  6. No. The whole basis for adjustment of status is a valid, legal marriage to a US citizen (immediate relative of a US citizen) - the one that produces an official marriage certificate. Common law marriage does not grant one a status of an immediate relative of a US citizen. If you apply with anything else it will be swiftly denied. This is irrelevant to your case. Your fiancé is not naturalizing.

  15. I was going to say file online and wait for them to RFE but I re-read the instructions for I-90 and I think filing paper is better actually. I’m basing it off of the following instruction from USCIS https://www.uscis.gov/i-90 under filing fee: “If you are filing the Form I-90 because your current Green Card contains incorrect information due to a Department of Homeland Security error, such as a misspelled name, you do not have to pay a filing fee. However, you must send us: The original card that contains the incorrect information; and Evidence documenting your correct name or biographical information. The emphasis is that YOU must send it, rather than they will collect it at some point . Knowing how USCIS can be (unpredictable), I’d just send it by paper along with the erroneous card.

  17. Do think about applying for at least the EAD. I’m not sure which state you’re in but a lot of them won’t issue a driver license without an EAD or GC. You can’t use your country’s DL as a long term solution since you’ll be treated as a resident and not a tourist. Also, think about if you’re okay being completely dependent on your spouse for potentially many months without the ability to work and travel and possibly even drive which is a problem if you do not live in a large metropolitan city with an excellent public transportation system. Just a heads up as I went through K1 journey myself.
  18. Removal of conditions won’t come until your 2 year conditional Green card is close to expiring. So it’ll be adjustment of status when you come to the US on K1. K1s don’t need to file the I-130 alien relative petition (that’s what the I-129f is for) as long as you marry within the 90 days of authorized stay that K1s get upon entry. EAD and AP are optional - they’re meant to give you an opportunity to travel and work while you’re waiting for your adjustment of status (I-485) to be approved. They’ve historically taken a while to process. So if you’d like to apply for those, they will be at extra cost after April 1, bringing the total to $2540. I find VJ guides more helpful. They can be found on top right when you click the 3 lines (if on mobile) under immigration guides.

  21. Sorry you’re going trough this. This could’ve been avoided if USCIS did their jobs better. Yes, the only option is to file I-90. You won’t have to pay the fee as that’s USCIS error. Unfortunately it cannot be expedited. You don’t have to include the GC in the submission. They will send you an RFE to send it to them when they’re close to adjudicating it.
  22. Yes, you can change, I did it. But you will have to do it at NVC stage and try to catch it before it ships off to the consulate, otherwise it will take months to have it rerouted from one consulate to another. Change of consulate/countries doesn’t work at the USCIS level as they automatically assign to the country where the beneficiary indicated they live when filling out the I-129f.
  23. Related threads have been merged. Please confine all further K1 questions to this thread only. Mod Hat off: If you’re referring to the section in I-129f where it’s asking you for the I-94 stuff, if you’re not currently in the US, you do not fill out that section.
  24. I-129f fee won’t affect you as you field before April 1, 2024. once in the US, AOS fees have gone up significantly. Besides the $300 increase just for I-485 (from $1225 to $1525 - this includes the biometric fee as well), employment authorization aka EAD aka form I-765 and travel authorization aka AP aka form form I-131 will no longer be free when filing with I-485. You will have to pay extra for those now. So the cost for the package went from $1225 to $2540. You can see a thread here discussing the fee increase:
