  1. My fiancee and I got married within 90 days of her entering on the K-1 Visa but it says in her passport that the visa expires tomorrow. We have not filed the AOS papers yet because of financial issues. Is she going to be deported or something??? I read different things on every website I look at. What do we have to do now that we are past the K-1 date? Which forms do we need to fill out exactly? Please help. Thanks, J & G
  2. It's been a long process and finally we are waiting for interview phase...I want to know if there's anyone else waiting for an interview or has gone through the visa interview in Kabul, Afghanistan. My case has been sent from the NVC on June 11 2019 to the Kabul Embassy. I emailed the Embassy on June 30 2019 asking about my case status to which they said, "Our office has received your fiancee’s visa application and her case is currently in our appointment queue. As soon as an appointment becomes available, we will contact you with further instructions." I emailed them again on July 20 2019 to which they said, "As previously indicated, your finance's visa application is currently in our appointment queue. As soon as an appointment becomes available, we will contact you with further instructions." It's almost 2 months that my case is at the Embassy and waiting for an interview date. Is it usually for the Embassy to take this long in appointing an interview date.
  3. Hi Everyone, I'm becoming very impatient! I have a job offer and I need to start working from 22nd January. Can you guys help me to get an idea when my EAD should be approved by? Case is with National Benefit Center (MSC). 08/30/17 -- Filed I-765 and I-485 09/25/17 -- BIO Completed // 11/15/17 -- Called USCIS, got a referral number, no feedback received 12/05/17 -- Called USCIS, got a referral number, no feedback received 01/08/18 -- Called USCIS, escalated case to Tier 2, then escalated to Tier 2 Supervisor who told me she would call back in a few days, still waiting... On the USCIS tracker it only shows "Fingerprint Fee was received" since 09/12/17 for I-485; and "Case was received" since 09/07/17 for I-765. Its been 134 days!
  4. Hi, My name is Saadan and i am living in Islamabad, Pakistan. I applied for the K-1 Visa and gave my interview on Feb-20th 2019 and they returned my passport (without any paper or refusal or anything, it was just my passport). I don't know why they revoked my Visa? upon continuously asking for a reason, the U.S Embassy told our lawyer in the USA that my visa was REVOKED. (what does it mean?) the embassy is not replying as to WHY they revoked it? What is a CR-1 Visa? How do i apply? What to do? How long does it take? do i have to stay married for 2 years before applying for the CR-1 and then waiting another 14 months for the process? Please can someone help me out.
  5. I guess I'll start an April thread since my package should be delivered today by 8 pm. Hurry up and wait...
  6. Good Morning and Evening All. I have been scouring the forums and really anywhere I can find information reagarding all this Fiance Visa related (don't we all?). I have been attemting to find straightforward answers about filing out the DS-160 and the social media disclosure question. This is a new, mandatory question added in May of 2019 that requires "a disclosure of all social media". what an absolutly daunting task for those of us who live their lives throught the internet. here are a few questions i simply am having a hard time finding the answers for: - When completing the DS-160 for K-1 visa application and the question asks for social media handles who are they wanting them from? Me (the US citizen petitioner? or the foreign Beneficiary?). If I am reading correctly on most "help" sites it is only the Beneficiary (person applying for the visa itself). - The question asks for "all social media in the last 5 years". this is a two part problem for me. If the social media site has not been used in the last five years but still has an active user account is that still considered as part of the five years? the second part is that it says "all" but the drop down menu is a limited list of social media sites. I know it is best practice to be honest but also best practice to give no more information than is asked or necessary. So which is it? "All" or honest? - Another issue that has vexxed me is the amount of social media handles someone may have. If they are prone to starting a twitter account or reddit account on a whim because they can't rememeber their last log on or decided on a new email account how would you find out or where could you search to recover the old account handles? What if you can't remember past email accounts or handles? Do throw away accounts still count towards the disclosure? If you miss/forget about an email/handle/social media affiliation or account and it is found out later will the CO conclude you are lying or intentionally trying to hide accounts? While I understand the need for disclosing this information to the asking governement and there is no getting around it what can be done to ensure that we have fully completed this portion of the application without inadvertently committing perjury or ommissions? Thanks in advance for any and all advice, this is truly a trying time in our lives! Cheers, Lizzy
  7. Hello VJ, Anyone out there with experience at the US Embassy in Rangoon, Burma? I've been searching but it seems there aren't many posters on here for that country and very few reviews of that embassy. I've filed I-129f for my Burmese fiancé, NOA2 was received September 23, 2016 and so now we are trying to prepare for K-1 interview. I would love if anyone could tell me their experience with scheduling the interview, any tips or things to look out for, etc. Thanks in advance for any insight
  8. Hello, my Fiancé just had his interview and we are a bit confused with the CEAC status. I checked it by using the case # given by NVC and selecting IMMIGRANT VISA... Status says READY He checks it using the ID# on the DS-160 and selects NON-IMMIGRANT VISA and the status is "NO STATUS". So which is it? Why do both work? His interview went well but they asked for our additional proof of relationship/contact and pictures (which he handed over) and they gave him a 221g white form saying "Admin Review" and we will call you in 2 weeks. Gave him his passport back. Does anyone know what's going on? Or which status is correct? Thank you, Andie
  9. Hey everyone, I just received my EAD/AP Combo Card on Monday January 13. My card shows validity period from 01/07/2019 to 01/06/2020. Am I right in understanding that my card is already expired? My AP letter shows validity from 01/07/2020 – 01/06/2021. My I-797 NOAs for both EAD and AP were dated 01/07/2020. Has anyone had this experience? I assume it is an USCIS error. I have a callback with them tomorrow. Thanks!
  10. I feel like once people went through the interview process they forget about this website and about all the people waiting to hear back about their experience. My Fiance and I are pending the interview and studying dozens of "most common questions asked" ... But would love to have your personal experience with the interview and most importantly WHAT DID THEY ASK YOU? I think this site is lacking the support of AFTER receiving/ or not the Visa. PLEASE comment below, tell us how your interview went and help the rest of us. ❤️❤️
  11. I am an American male and I met an Egyptian guy in Alexandria early in 2019. We have been talking a lot and we've pursued a relationship and I have visited twice. We've decided we want to marry. We both come from conservative, Christian families and neither of us are "out" to our families because we know they would not approve. He plans to present me to his family as a "friend" and we will likely take pictures together with his family whenever possible because I know this would be good evidence where there is lack of family support affidavits. I will be visiting him at least once a month for a few days at a time in 2020. In July 2020, I plan to spend almost the entire month with him. I will save the tickets and receipts and we will take several photos. I have many screenshots of our WhatsApp conversations and will continue to keep them. I feel that I have a pretty solid understanding of how the K-1 visa works, and I will be asking more questions, but what I'm looking for right now is anyone who can tell me about their experience or give me tips if they've married someone from a MENA country (especially if you've married someone from Egypt). I'd also like the same thing for anyone who's gone through or is going through the process as a same-sex couple (again, especially if from a MENA country or Egypt). I'm not really sure what the best way is to go about this. Once I get him to the U. S. A., he cannot go back to Egypt. I've considered us getting legally married in Ecuador or Mexico or another place, but all those options would involve him going back to Egypt for an indefinite amount of time while we file for a visa to bring him to the USA as my spouse. So, our only real option is for the K-1 visa. Does anyone have any advice? What are some things that he and I can do that can better solidify our application when we decide to file (most likely December 2020). I want to be able to front-load the application with as much information as possible, because I know that filing a K1 from a MENA country is risky because many of the K1s from this region aren't approved.
  12. Hello, newbie here and I’m in need of guidance from people who have gone through this process. I have two questions that I need help with as I am not really sure what I need/have is appropriate. First question, I am currently in the process of starting to gather all documentation of meeting in person and all the pictures I have (which honestly aren’t many as neither of us are big picture takers) are snap chat pictures, meaning they have filters on them. Is this acceptable? I wish I would have known when we traveled for 2.5 months that down the road we would need photos but I just never thought about it as I really don’t like pictures. Second question, I see they need a passport style photo of both of us when I file for the K-1 Visa. Is it acceptable if he sends me a photo by email and I print it off with the dimensions needed or does he need to mail me an actual photo? I do not see why me printing one off wouldn’t be acceptable although I want to be sure all documentation I send off is accurate the first go around. This newbie is in need of help so any advice is greatly appreciated, thank you!
  13. I got my RFE today. They wanted a legible copy of one of my divorces and pictures of us together, which I put in the application. My case is with the Texas service center but the address they want me to mail the stuff is in California. Can I use a different envelope and can I enclose a video of our engagement party? P.S. Does anyone have a general time frame from sending the RFE back to NOA2?
  14. Hello newbie here. I’m still in the process of gathering all the required documents to file the 129. I’ve seen here that people included chat logs. My fiancé and I communicate on WhatsApp. Would I have to print out our complete chat logs??😳
  15. If I have an arrest, what documents do I need to attach to my petition? Court certificate of disposition? Police certificate? In addition, should I draft a statement?
  16. Ok newbie here. I asked in another forum about chat logs and whether I needed them for the 129. I understand that Morocco is considered high fraud. So we might have difficulty because I’m older than him. I am still gathering the documents to file the 129. I’m hoping to be done by the end of the month. I want to make sure I’m thorough so we are not denied or delayed any longer than we have to be. Any help would be greatly appreciated.
  17. I'm in a weird predicament, wondering if anyone else has ever used a Statutory Declaration in place of a Police Certificate when that certificate can NOT be produced? Situation: Myself (and fiancé) spent 7 months traveling together in Cambodia. We spent the majority of that time at one guesthouse in Sihanoukville without paying rent (owner is a friend) My understanding is that I need a police check from Cambodia because I was in the country for 6+ months. ----- However ---- To acquire a police certificate from Cambodia you have to appear in person at the Ministry of Justice in PP. To get the Police Cert. from them you have to provide a "Certificate of Residence" given to you by the Sangkat (community center). The Certificate of Residence can only be produced by giving the Sangkat a copy of your lease agreement. I did not ever hold a lease or pay rent in Cambodia so I can not get a Residence Certificate, Therefore, I also can not get a Police Certificate from the Ministry of Justice. I was a traveler, not a resident, despite the length of my stay. A lease can't be created retroactively, and I've read a lot of old forums on here where people described paying-off various officials to get it done - but the most recent one suggests that the Sangkat people no longer have the ability to "create" Residence Certificates when given tea-money, so that is also not an option. Long story short, I plan on drafting a Statutory Declaration and swearing an oath to the above, and that: Even if I fly to Cambodia (for $1500+) and negotiate with the MoJ (despite not being able to read/write/speak Khmer) that I can't make a Police Certificate appear because I'm unable to prove I ever held residence in Cambodia. Will the USCIS or DOS or the Consulate have any problem with this? I plan on attaching relevant documents supporting my claim, along with a sworn statement from the guesthouse owner stating that I didn't ever pay him for my stay. Thank you thank you thank you, the last thing I want is to find out at the last minute that they demand I fly to Cambodia to get this paperwork, even though I know that it's not possible for me to get it.
  18. If you are called to redo a medical in anticipation of visa issuance, can the follow up interview be scheduled quickly? In other words, do they have a special category for people in that situation so they can set up an interview fast? Faster than the standard open times, I mean ... If you have any information about this, I’d appreciate it. Thank you.
  19. Hello members! This is my first post (K-1 visa) I gave my interview it went really well i Was very hopeful, at the end of the interview the CO viewed my case for a while. i was told that we can not decide your case right now so you have to wait i was like should i wait or go home the CO told me you can go and we will inform you They kept my passport. ( My passport is still with them) my interview was on Date: 08-22-2019, i was not given any 221(G) neither they asked me in the email later. I wasn't aware of any Ceac website back then, so i didn't checked my status after my Interview right after 17 Days my fiance checked and it says ‘REFUSED’ and still it is ‘REFUSED’. When ever i inquire the embassy they send me the same generic email that am in AP and refused under section 221(G). could any one help me please to figure out whether i am refused at this time, AP or my visa is permanently denied? Thanks.
  20. Hi all! My fiancee and I are in need of some advice. We are in the process of obtaining a K-1 visa, with only the interview in Sydney yet to take place. Australian fiance is currently in US on a tourist visa during the interim period, and our original plan was to return to Australia only to conduct the K-1 visa interview and then immediately return to US once the K-1 visa is issued. We are now contemplating getting married in the US whilst fiance is on his tourist visa and then applying for an Adjustment of Status and abandoning the K-1 visa process, driven largely in part because fiancee has recently fallen pregnant. Our understanding is that it is not permitted to enter the US on a tourist visa with the intention of getting married on a tourist visa and then applying for an Adjustment of Status. However, we are not sure whether we would be viewed by US immigration as falling within this category. The fiance entered the US with no intention of getting married on the tourist visa, and only recently has this intention changed. Our question is whether US immigration would permit an Adjustment of Status application based on these circumstances, or whether the filing for the K-1 would be viewed as a clear intention to marry and thus a breach of the tourist visa. Can anybody help to advise on this!? Also, even if an Adjustment of Status is allowed after marrying in US on a tourist visa, would it be faster and cheaper to simply obtain the K-1 visa for the purposes of obtaining a green card as opposed to applying for Adjustment of Status? Thank you so much for your help!
  21. Hi all I am a K1 Visa recipient and my husband and I are filing our AOS soon. I have a question regarding the required tax documentation on the I-864, Affidavit of Support. I understand that if we file AOS before the end of 2019 our most recent tax year would have been 2018, and we've got that. But if we file in January 2020, would our most recent tax year be 2019 already, thus requiring the proper documentation for 2019 instead? I ask because the company my husband works for doesn't send out W2s until February, but we REALLY don't want to wait any longer to file our AOS because my I-94 had been expired since October 22nd. We've planned to file this December 16th but something came up, and we might have to reroute the budget for that one onto something else.... sigh (I know, I know, we're filing late, but life happens and so here we are...) 😅 So I'm thinking: 1) Perhaps USCIS would allow the submission of 2018 records due to the fact that tax season for 2019 won't be over until April 2020 anyways? 2) Perhaps we could include an explanation on our cover letter as to why we're submitting 2018 records despite 2019 ending? So yeah, I would appreciate any input from anyone who can help. Thank you all
  22. Hi everyone! I need some help with a few items on the I-864, if anyone could kindly assist: ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 4 Part 5., 1.-3. (Sponsor's Household Size) Persons you are sponsoring in this affidavit: 1. Provide the number you entered in Part 3., Item Number 29. - 1 Persons NOT sponsored in this affidavit: 2. Yourself -1 (auto-populated) 3. If you are currently married, enter "1" for your spouse. > My husband is my sponsor, and we are married, but if we put "1" then it makes our total Household Size: 3, when it's just the two of us. We are aware we shouldn't count any member more than once. Should this be "0", then? Even if we are married? ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 5 Part 6., 24.a.-24.c. My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ) as reported on my Federal income tax returns for the most recent three years was: > We are able to gather only the most recent year, 2018. Will leaving the other years blank cause any RFEs and/or denial? ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- I would appreciate any input. Thanks!
  23. Hello, My wife came to the U.S. on a K-1 and we married this past March and applied for Adjustment of Status. We have been living in Connecticut in a house owned by my parents but this past month my wife started a job in NYC so we rented an apartment in NY to be closer to her work. We now have an appointment for our interview in Connecticut, and I am wondering if we can still do this interview in Connecticut? My drivers license is still in CT and we will file taxes in CT, but we also now are staying at this secondary apartment an hour away. Will this be a problem? We really don't want to change our case to NYC since we have an interview this month and NYC is so back logged. Plus we still have and use this house in CT, just not full time currently.
  24. Hello all, My fiance & I are starting the process of doing our i-129f form for a k-1 visa and I had a few quick questions as we go through it. I hope this is an okay to post them... 1. For the Beneficiary's Parent's info, do we put my mothers current name or her maiden name? She was using her maiden name when I was born but has since been re-married. 2. I haven't been in contact with my biological father for a very very long time. If I can't recall his birth year what do I do? Can I leave it blank, put in just his day/month? 3. For beneficiaries employers, the PDF won't let me put PRESENT as an end date, I haven't given any notice at work and I have no current end date. Do I hand write in PRESENT or N/A or NONE for that area if I'm still currently employed? 4. A couple of the address sections say "Provide your/your beneficiary's current address first if it is different from the mailing address..." If my current address is NOT different from my mailing address do I skip to the Physical Address 2 and leave Physical Address 1 blank? Sounds silly but we're trying to follow it perfectly. Thank you for any assistance you can provide!
  25. Hello everyone! I am currently filling out my I-485 and I just needed clarification on a few items, if anyone can help: Note: I posted the same topic recently but put the wrong title in and forgot to add tags, plus I needed to edit the content. Apologies for the redundancy. If the site admins could delete my previous post, kindly do so. Here is the link of said post: Here are my I-485 queries: -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 3 Part 1., 25.a.-25.c. - Provide your name exactly as it appears on your Form I-94 (if any) > I obtained my I-94 from the website and it only shows my first and last name. Does this mean I leave the Middle Name item blank, write N/A, or still write my middle name even if it doesn't show on the I-94? -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 4 Part 2., 3.-4. > Is the Receipt Number the one formatted as such: WAC1990123456? > My NOA2 shows the Priority Date as blank. Should I put N/A? -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 8 Part 6., 1. - "The term 'children' includes all biological or legally adopted children, as well as current stepchildren..." > My husband has a daughter from his previous marriage, but I have not legally adopted her and she's not his dependent. Is she included in the "stepchildren" clause? (I'm uncertain about the legality of the terms is all) -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Page 13 Part 8., 63.b. - If your answer to Item Number 63.a. is "Yes," do you believe you had reasonable cause? > I answered "No" on 63.a. so this item should be N/A to me, but there are only Yes and No boxes. Should I check "No" anyway, write N/A, or leave it blank? -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Any help is appreciated. 😊
