    Canadians can come visit without getting a specific stay but they can't stay more than 6 months.  She is overstayed and I imagine that she has worked illegally or collected benefits she isn't entitled to .  She will not be getting a visa via you petition

    DV lottery visas can only be issued during the fiscal year that you won.  That fiscal year ends the last day of September.  If they haven't printed the visa by then you are not going to get one. They ddo try to complete AP for those that have interviewed but some will not finish in time.  This is why they warn you to not quit work of sell off belongings until you have visa in hand.

    To the original question.   AP is the process of validating document and verifying that you are not a member of a terrorist group.  In some countries this can be a lengthy process.  Men and woman can be in love while they hold other agendas.  Unfortunately other peoples bad behavior will slow the immigration timeline of the most legitimate couples.  It would be interesting if someone could create an AP length calculator by country so people would have a clue.

    A company the size of Morgan Stanly knows the rules and probably has hundreds of immigrants a year and HR is used to having to do this.  It was the person that interviewed you that didn't know the rules , he probably hasn't seen a EAD holder before.   They can't let you have the access you need as a non US person.   You push it and you will get tagged as a complainer and never work for them.   Wait until you have the green card in hand.

    They are correct in not offering the job.  To get clearance to PII and financial data at that level the requirements are very strict and a temporary status via EAD is not the same as a resident and not qualified to be cleared.

    There are hundreds of thousands of jobs that require you to be a US person to be hired.  It has to do with the quirks of being able to apply US law to you.  Non residents are exempt from some elements and because of that their can't give you the clearance you need.  That being said some clearances take over a year to get , so you would have a green card by the time the investigations are done , but due to the costs they won't even start one without the US person status.   Believe me you will get no where with crying discrimination.

    § 6010. “United States person” defined. As used in this chapter, the term “United States person” means any United States citizen or alien admitted for permanent residence in the United States, and any corporation, partnership, or other organization organized under the laws of the United States.      You have yet to be admitted for residence .  You are still adjusting status.

    You include all children under the age of majority regardless of custody or child support or tax agreements.  You are obligated to raise them fully if the other parent(s) die.

    Not only does everyone get in but the original USC petitioner is on the hook the affidavit of support even if the sweet young thing gets her man here.   That is for 40 quarters of work credit and that could be life if miss sweet thing never works.

    High fraud countries have their cases looked at more closely because of the length that people will go to get to the US from those places.  I recently had a older friend that had gotten into online sites while waiting for a divorce and wanted some visa advise about a young nursing student from Ghana named Bernice he had been chatting with.   I smelled a rat and started poking .  She was a nursing student on the site he used,  a teaching student on another ,  a police cadet on a third , single on all , but on yet another site had posted pictures of her family including her man.   Saved him the cost of a trip.  She tried to deny everything to keep him hooked ( yes he was ready to run over and do what it took to bring her back when he approached me )  But it is that sort of stuff that makes them  check out everything.  They will assume your lady is just like Bernice.
