    Extremely unlikely you will be granted a non immigrant visa after applying for a green card.
     
    I don't think you have many options here, EB1 has certain criteria that you either meet or you do not and if even with an appeal you got denied that is it.
     
    Your time in the US is coming to a close, OPT is attached to the school somewhat and it is for immediate employment after graduation, that ship has sailed.

    Others can correct, OPT can only be used immediately after completing studies and has to be secured in advance.

    Hey guys, I had my interview on Monday 2/12 in Tampa, FL. It was a combo interview as I still have a pending I-751 ROC. The Tampa Field office called me about a week and a bit before to let me know to bring my spouse as they would be completing both interviews at once. Interview was at 8:10 AM, got called in about 9:20 AM, both sworn in, provided our drivers licenses and my Greencard. Was asked my full name, current address, how long we've been married, reviewed my travel history (which is extensive, I've traveled back to Canada about 4-6 times a year since I've lived in the US, plus another trip to the UK, so she had to add up the days to make sure I had enough days for the substantial presence test. I was asked about my employment, what I do, and then the regular security questions as asked on the N-400. We then jumped in to the civics and history questions, passed no problem. Retook a photo for my naturalization certificate, and she let me know I had passed my test, however she could not give me an official result today as my I-751 had not made it in time, but she had made an urgent request for it. Tuesday (2/13) my I-751 case updates to "Case Transferred to another office" and by Wednesday (2/14), I see "Your case has been recommended for approval" and "Oath Ceremony to be Scheduled". YAY! Overall, very easy and so relieved.

    Today both I-751 and N-400 were approved and oath was scheduled for March.

    Very odd that she already had an interview and this is the answer. Something is amiss. After the interview she should have had an answer - approved or not, lack of documents, anything.
     
    I'd try to contact USCIS but that's not a guarantee of anything, the first contact will be with a tier 1 person that usually is not much more than someone reading ready answers. Maybe try for a Tier 2, but at the same time contact the local representative via any means to get this process going. You/she will need to be on this constantly until is solved, did she get an EAD? Is she working at all?

    Then, she needs to get on a plane with that Green Card and return to the US.  She can board a flight with an expired 10 year card.  She might have to answer some questions at the border.  Once inside the US, she can file an I-90 to try to renew the card.

    I don't think this will be scheduled in the first semester, which then puts me in recovery between July-October. It is not inconceivable that by September I'll have an interview date.
    Just trying to plan ahead when you have no idea when things will happen...

    Beauty Oh please do not delay surgery ..even a Brazilian Beauty Procedure will keep the N-400 alive . 
     
    Schedule surgery and if interview date comes during recoup , send request for a specific date along with Doctors Note . —“ Kindly reschedule on or after  xxx date as I am recovering from surgery “
     
    They may automatically reschedule in a month …by mistake but you are ok to again postpone .

    Had my N-400 interview on Tuesday. Everything went well, the officer mentioned she didn't need to interview my husband, so she was going to approve to the I-751 as well. This morning my I-751 updated to case transferred to another office, so I should see an approval notice soon.

    I recommend you mail in another copy of the response , a letter dated today citing your conversations , in your best Damsel in Distress prose. 
     
    As soon as it’s mailed out , please reach out to Congressman , and ask that they intercede since you are afraid of a repeat . Also write to Omnbudsman, to report issue .

    If applying for citizenship is something you want you can do it the moment you're eligible, no need to wait until the I-751 is done

    Daughter had her interview this morning in Arlington, VA. The officer asked her 6 civics questions, went over yes and no questions on the application. Her application was approved, but no oath ceremony was offered today, sigh. They told her to anticipate for oath notice within 4-6 weeks. I was so looking forward to be done with USCIS for good and yet have to wait again.

    OK. Just make sure you don't lose GC for educational purposes. Sometimes withdrawing N-400 is the right thing to do. You may also want to consult with immigration attorney. If you hope USCIS approves your case, make sure it's not approved in error or by misrepresentation. Because this will put your citizenship at risk for the rest of your life.

    Rooting for you - passport waiting times are way more reasonable now than months ago, there's a good chance you will get it on time! And even emergency ones, I'm sure it's easier to pencil in those when the line isn't 4 months deep

    Unfortunately, you have made several serious mistakes.  I wish you had come here before filing :
    1.  Your mother can have no derivatives. She is an immediate relative of a US citizen.  You need to file a separate I-130 for your brother.
    2.  Your brother cannot adjust status through you as his priority date will not be current for more than 10 years in the future....maybe 20 years.
    3.  Your mother, as a legal resident, can file an I-130 for your brother, but it will be several years, minimum, before his priority date is current.
    Do not allow your brother to file another I-485 now.  It will be denied also.  If his I-94 has expired, he is out of status.
    I suggest you find someone who is knowledgeable of the process or an immigration attorney to help.

    I think this is the important piece.  If I was looking at a case where someone had been an LPR for over 16 years and was suddenly attempting to naturalize under the 3 year when eligible for the simpler 5 year, I'd probably question it.

    Our package was finally sent today. There were some last minute dramas but I feel like I’ve done everything I can possibly do. Last post for some time. Thanks again everybody who helped me through the last few months on this thread. I cannot thank you all enough.

    Yes, assuming your extension letter is still within its validity period, your extension letter in conjunction with your expired card will remain valid for travel purposes, if for some reason your new card has not arrived.
    A stamp will also work just fine should you manage to navigate the muppetshow of actually getting an appointment. 
     
    In the grand scheme of things its a nice non-problem to have really. Don't worry about it.

    I strongly advise against the use of any type of marijuana (MM or rec) for immigrants, regardless of state laws.  For some, it could be an extra incentive to naturalize under the 3 year rule if eligible.

    Marijuana is Federally illegal. He will have to disclose use and why at his medical. If it used for medical purposes then the MD will evaluate it. If is used for mental health purposes he may be referred to have another evaluation with a psychologist.
