    Scheduled oath for June 14, which is a special ceremony at the St Louis Arch 🎉
     
    I requested that my oath to be scheduled mid to late June if possible due to surgery and the officer did put me in the right pile for it, extremely thankful for that. I will be recovered and got a nice special ceremony. The end is near everyone!

    I got recommended for approval today in the Dallas office (Irving)!
    It seemed like I would never get here, but thank goodness it's finally (almost) over. I sent in my N400 application 01/28/24....3 weeks after I had my second baby 👶. on 4/2/24, my interview was scheduled for today.
     
    I was a little anxious because traffic was rush-houring the way I should have expected at 7:50am. My appointment was at 8:45am and the GPS was telling me I would be 3 mins late. I ended up getting there right at 8:45... which is not ideal but it was fine. I went through security, checked in and had my fingerprints and picture taken. Went upstairs, then waited about 10-15 minutes before they called my name. Another person stood up and was walking towards the officer. To her, he was like, "not you, the person behind you." I asked him how he knew it was me, he said he double checked my picture before he came out.
    I went in the office and sat down. I had a thick folder with all my documents organized and labeled. I'm almost sad I wasn't asked for anything besides my drivers license and green card lol. I had started preparing the folder the moment my interview was scheduled. He asked me to stand and swear to tell the truth. He then asked basic questions....my name, dob, address, if I'm married, husband's name, kids' names.
     
    Then we began the Civics test - Questions were:
    There are four amendments to the Constitution about who can vote. Describe one of them Who is the Commander in Chief of the military? What is the capital of the United States? During the Cold War, what was the main concern of the United States? Why does the flag have 13 stripes? Who lived in America before the Europeans arrived? After questions, he asked me to read a sentence on the iPad "When is Columbus Day?"
    Write a sentence on the iPad "Columbus day is in October"
     
    Then we went through my application just answering the yes/no questions.
    He typed some stuff for a minute or so then told me congratulations that I had been recommended for approval. Said I would get a notice in the mail with the time and date of the oath ceremony. By the time I got home, the letter was already in my documents in the online portal. Scheduled for 05/22/24.

    My I-751 was approved, and N400 placed into "Oath Ceremony to be Scheduled" queue. Exactly three weeks after interview. Interestingly the I-751 got approved at around 6pm Friday, then the N400 showed approved/oath ready to be scheduled at midnight.

    Yes, multiple times (I've had multiple denials).
     
    That letter is a) ridiculous and b) has no legal basis. 
    But USCIS never make up their own rules do they? (answer: they do, as I have discovered).
     
    You can have a presumed abandonment of status, but that has absolutely nothing to do with the I-751, and shouldn't even factor into the adjudication of it, and hell, in this case it isn't even a year, which is the higher threshold.  Between six months and a year absence, you may have to prove continued ties to the US at your POE, and may have a presumed abandonment until then. 
    But thats presumed , and as a LPR you still have the absolute right - endshrined in law - to a hearing with an immigration judge, when presenting as a LPR at a POE. There are a multitude of valid reasons for an extended stay out of the US and if you have maintained a dwelling, mailing address, phone, bank account etc, you have retained ties to the US. 
     
     
    Just get on the plane, present your still valid stamp and see if you are stamped in as LPR/ARC or paroled in. Don't show this letter to the airline, to CBP, or anyone - it complicates things. Calling USCIS in this instance was also a waste of time and possibly a mistake. 
    No need for the I-290B either at this point as it'll probably be rejected due to the deliberate nuances built into that particular filing (my opinion differs here compared to that of FAMILY).Instead, I'd be refiling a new I-751 as soon as you get back if I were you, which costs the same as an I-290B. And then don't leave for such a long period again. 
     
    Repeat: You remain a LPR until an immigration judge says so, and this letter does not change this. As much as USCIS think and act like they are judge, jury, and executioner, they are not, and that is a very good thing. USCIS suck.

    The stamp will still be valid until expiry.
    Regardless of the scary denial letter, in law you remain a LPR until an immigration judge says otherwise (with a final order of removal) and you are entitled to a hearing with an immigration judge before that happens.
    If you were denied last week it is highly unlikely an NTA has been issued already, and zero chance a hearing has been held in abstentia on that timescale. So you can relax..a bit. 
     
    So, you are good to board and travel, and with a stamp you will have the customary slightly annoying but polite visit to secondary to verify your status once you land. 
    I've done it myself many, many times with a stamp after denial... with the slight caveat that I've only travelled after refiling and having a new receipt number in the system.
    I've never travelled after denial but before refiling. 
    Now, in your situation, they should stamp you in as as normal (which would be stamped ARC or LPR), but what should happen, and what does happen may be different. Whether they do that or parole you in I'm honestly not sure. 
     
    Please update us as as to what happens, as info for an entry under these circumstances is seriously lacking, and I can add it to my bible which will help many, many, others (including myself). 
     
     
     
    You also need to go to the EOIR site HERE and stick your A# in and see if anything shows up. Please post back the results of this asap. 
     
     
    Also, an I-751 denial has little to do with excess periods out of the US, and that is very odd if it was denied on that basis alone. That would be dealt with very differently. Can you post the exact wording of the denial letter (or a photo, redacted of course)?

    That probably means they you to send up to date marriage bonafides for you to be approved since your current file is now 3 years in the past. Lots of cases get approved with no interview after replying to an RFE in these circumstances.

    I would file an N-400 (if you qualify) before filing a WOM.  I have seen only one or two I-751s processed within 90 days....and those were used to boost USCIS numbers.

    It's fair to assume you cannot naturalize while in the 90 day window. I wouldn't worry about it for few more months until you hit at least 6 months of waiting.

    You will need to pay the new increased fees. The previous filing will not preserve anything and will be treated as a rejection…
     
    The problem with banks /credit cards rejecting payment has been significant….am wondering if consumers will unite for a class action lawsuit soon .

    My ROC has been transfered to the local office and the N-400 is now actively being reviewed. Considering how these combo interviews usualy go, I think the officer that did my interview was just being nice when he gave me the full approval on the spot instead of "can't decide today because I need the ROC first". I'll take it!

    Ok, you ignored my comment so I'll comment one last time. If your expectations are 3 months for a green card, you have a huge chance of being disappointed, stuck in the US and not able to work for much longer than that. I hope I'm wrong and you are one of the lucky ones. Statistically it is very unlikely.
     
    Edit: I checked your timeline and you are not in the US yet? There's a lot of time between today and the fee increase, if the cost is so prohibitive just start working on your application now and submit it as soon as you can, avoiding all issues with no AP/EAD.

    You seem to expect:
    1) USCIS work fast and provide consistent experience
    2) People on USCIS help line to tell you truth
     
    Neither is true...
     
    4-6 weeks for checks to get cleared and receive notice in the mail is the norm. I wouldn't worry about checks clearing or receiving notice in the mail until May 5th or so.

    Hello guys
     
    I had my oath ceremony today at the Courthouse here in Miami, FL.
    Exactly 15 days after my Interview. It was beautiful!
