I am asking of the fraud because my dad simply denied that he is not aware of anything. and i have supplied affidavits signed by him.

The embassy didnt said anything about it. i am trying to get info what further can be done. so i am not aware whether every case goes to uscis after denial or not. if you can give me any link where i can read about it that would be appreciated.

How old is your father, how could he sign then tell them he knew nothing,

was this purposely done by him? If he has some senility and its verified by

a doctor then it could be no fraud, If he did it on purpose yes it could be

possibly fraud, you presented affidavit from him and he's saying he knows

nothing

As everyone has said...nothing at this point to do but wait for the AP decision.

If that decision is a denial, then would it not be sent back to UCIS for NOIR/NOID? At this point the wife (petitioner) will be given a chance for rebuttal. Sworn/notarized affidavit from Dad explaining his initial phone response and change of mind could be submitted at this point.

But only thing to do now is wait...

It alarms me to learn that they demanded to see wedding photos with your parents in them. My husband and I married at a court house, 1400 miles from my family, 7000 miles from his. Our photos are of just the two of us, and our attire was just average day to day clothes. A wedding does not determine the sincerity of the couple! My parents eloped, and in their wedding photos, my dad was in his ranch hand clothes and my mom was in jeans and a red checked shirt, but yet their marriage lasted 53 years and only ended upon my dad's death. Apparently consulates do rate the couples sincerity by the quality of their wedding???

It's not about the sincerity of a wedding. But the culture. And if you are coming from a culture where parent approval is very important and someone says My parents don't even know I am married. That is major. That's why the parents were involved.

Same situation as the OP's a friend of mine has at the USCIS level they requested an affidavit from his parents in Nigeria why they weren't at their wedding (she made mention parents weren't there). Well they weren't there because like the OP they didn't tell the parents because of her older age to their son.

They haven't had interview so we will see what will happen. But at least they got affidavits upfront. But OP's dad changed mine and said we know nothing so it makes it look like "did dad even sign the affidavits at all. " I think that's the OP's concern about fraud.

Consulates are staffed by officers trained with some knowledge of the local culture at their post. They have discretion if they spot questionable evidence or anything else that stands out. CO are human too, but the burden is on the applicant to make their case beyond a reasonable doubt.

For an applicant with a genuine case backed up by supporting evidence, terms such as 'fraud' or 'denial' do not usually enter the lexicon. And maybe it's just me, but why refer to your spouse as "an American" versus a more personal "she is American"? Maybe I'm just splitting hair.. Just my 2 cents...

Sorry did not mean to do that , but anyway we don't what kind of he'll this op has been though. Seeing this post has gotten me extremely worried. My husband, who is also Indian 5 years younger and is now married to a divorce woman with children told his family he wanted to marry me. Had his mom, brother, and sister convinced but not his dad. His dad proceed to force an arrange marriage onto my husband, and even gone to the point won't let him out of the house for a week. Well filed k1 because of this but the CO decided to deny because his father's disapproval. Scared my husband and I married secretly last year, just like all the other poor men and woman doing love marriages and their parents don't agree because from different class back ground. I even read a sad story of a poor couple hiding in fear because a father threatened to kill them both because he was disgraced. I feel CO should also realize that these kind of abuse and parents hold on their children is strong. I just hope the letters from his approving family works because I don't have photos of them there because they was not present because my husband does not want to take chances that his father will find out. He swears up and down that his father will force him to divorce me because I will be disgraceful to the family. I wish the OP good luck.

It depends on consulates, for my wife interview in Pakistan on the 28th of January, 2015 they asked for reception pictures from the bride and groom side; and our wedding video. Along with requesting to see pictures of us with our parents, extended family from Pakistan and brothers/sisters.

It depends on consulates, for my wife interview in Pakistan on the 28th of January, 2015 they asked for reception pictures from the bride and groom side; and our wedding video. Along with requesting to see pictures of us with our parents, extended family from Pakistan and brothers/sisters.

IMO, the photos should have been submitted with the I-130, or even with the civil docs during doc intake at NVC. Interview day is usually the wrong time for a 4 minute review, as the casefile was inside the IV unit for at least 20 days prior to interview and all inside of it was actually reviewed prior to the interview.

as to the wedding video, well, USCIS won't accept it, neither will NVC.

sir, she is not just my spouse, she is my life. my life starts with her and ends at her. I wasn't aware of "fraud" thing. my wife was crying and was afraid and still afraid of getting a denial with fraud. when she told me about that .i got worried too. I am not worried with it any more. if i get the visa its good else she will shift here. she resisted her love for a long time just because she was convinced that my family wouldn't accept us. Loosing the hops and dreams of is really scary. i will pray that no one will face this. we have found our way. I am thankful to everyone for their prayers. please keep praying.:-)

We did submit the photos with the I-130. But we had a 100 picture photo album prepared just in-case because in Pakistan they ask for album (it's standard in Pakistan), and what you know they asked for it and my wife quietly handed it over. I read everything about Pakistan embassy and asked friends who've gone through the spouse visa process in that embassy.

Have your wife email to her congressman/senator and president, explain how families are against love marriage in India, and how it could affect your lives. She can also explain that you too are adults and do not need permission from your parents for marriage and US embassy should not decide solely on your what your parents think.
