  1. Hello! I'm a Canadian Citizen in the US on a TN Visa, however, I've been furloughed due to COVID-19. My employer has filed the i-129 petition before my i-94 has expired, however, as of now, my i-94 has expired, and my status is pending. My boyfriend and I've been together for 4 years, and we had hoped to get married at the end of the year, if not early 2021, but with COVID-19, it is very likely for me to get laid off, which will force me to leave the US, so we're looking at applying for K-1 visa for us to be back together in the US. Now, if I'm planning to move forward with K-1 as soon as I'm back in Canada, will my pending TN Visa Extension petition be an issue in the eyes of USCIS, or would it not matter since leaving the US while the petition is pending will mean I'm out of status any way? With that being said, will it negatively affect my K-1 application whether I choose to resign or not before departing the US? Thank you so much!
  2. My fiancé and I began the process of getting his K-1 visa in November. We received the NOA2 in March and since then it has, like everyone else, been at the NVC. We contacted the embassy as the NOA2 was expiring and we received the email below. Are others getting similar messages? Is there anything we can do? The embassy is still closed and the coronavirus cases are on the rise in the city of the interview, but from what we understand the statement about the proclamation is not true. Also, we completed DS-160, but where do we submit his passport page? *my fiancé is Mozambican, but his interview takes place in South Africa*
  3. good evening when updating timeline do i put the date i received the text from USCIS or the date that USCIS actually received the petition? Example i received a text with a receipt number today but when i checked status it says USCIS received on July 9th...
  4. Hi, a few questions regarding the I-129F: 1) Employment History - End Date field for current employment: This field is only numbers and slash format with my version of Adobe at least. Can I write 'PRESENT' in ink after printing the forms? This is the case for both petitioner and beneficiary. 2) Beneficiary Information Item 38. "If your beneficiary is currently in the United States, complete Item Numbers 38a-38h." Fiance is currently not in the US. Do I still fill out Item 38a-38h? Typically I would think not, because of the "If". The I-129F instructions from USCIS website don't mention anything about the "If fiance is currently in the US" part. To me, the I-I29F instructions imply to fill out Items 38a-38h regardless. It also seems like important information to leave out. The evidence section states to include the I-94 and passport number. Can anyone please clarify? (I ticked Yes for Item 37 as beneficiary has been in the US to visit several times) 3) Evidence: Boarding passes vs airline booking confirmations. Would booking confirmations help? Or do they assume you could have changed your flight? Fiance and I also have passport stamps from 2 trips. Fiance has bus tickets which are more like booking confirmations also, from Greyhound trips to visit me in the US. 4) Should "N/A" or "None" be used in every field not filled out? I have read that suggestion on the forums. In the same case of numeric and slash only fields, would I write "N/A" or "None"? 5) Payment G-1450: If my beneficiary pays by credit card would a non-US, issued in Canada credit card be okay? Alternatively can ask her local bank if US money orders are drawn on US banks, which I think might be the alternative. Any help would be greatly appreciated! I have a habit of overthinking things mainly because I don't want to overlook anything also. Thank you in advance for your suggestions.
  5. For my fiancee to get her K-1 visa the last item we are waiting on is for the Embassy in Kyiv to open and schedule her K-1 interview. Her and her daughter have valid US Tourist Visas and has been to the US twice already. I plan on having them fly round trip from Odesa to Istanbul to Chicago on Turkish Airlines, July 5th and return August 9th. I have been told by Homeland Security the planned trip is OK but as with all travel the passport control officer at the airport has the final say on entry to the US. Does anyone see any issues they may have making this trip and getting thru passport control? June 19 at 5:32 AM · If you have a valid U.S. visa and have been in Ukraine, or in another country not covered by COVID-19 related restrictions as described below, for at least 14 days prior to departure for the United States, you may travel to the United States. If you wish to transit through another country to the United States, you need to plan carefully and review COVID-19-related restrictions. Transiting through certain areas en route to the United States -- including the Schengen Area, the UK, Ireland, China, Iran, or Brazil -- is not currently permitted for most visa holders. 6. I guess I'll start an April thread since my package should be delivered today by 8 pm. Hurry up and wait...
  7. Hello, I am feeling overwhelmed by the odds against us in Lagos. Is there anyone here who has recently been issued a marriage or K-1 visa and would be willing to tell me about it? What can we do to increase our odds? Coronavirus isn’t helping.. but I am looking for a foothold amongst so much uncertainty.
  8. We are currently in the waiting process for our NOA2 and are trying to determine when to start attempting to obtain a police certificate from Ghana. My fiance is Ghanian but lives abroad, so he cannot go to Accra and have his fingerprints done for the certificate. Does anyone have experience of getting a police certificate remotely and how long did that process take you? Did is go smoothly? Any advice is welcome!
  9. My fiancé and I are applying for the K-1 Visa. He lives in the United Kingdom, I live in New York. We have been together for 2 years and 3 months, and have visited each other's countries a total of 7 times. My fiancé and I recently sent in our I-129f form. We attached a small 5"x7" softcover photo book with about 20 photos as evidence of our ongoing relationship. Today I received the book back in the mail from uscis. I now feel dumb for sending it because I see that we are not supposed to send any kind of photo book. I saw a few YouTube videos where people sent similar sized photo books so I thought it was fine since it wasn't a big photo album. I read on the official website that they don't accept bulky photo albums but I thought a small, thin, softcover book would be okay. Now I am worried that we will get an RFE. I know that photos are not required for this stage of the process, but they do help, and now there are no photos attached to our application. We sent in a lot of evidence. We sent boarding passes, flight itineraries, bus passes, passport stamps, receipts, etc that prove we have been together. We also have other secondary information like video chat logs and messages, and we have letters from our family and friends who support our relationship. But I'm worried that not having any photos will delay the process and result in an RFE. I know an RFE isn't the end of the world but we really don't want anything to get delayed. What do you guys think?
  10. Hi guys! I have a problem. I am 99% sure that I have got all the vaccination needed. However, my vaccination records were lost, as in Ukraine we still don't have an electronic data base. Any ideas how to fix this situation? Can I do vaccination in the US after I arrive (before filling for AOS)?? Or is there other way to prove that I actually got all the vaccination??
  11. I have received an RFE for my Venezuelan Fiance to prove that she is divorced from her ex per commond law statute. The recept date is 4/17/200 and the due date is 7/13/2020. She sent me official documents in Spanish and I had them translated by a certified translation service. Her documents clearly show that she is within the common law statues of her state to be considered divorced. My question is, since everything is closed in Venezuela, including the office that appostilles, should I send copies of the original documents and the translations to the USCIS, with an explanation that because of COVID, we could not get the documents appostilled? Or should I wait until the offices open? I don't think the latter is an option. thank you for any and all comments
  12. We just received a notification that on June 4th our case was approved by USCIS! We're beyond excited and going to wait until the NOA2 arrives in the mail. But does anyone else, who recently got theirs approved (this year during pandemic) know what to expect next?
  13. Greetings! Apologies if this is not the right forum. This question concerns a K-1 situation and the US consulate in Naples, Italy. My fiancee has a K-1 visa that is about to expire (tomorrow, on June 5). She intended to enter the US on March 21, but of course due to the travel ban from Schengen's countries going into effect on March 11, she hasn't been able to travel. Communication with the consulate in Naples is difficult to say the least (they don't pick up the phone, and only respond to emails with half sentences after many days), nonetheless we've been told that although K-1 visas cannot be extended, this will be re-issued after getting another medical visit, paying the fee (and presumably) making another appointment. What we don't know is: 1. how do we even schedule another appointment at the consulate (which is a necessary condition to get a medical appointment), since the website does not offer the option 2. how do we pay the fee (same problem as (1)) Looking to collect information/first hand experiences on this forum from people who are possibly in the same situation. Thanks! Daniel
  14. My fiance received his K1 visa on March 4, 2020 in Canada. He needs to move to the US by August 14, 2020 (the expiration date of his visa). I have two questions I'm wondering as we try to figure out a date to get him here. We have not been able to get him here yet for many reasons I won't get into, so please do not comment on what I "should have" done in the past. Here are my questions: Does anyone know if we could get an extension on how long our K1 visa is valid for? Our 6 months started literally at the exact same time as the outbreak. Is there a way to delay the expiration date due to the extenuating circumstances? If that's not possible, then does anyone know if we could get an extension on our 90 day window to get married? If he gets here and the government is still shut down, we will not be able to get a marriage license, let alone file it after we're married. Our local government is currently not processing marriage licenses. Who would I talk to about an extension for the 90 days to get married, due to the extenuating circumstances?
  15. Hello, In your guys opinion do you think that, the people who had there K-1 interview in March (and was canceled) will be first in line for an interview when USCIS opens up? For example will they schedule interviews in the order canceled and moving people back who were not effected by the shutdown. Or are we on our own and have to schedule what ever's available.
  16. So here's a weird question that my fiance and I are not even sure where to begin answering. He has a full, red beard. He works at a hospital and they are about to switch his ward over to a 'red zone' for Covid-19 patients. He was told that he would have to shave off his beard and has no problem with that what so ever, it's so his mask will seal properly as he will be working in direct contact with corona patients. Our question is this: when we originally took the pictures for his medical (4) and embassy requirement (2) he has that full beard. Our NOA2 is in tansit to the embassy and god willing that will open up interviews again in the next few months, however that won't be enough time for him to grow his beard back out. Do we re-take the photos for the embassy (the medical already has the bushy ones) or do we just explain at the time of interview the circumstances? He looks quite different with and without a beard. any advice or suggestions would be appreciated. Stay safe out there!
  17. So, I was one of the people who had an appointment in Montreal on the 18 that got cancelled when I arrived in Montreal on the 17. BUMMER! Anyways, just looking for opinions and what I found out from the US Visa Info call centre. I received my US Medical on 30 Jan 2020. So according to the 6 months validity it should be good until end of July most likely. Now with the whole uncertainty of Covid-19, the Consulate itself isn't even sure when they will reopen to schedule appointments again, and I expect it to be pretty backed up once they do since a lot of people will be trying to get there. As from my discussions with the visa call centre these were my questions 1. What happens if the consulate decides to postpone the appointments further and then any applicants' US Medical then becomes expired? Their answer: You will have to get a new US Medical. 2. What if with the whole pandemic, you have to travel to obtain a new US Medical and may not feel comfortable travelling to hotspots of the outbreak like Vancouver/Toronto/Quebec to obtain a new Medical? Their answer: You can attend your new Visa Appointment in Montreal, instruct the officers that you did not retrieve a new US Medical due to the reason stated and they will offer two options: 1. Rescheduling the Visa Appointment and then getting a new US Medical. 2. Having the US Medical be couriered to the Consulate. I did not think this was very helpful...I understand that Consulate still has to follow rules and regulations - but considering this pandemic was not in anyone's control, something like allowing the use of expired US Medical if it has been expired no more than 3 months sounds acceptable. BUT, I digress. My other question I had forgotten to ask them: For those of you who had already received your K-1 in your passport, with the border still closed and the possibility of it closing longer. Has the Consulate let you know if they will extend the validity of your K-1 for entry? Or will you have to start your process over again? Not so much of a question I suppose but as a discussion on what anyone else has heard who may be in a similar situation? Stay safe everyone!
  18. I received the NVC case #, and they told me it was assigned on 03/18/20. not sure when it is sent out and they could not give me that information, but I told my fiancé to do the DS-160 which is what I believe is part of the next step. but now im confused again, and im not sure if I read somewhere that If I had to do the DS-160 as well or is it just the beneficiary? also once we have that confirmation # what else if anything needs to be done to get an interview date? Thank for your help.
  19. Hello! I have been struggling to fill out the I-129F because I do not understand Cuban addresses at all. If for example the address is: Calle XX #XXXXX E/ Calle x y Calle x Reparto Magdalena Cotorro La Habana (this is how it appears on my fiance's ID) Where does each section fill into on the form? Also, does Cuba have a postal code? If anyone could help. Thank you!
  20. Hi! I'm currently filing I-129F form with my fiance and since she is not so familiar with these government forms and technology stuff, I(Alien fiance) am preparing most of documents so I'd like to get checked if I'm doing everything right. No one wants to get RFE especially when it is already expected to be delayed a lot due to COVID-19, right? So, below are the documents of what I'm filing in the packet. - 1. G-1450, Authorization for Credit Card Transactions - 2. Cover Letter - 3. Form G-1145, Notification of Acceptance of Application/Petition - 4. Form I-129F, Petition for Alien Fiancé - 5. Passport style photo (Petitioner and Beneficiary) - 6. Copy of the Birth certificate (Petitioner) - 7. Letter of intent to marry (Petitioner and Beneficiary) - 8. Evidence of In-Person Meeting And for 8. Evidence of In-Person Meeting, I wrote circumstances of the in-person meeting within 2 years of the filing date, just like the one in I-129F form. And I put my passport page that shows the stamp, my boarding passes and screen capture of flight receipt with my name and date to support this statement. and I added 4 photos of just us on a trip and a photo of us and her mother at the airport when I was leaving. Total of 5 pages. I'm so nervous and delay of me moving there is the last thing I want right now because we've been together for 8 years with long distance and it is finally time to close it. Please let me know if you have filed similarly or if you received an RFE before for having done same mistakes like I might have done here! Thank you!!
  21. My fiance was granted his K1 visa at his interview in Montreal on March 4. It expires on August 14, 2020. As you may know, they've closed the US Canada border to nonessential travel. They keep talking about 'nonessential' as shoppers or tourists, while essential travel involves trade/commerce. Obviously immigrating to the US falls into neither of those categorires, and I cannot find any information on whether someone on a time sensitive K1 visa would be exempt from the ban or not. I spent all day trying to call USCIS, Homeland Security, Customs/Border Patrol, and emailing any government entity I could think of. The US Customs/Border Patrol says that until there's an executive order stating the details of the restrictions, they don't know who all is allowed through or not. There's nothing on the white house website yet, so all I have to go by is his speech. I also asked them if an extension would be possible, but they didn't know that either since this has never happened before. Is there anywhere else I should be looking, or people I could ask about this? I'm really nervous that we could lose our visa that we worked 11 months for because of this stupid virus.
  22. Hello, I have been with my fiance for almost 3 years now, and we are starting to plan applying for the K-1 Visa. The thing is, I'm not really sure where to start. He lives in Cuba, so I feel like things might be a little more complicated. I have a couple of questions and it would be really helpful if anyone had answers. 1. Should I pay someone to help me with the process or do it myself? 2. I am aware of most of the things that should be included in the application, but how should it be put together to send? (Binder, folder, etc.) 3. Are single-status affidavits required? 4. In terms of conversation screenshots, what kind of things are they looking to see? 5. Do documents, like the Cuban birth certificate, have to be translated? Thank you!
  23. I am an American male and I met an Egyptian guy in Alexandria early in 2019. We have been talking a lot and we've pursued a relationship and I have visited twice. We've decided we want to marry. We both come from conservative, Christian families and neither of us are "out" to our families because we know they would not approve. He plans to present me to his family as a "friend" and we will likely take pictures together with his family whenever possible because I know this would be good evidence where there is lack of family support affidavits. I will be visiting him at least once a month for a few days at a time in 2020. In July 2020, I plan to spend almost the entire month with him. I will save the tickets and receipts and we will take several photos. I have many screenshots of our WhatsApp conversations and will continue to keep them. I feel that I have a pretty solid understanding of how the K-1 visa works, and I will be asking more questions, but what I'm looking for right now is anyone who can tell me about their experience or give me tips if they've married someone from a MENA country (especially if you've married someone from Egypt). I'd also like the same thing for anyone who's gone through or is going through the process as a same-sex couple (again, especially if from a MENA country or Egypt). I'm not really sure what the best way is to go about this. Once I get him to the U. S. A., he cannot go back to Egypt. I've considered us getting legally married in Ecuador or Mexico or another place, but all those options would involve him going back to Egypt for an indefinite amount of time while we file for a visa to bring him to the USA as my spouse. So, our only real option is for the K-1 visa. Does anyone have any advice? What are some things that he and I can do that can better solidify our application when we decide to file (most likely December 2020). I want to be able to front-load the application with as much information as possible, because I know that filing a K1 from a MENA country is risky because many of the K1s from this region aren't approved.
  24. Hi, My name is Saadan and i am living in Islamabad, Pakistan. I applied for the K-1 Visa and gave my interview on Feb-20th 2019 and they returned my passport (without any paper or refusal or anything, it was just my passport). I don't know why they revoked my Visa? upon continuously asking for a reason, the U.S Embassy told our lawyer in the USA that my visa was REVOKED. (what does it mean?) the embassy is not replying as to WHY they revoked it? What is a CR-1 Visa? How do i apply? What to do? How long does it take? do i have to stay married for 2 years before applying for the CR-1 and then waiting another 14 months for the process? Please can someone help me out.
  25. Hello newbie here. I’m still in the process of gathering all the required documents to file the 129. I’ve seen here that people included chat logs. My fiancé and I communicate on WhatsApp. Would I have to print out our complete chat logs??😳
