Hello all,

I have a question regarding the tax returns one can submit in order to prove the marriage is real.
How important are those and how important would the most recent one be?

I am currently preparing everything and want to send off everything by the end of the week. However, we do not have our 2020 tax return back. We filed months ago, but nothing so far from the IRS.

You will include whatever you have so far, which would be until 2019 tax return, and if uscis will want to see 2020 as well, they will send an RFE. They may not as well, depending on your other supporting evidence.

Removal of Conditions

02/06/2021: Filed and package sent

02/10/2021: Received by USCIS

03/18/2021: NOA 1

07/01/2021: Biometrics waived

09/27/2011: Case approved, no interview (K1 visa)

Timeline

When we went through the process, we filed in April, before our prior year's tax return was complete.  We did not get an RFE, but we did take a copy of the latest return when it was time for the interview.  USCIS knows the IRS is slow this year - especially since the due date was extended.

 

Go ahead and file.  You may wish to add a note to your cover letter stating the date you filed, but noting that the transcripts are not yet available.
