You may need to do something to prove to the embassy you really care about your wife. I understand everyone cannot do this but I lived in Sri Lanka a little over a year and I learned to speak intermediate Sinhalese in order to gain my in-laws' approval for marriage. His parents wanted him to marry a Sri Lanka woman so they would have Sinhalese speaking grand kids, not English and Japanese speaking kids because my husband and I both speak Japanese and English but I had no knowledge of Sinhalese at the time.

I have met ALL of my husband's family members, best friends, friends, ex-coworkers, expatriates, etc. We own a house and land together in Sri Lanka.

It is time for you to fly your wife over to India, introduce her to everyone you know, take pictures together, put her name on your property and get your parents to understand this is a decision you are not willing to change. And give her the wedding she deserves!!! You deprived her of this because you were too scared about tradition and what your parents would think.

As far as fraud, if you didn't commit the fraudulent act you have nothing to worry about. It is your father who lied, not you. Now whether or not you can prove this is a different problem.

Why would he ? He made a major mistake of not telling his family about it (which - as far as I understand - is pretty important in India) and I don't see how any other CO wouldn't have doubts in this situation. Not sure if we're getting a whole story, but if denial happens, it will pretty legitimate. Don't see what would congressman or senator help with.

people here are saying that this is not the whole story. what else do you guyys want me explain here. or should I wrote the headliners. my wife can not move to either india or any other country because she is in debt.

I have no idea of what goes on in India, or their culture.

What weight, did the "dad's comment" have on what has supposedly been submitted, and on the way to approval.

Like someone else said, your dad might need to have a sworn affidavit, written up, correcting his phone conversation and "at some time" you can submit it to a CO.

It would seem that the culture in India, is very family orientated and I really respect that, "nothing can replace your family."

I hope you will make it through AP, if not, live with your wife in India. (just because someone has debt doesn't mean they can move abroad). Once you've lived together for awhile re-apply so they can see you are a real couple. I knew when I got engaged to my husband that there was a chance I'd have to move to Pakistan if he didn't get a USA visa. If your wife loves you, she will do the same.

Be it cultural, religion, or family circumstances, but there are enough situations

like this where marriage decision occurs without the family knowledge or support.

While this is not the most desirable path, there is nothing illegal about this,

and this person fully deserves fair chance for the US visa.

Hopefully legitimate marriage will stand on its own merit in the end.

Best of luck.

At least if the worst comes to the worst she can move.

I think the issue here is cultural differences, not a visa issue. The presumption in the US in getting a marriage visa is that your family is fully aware you are married and hopefully support the process, but at least they acknowledge that you have informed them and even taken pictures as evidence. That serves as evidence the marriage is for real and involves the whole family. In some cultures, as you experience yourself, it works very differently obviously, meaning there is a culture clash here. Unless that clash gets resolved to the USCIS or embassy satisfaction, they have the discretionary right to approve or deny based on just that - discretion, including consider your marriage a scam. The solution is not trying to convince the USCIS or embassy anything, but the key is to convince your parents to support this and sign necessary papers and affidavits, which then serve as adequate evidence for the USCIS/embassy to make a positive decision. India is considered to be a higher risk country for marriage scams than for example Canada, so I think you need to provide some solid evidence to the CO to prove your marriage is indeed legitimate, and if that involves your family then you need to work with them to get them on board.

Its really a coin toss when it comes to India some people have a lot of evidence and letters from the family (both sides) agreeing with the marriage and still get denied most of you where not here when I had the pleasure of dealing with India

then other couples have very little evidence and have a smooth ride all the way threw ........it depends on the officer and how that person felt about the truth of your situation when you were interviewed......

truthfully your fathers answer on the phone may not mean a thing if you had strong evidence and a interview that went well.

I will add you to my prayers hope everything goes well for you

I am worried of the fraud case because if i get that i will be banned to enter in the land. i dont understand our life is controlled by other people like my family and some other counsellor. they are there to help. i have given more than 100 pics of us and her home in usa which has our pics all over the walls. the insurance in which we are benificiary. she has three visits to me all of the detail are submitted to the embassy. the whats app chat that we had in two years(200,000 entries in there). written affidavits from friends on there views of our marrige.

I would not worry about fraud. Your father is the one that lied, not you. I know it is a toss up if you will get a visa or not, but I know the fact that your family is not okay with things does not completely ruin your chances. My friend brought her fiance to USA from Iran over 10 years ago. Her husband's siblings now know about their marriage, but his parents still don't know because of how their culture is in Iran. He was given a visa and is now a US citizen. Keep faith that everything will work out.
