    Biometrics fee covers the cost of running background checks. When they re use previously captured biometric information, what they do is instead of taking a new picture, new signature and capture fingerprints, they use that previously captured information. They don’t use the results of previous background checks. What if someone committed a crime in the past 2 years? They still need to run new background checks on that previously captured information. It cost money to run those background checks at other agencies. If they return the money every time they waive a biometric appointment, they won’t be able to clear background checks and approve applications.

    I think you are referring to combo interviews. When you file N400 and your ROC is pending, if by the time your N400 interview is scheduled, If ROC is still pending, then is very likely they conduct a combo interview where first they interview both spouses for the ROC part and for Naturalization they only interview the petitioner. No matter what I have never heard a naturalization interview where the spouse is required to attend.

    It is impossible to know, they do not follow the same pattern. Sometimes is super fast sometimes it takes over a year. Piece of advise, if you are in the middle of an immigration process do not leave the country unless is for a short period like a week or two.

    If it has been 19 months since you initially sent ROC it could be due to a couple of reasons. What service center is reviewing your case? If you were originally routed to NBC then most likely your case is in a queue at your local office waiting to be scheduled for an interview. Most cases at NBC have to wait for a very long time, and is not because the service center is slow, the delay occurs at local offices. If your case is at another service center, if for any reason they had a delay taking a decision on your case, like over a year or so, they sometimes send RFE to get up to date evidence before they can take decision.

    I read so many stories about rejected applications just because they couldn’t process cc payment. It takes a while to get it back. I think it’s just safer to get a cashiers check. Funds are wIthdrawn immediately and are only available to them so no way they can miss it.

    Hi Everyone, especially EAC filers.
    This morning at 9:30 I got an e-mail stating new card ordered. 315 days into the process. No interview or RFE. Stay positive if your still waiting. Notifications come when you least expect them.

    I have heard of people speaking with agents and finding out that their cases are at a local office without getting an update. Other people get the ready for interview update without being transferred before. At this point is pretty obvious they don’t follow an exact pattern with every case. So many millions of cases they process a year that it must be a challange to keep a consistent pattern.

    If you have that message of new card being produced then your case was approved. That is usually the first message, followed by your case was approved in a day or two. So congratulations!!

    I don’t think this is a regular case that you can do it on your own. You might have to hire an experienced immigration lawyer that would better assist you. He might have dealt with something similar before and know exactly what to do. Good luck.

    If it was me, I would consult with an experienced attorney, not only they can provide guidance but also they could help to redact the letter explaining the reasons and the outcome of the incident. Simple cases they do not need an attorney but some they do require one.

    Send tax transcripts of previous years and a copy of 1040 you sent for 2020. The only thing IRS will send back is the return money.

    Why would they refund the biometrics fee? It is not only to capture biometric information. Every time an immigrant apply for certain status, they are required to complete background checks before a status is adjudicated. Reusing biometrics information IS NOT reusing background checks. They reuse the previously captured information, fingerprints, picture, signature. That is all it does, now they have to run background checks again using that previously captured information. And guess what? It is not free, it cost money to run those background checks! So if they return that fee, they won’t be able to tun background checks and no status can be adjudicated.

    Take every piece of proof you have, just don’t hand it over unless specifically asked for. Your passport and letter 797 is enough evidence. Is what their website says, they only need to run it through the SAVE system. It might take 7 to 10 days to hear back but then you have to go back to complete the application.

    Back when I did AOS, after sending the package and receiving the first 797 letter showing they accepted the forms, with that form is enough proof in Texas to get a DL, and I did get it showing that letter and my passport.

    The main issue is that years ago nobody knew anything about asylum. Somehow in the past 4 years all this immigrants from central america at the beginning and now also from south america and even from africa, they now know about the asylum system, that it takes years to get an answer and while they wait they can stay and apply for EADs, request certain benefits like food stamps and other things that regular legal immigrants are not allowed to request. So just to mention this past march, over 160.000 people crossed the border and now they don’t just hide and try to get deep into the country, now they turn themselves to CBP and request asylum. 160 thousand last month, how can the government provide for that many people every month. Then they apply for asylum and pay $0 for the application, $0 for the EAD, and who is processing all those new applications? Disney? Nope, USCIS, and how is that agency funded? By the government? Nope, mainly, around 97% by the fees that legal immigrants pay for their applications. 
    So if the they want to apply for asylum fine but they should be paying their fair share.
