not very gay friendly country is hard and this is what happens. The situation in America now is okay, imagine how it was like 9-10 years ago when this couple got married.

If you don't like my opinion (and it clearly makes you angry) don't read it, move on to the next one.

People can be very harsh about those with a non traditional sexual disposition.

People, please read the entire thread before replying! Some of you are making the situation sound bleak. She clearly has valuable options to successfully get out of this mess and start a new life.

OP, go live with your family who will help you out of this mess! That's what family is for :) I wish you and your son nothing but the best. Your kind heart will be rewarded. As for immigration issues, you're 100% in the clear.

A thousand lives if I could give,
I would spend it all again with you,
Don't forget where you belong,
Only with me you are strong,
Not even the gods above can break,

Hi Darnell. Thank you. Im trying to research on my phone. Its my only access right now. He hids the laptop and wifi and even said we dont have those. But i recently discovered where he hides thise from me.

Ok. I suggest getting into a public library and use the computers there. Usually need a library card, too.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
