I am a Conditional Green Card holder, and I have my I-751interview to remove conditions, on Aug 23.

 

I filed my petition jointly on May 29, 2019 and remain happily married to my spouse.

 

The letter I received, under the section titled "Who should come with you?" does not mention my spouse; it just mentions attorneys, interpreters and disability assistance.

 

The letter only mentions the documents that I should bring: it does not mention my spouse.

 

My spouse did not receive a letter addressed to her: does she need to attend the interview?

 

I have tried calling the USCIS Contact Center for clarification, but the automated system is not helpful, and just provides me with canned responses and status updates.

 

Has anyone, who filed jointly, received a similar letter and attended their I-751 interview on their own?

its a joint petition. yes they should attend.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Thank you for your prompt response!

What is the basis of your answer, i.e. is there a document that explicitly states that the spouse of a petitioner on an I-751 must attend?

 

I would have thought that the letter I received would have stated everything (and everyone) who was needed for the I-751 interview? And that, these requirements would be clearly stated.

the fact it is a JOINT PETITION is the basis for my response.

 

but show up without your spouse. see how it goes.

This is up to debate here on VJ. Mine said the same. I followed exactly what it said and went alone. That was 4 weeks ago for my N400 interview. I was not even asked where my spouse was. 

 

Unrelated, but @debbiedoo I have not seen you in a looooong while. I hope you are of great health

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Thanks for your thoughtful reply. I too think that this is up for debate, especially since NO WHERE on the letter does it mention the need for my spouse to attend.

 

USCIS could be keeping these interviews to only the conditional/permanent resident due to COVID.

 

Is there a thread where this issue is discussed in more detail? I like that you (helpfully) gave your actual experience, which is worth a lot more than the random opinions I have encountered. :D

PS meant to attach this additional information, from the letter, which explicitly states what is to be done for joint petitioners.

Yes, with a joint i751 interview the spouse MUST attend, if not, there is a good chance of the ROC being denied or if you are lucky to be called back for a second Stokes interview together.

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Thanks all for replying to my question: based on your answers (and what I've learned from asking others IRL), my spouse and I will both attend the I-751 interview.

 

It is very annoying that the USCIS letter is not clear on who has to attend, but thanks to you all for helping me to clarify the requirements.

Could be because the letter is generic, they don't produce one letter for those who filed jointly and then another for those who filed with a divorce waiver etc. Everyone who gets an i-751 interview gets the same letter.

N400 interviews are exclusively for the petitioner. ROC interviews filed jointly, both the petitioner and the spouse must attend.
