Hi everyone, 

After waiting 19 months for any news about our ROC, we finally requested an update in April. This prompted an RFE from the USCIS, which we sent in in May. On May 19th the status got updated to "response received".

On June 11th it got changed to "Correspondence Was Received And USCIS Is Reviewing It".

It's now 72 days since they received our response. Does anyone know how long it typically takes for them to make a decision?

 

Frankly I'm starting to feel like a prisoner, I haven't been able to visit my family for almost 3 years now. And that's taking a toll on me.

Go ahead and file N400 online. You are eligible

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

While the lengthy processing time sucks, it doesn't stop you from visiting your family. You can travel while it's pending.

Extension letter expired and we would have to get an I551 stamp. As far as I'm aware of its impossible to get an appointment unless it's an emergency.

 

But maybe i'm misinformed?

No. But time is going. So why not kill 2 birds within the same timeframe as opposed to waiting for one to finish, then doing the other?

Just make sure to file online. It is easier and guides you on what to submit. If you had done it 11 months ago, you would be a citizen by now.

Gotcha.

The reason I didn't do it is because i'm not sure I want to get US citizenship. I haven't made up my mind yet. I already have 2 other nationalities.

I'd say not having an evidence of LPR can be considered an emergency. I'd try to get the appointment.

If it has been 19 months since you initially sent ROC it could be due to a couple of reasons. What service center is reviewing your case? If you were originally routed to NBC then most likely your case is in a queue at your local office waiting to be scheduled for an interview. Most cases at NBC have to wait for a very long time, and is not because the service center is slow, the delay occurs at local offices. If your case is at another service center, if for any reason they had a delay taking a decision on your case, like over a year or so, they sometimes send RFE to get up to date evidence before they can take decision.

@Figtrees hello,

I just got an extension too and I hope they send me the biometric appointment soon 😞

Anyway, you can travel abroad and see your family especially if you the biometrics already  then you won’t have the issue that they are gonna schedule it while you’re outside the country. Your extension is an extension of your GC it’s valid for traveling, working etc together with your expired GC. You don’t need an emergency to get the stamp in your passport since you need that stamp pretty much to do anything even renewing your driver license for example. They are going to let you get the stamp just tell them your extension is expiring soon and you need the stamp to prove you’re legal here.

Since you received an RFE it's a sign they're trying to approve you without an interview, else they would have put you in line for an interview and you would've brought more evidence to the interview instead.

 

Depending on if your RFE response was good enough, you could be very close to an approval. In that case filing the N-400 could be a big mistake as they often "pause" the i-751 and wait for the N-400 to get processed so you get interviewed for both at the same time (a so called "combo" interview). If it was me I would definitely not file the N-400 at this point, but it's your choice. 

 

If your RFE response wasn't good enough and they put you in line to be scheduled for an interview for your i-751, then there's no harm in filing the N-400 if you want to, as then you'll have an interview anyway and may as well have both together. 

 

And like others have said, no one has stopped you from traveling to see your family. You can get a stamp in your passport if your extension letter is about to expire or is already expired. No emergency needed for this at all.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

It's actually 24 months in August. But I requested additional information at 19 months.

 

Originally I sent it to Texas centre, but they forwarded to Potomac for an to me unknown reason.

I received the RFE a week or so after I requested an update. Not sure if this is correct,but it seems like that request prompted action.

 

Since it's been 73 days since they received the rfe response, I requested another update.

Besides the traveling, I haven't really been in a situation that I need the stamp yet. I kept hoping every month that I would receive an update.

 

I'm going to call next week for an appointment.
