Filing for marriag visa on expired tourist visa

I'm most likely confused on the visa. I've seen him refer to it as ETSA, so I'm probably in the wrong on this one. I know he can only visit for up to 90 days on whichever visa it is, and has no criminal record.

Well said. Some of the "experienced" people around here can really get on their high horse. The whole purpose of a forum like this is to share knowledge and try to help.

I saw someone continually bash the OP for the semantics of her husband's current entry status, which esta/vwp is basically the same thing and the fact of the matter is that since the OP married her spouse while he was lawfully in the country, she is free to file for AOS if they choose to live in the US. That is all that needed to be said, along with perhaps some advice on the steps needed to be taken. Harpa, I thought you were being helpful.

I saw someone continually bash the OP for the semantics of her husband's current entry status, which esta/vwp is basically the same thing and the fact of the matter is that since the OP married her spouse while he was lawfully in the country, she is free to file for AOS if they choose to live in the US. That is all that needed to be said, along with perhaps some advice on the steps needed to be taken. Harpa, I thought you were being helpful.

Because OP wasn't clear in her post whether the spouse entered on VWP or Tourist visa (B2) as stated in her title.

And there is a big difference - if AOS based on VWP is denied, there is NO Appeal.

So unless OP has other serious negative factors that she did not mention here, they should be fine to AOS.

I had two simple questions: 1. If his visa (whatever label it may be under) expires before the 90 day date stamp that says he needs to be out of the country, are we going to run into trouble? And 2. Will a doctor perform a physical for someone who is still considered a tourist? If I needed to provide other information, I asked what that may be. I don't know why I'm being painted to look as if I'm giving sass or ungrateful.

Just FYI if you should run into any trouble and/or denial of aos, on vwp it cannot be appealed. At that point he must return home.

All a Doctor will care about is that you pay, most seem to want cash.

(Think because you were unsure of the type of visa/VWP/ESTA and you responded that "he obtained a visitor's visa to visit, of course", it was seen as evasive and sassy. That may not have been your intention but I think that was the interpretation).

OP originally said, and repeated, that he entered on a visa.

ESTA/VWP, well we would have understood what she meant has she said that.
