    You should be aware that this smells like a case of visa fraud and using the VAWA to get rid of you once he got the green card.
    You need to think about protecting yourself.

    If so, he would not have move to his brother's state to work and chatting up another woman so fast.
    Entered in August, new affair occurred in Oct, barely 3 months in US.
    Normal people would want to spend time together with their spouses after entering US, instead of living separately.
    Probably his brother or sister in law knows about it too, only you don't know.

    Just forgot to mention how is she supposed to do it. Can't adjust on K1 through anybody other than petitioner. No marriage, no way to stay in US (other than VAWA which is not the case here).

    Are you sure he is even her brother? Maybe he is a father of a child? Or maybe she wasn't raped ever? Maybe she kidnapped her child without the knowledge of the father? Sorry, I am just thinking out loud. I am sorry about your situation and I agree with others - try to get your marriage annulled and take all steps to protect yourself. Good luck to you.

    If it is not a legal marriage in the place where the marriage occurred, then it's not a legal marriage for US immigration.
    It doesn't matter that it's legal under Islamic laws. The marriage has to be legal in the UK.

    He arrived 4 weeks ago.
    Within that 4 weeks he moved state.
    Unclear as to whether he ever started at the College he signed up for. Or ever had any intention of so doing.
    Presumably has not paid the college. They have no doubt reported the situation.
    The way I read it is that he is considering going to another College, not that he is.
    Obviously needs a good lawyer, I have a feeling this is one of those cases that will not be updated.

    No, she can not work without the EMPLOYMENT AUTHORIZATION DOCUMENT (EAD).
    "Wouldn't technically be legal" = illegal
    The state ID is a state specific issue. It depends on your state.

    The application clearly states that you have to report any time you were cited by an officer. There's nothing in the instructions, the application, the USCIS policy manual, or the naturalization guide that says that you do not need to report traffic offenses. The only thing that it says is that you are not required to provide proof that you have paid all fines for traffic offenses below $500 that are not DWI related.
    You absolutely have to list this on your N400 - there's no question of that. Furthermore, even though the instructions say that you do not need to provide proof, in about half the cases of traffic incidents reported here on Visa Journey, the interviewer has insisted on seeing proof of final payment or court disposition, regardless of the amount of the fine.
    Having said that, there's no reason that this should delay your application if you can provide the necessary documents.

    The OP admits to drug use and is asking about lying about it. Participants in this thread have been condoning this possible action or have not been speaking out against it.
    This thread, and several responses in it, violate this tenet in the VisaJourney Terms of Service:

    First, Obama has not announced any "amnesty". He doesn't have the authority to do that without Congress passing a law authorizing it. What he has announced is an expansion of the deferred action program he previously created for people brought to the US illegally as minors, called Deferred Action for Childhood Arrivals, or DACA. The expansion will allow more people to qualify for DACA, as well as allowing parents of DACA eligible kids to apply for deferred action. It also expands the provisional waiver of unlawful presence so that more people are eligible to apply for the waivers while in the US.
    Just to be clear, deferred action is a temporary stay of prosecution. It's not amnesty.
    The terms of the program have not been finalized. Currently, it requires five years of continuous residence. If it ends up working like the DACA program then brief periods of absence before a cutoff date (it's August 15, 2012 for DACA) would not count against continuous residence. After the cutoff date then ANY absence would disqualify the alien from eligibility.
    Again, if it works like the DACA program, then she would be able to apply for advance parole once she had been approved for the deferred action program. With an approved advance parole, she would be eligible to leave the US and reenter. If she hasn't already been approved for deferred action then she can't apply for advance parole. If she left the US without advance parole then she triggered the 10 year ban. She won't be allowed back into the US until she applies and is approved for a waiver of the ban and an immigrant visa based on her marriage. This will all begin with her husband filing a petition for her.
    She really blew it by leaving the US.
