    Many thanks for such a detailed response. The RFE was linked to a divorce certificate I forgot to include but additional evidence was also required for something referenced in Section 3.

    I would give them what they asked for regarding the RFE and nothing more.  I wouldn't give them anything which might confuse them. Anything else could be grounds for them generate additional RFEs.

    There are very few things required with the submission of the I-129f. Wait for the RFE and send specifically what they ask.

    This likely happens a whole lot more than we hear about it on this forum. I vaguely remember a couple of cases in the pass that were along the lines of the OP. This is an extremely difficult and embarrassing situation. I admire the courage of the OP to come here and discuss his options. But it also makes me wonder if he did it to get the 
     
    I want to share a phrase I learned that should help you decide on what to do.... "Don't light yourself on fire to keep someone else warm."
     
    You may love her, desire her, and she has a lot of things you want in a wife. But she may not be for you. You can love someone without being with them. There is no governing, spiritual, or physical law that states you HAVE to marry someone because your love them. Some times people are not good for each other no matter how they feel about each other. I'm all for giving someone a chance if they make a mistake. But this may be something that is beyond restoration in my opinion.
     
    Here are things to consider:
    You will be responsible for her and the child, even if you two divorce later. It is in the affidavit that you will sign for her. The bio father may want to be in the child's life and could very well have the right to say whether of not the child can leave the country. Having a child is stressful for any relationship. You two would be going from young loving newlyweds to a full family with huge responsibility and trust issues. You will not have given your marriage enough time to develop. The baby will multiply your financial expenses 10 fold. You don't seem the know the true nature of your fiance and the biofather's relationship. From your follow up post it seems you have little information about him. She may had some serious feelings for him now. Obviously, she has some feelings with him if she produced a child with him. But it could very well be more than a fling. This situation will put an extremely negative variable in your relationship. Immigration issues, assimilation issues, and financial issues are already waiting to put a burden on your relationship. Now you have to deal with trust and uncertainty. To answer your question, it is possible for you to go through with the K1. But there may be some tough questions during the interview. If you are there during the interview (and I HIGHLY suggest you be at the interview if you move forward with this), she will need to be 100% truthful. The interview is not the time for surprises to pop up. And those officers may ask some really tough questions.
     
     
    At 31 y/o, you have to realize that life is just now starting for you. Don't start it off on the wrong foot. You have a choice to direct the path you want to take. You can start a successful business or backpack around the world if you wanted to. You can still care for her and be there as a friend to her. 
     
    If you do decide to continue... at least make the choice to delay the interview. Tell her you need some time before move forward. Give yourself a few months or even a year before finishing the process.
     
    I truly wish you the best of luck. And if I knew you personally, I would have a case of whatever your favorite beverage waiting for you.

    I did the exact same thing. I had two divorces, but only put one in the packet. No RFE. I took an official copy of the missing one to the interview in Saigon. No big deal. They didn't seem to care.

    He has been talking about changing to a merit-based immigration system since at least 2017. There's obviously no guarantee at this point, but it looks as though his idea of a merit-based system is mostly targeted toward work visas, as described on the White House website's article posted after the work visa EO was announced (https://www.whitehouse.gov/briefings-statements/president-donald-j-trump-putting-american-workers-first-restore-economy-greatness/). It specifically mentions the move to a merit-based system as "taking action to reform our H-1B immigration program." 
     
    Again, this is no guarantee that K1s wouldn't be affected if there were such a change, but it doesn't seem as though that would be their focus. Unfortunately, this is another "wait and see" situation.

    In my opinion, all of those photos will be rejected. 
     
    I recommend that you both shave your heads so your ears are visible. Also, your fiance should have his facial hair waxed. I would then grease his face so it is shinier. He may also want to think about a tuxedo.
     
    The background color should be #16 glossy eggshell white. Anything else, and USCIS will deny the application, keep your fees, and bar you from applying again for 1 year.

    @Claire1212 No sense in kicking yourself while you're down.....You can't change the past so it's best to be optimistic for the future! You'll be together one day. It may not be as quickly as you want, but it will happen. That's what I tell myself everyday while waiting on our K1 too. ❤️

    Wow! You seem depressed. This is such an effortless process to do. Just do what they ask and get used to waiting. Waiting is not going to stop here. It's going to be the same for the next process alllllll the way to naturalization if indeed that is your goal.
     
    No one can predict the future so it's fruitless to be concerned with it now when you have the process in front of you to complete to the interview. When you are ready for your interview the scenery will have changed and new challenges will exist. Good luck and stay engaged.

    Additionally, the Current Month's VJ member I-129f CSC approvals is at an all time high in regard to number per month, @ 94 to date from June 1st - 26th. I've only looked back as far as mid 2019 but since then until now there has been no other month to even compare to those numbers. So for right now, it looking pretty good. Good luck

    Going back to the original Executive Order (EO): 
     
    "Section 1.  Suspension and Limitation on Entry.  The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation."
     
    Since K1' visas are not immigrant visas (see Dept. of State link below), the EO does not apply to K1s. Therefore, K1's should not be affected on the USCIS level. However, as other users experienced there are delays on the Embassy levels due to each country's own Covid-19 reopening procedures.

    K1 Visas are a non-immigrant visa according to DOS, and as such are not affected by the EO. I spoke to an immigration attorney confirming this. No need to worry.

    Thank you for taking the time to write all of that and stating your opinions. You assume you know who youre speaking to and who it is that wrote this post based on what you see, that's fine. Let me put it clear that not once have I asked any US Citizen to contact their representatives on my behalf.  This post was for others that are currently in the K1 process under this whole situation with the EO, bans and embassy closure to come together in a way and ask for clarity on the K visas. Apparently not taken good by some.
     
    I am aware this is a public forum but apparently asking for kindness is where the line is drawn. I am grateful for veteran members as they help many of us in times of need however  even though they are entitled to do it why be condescending or rude? He in specific, did not go through what we are going through right now and that is why I said.  "This issue does not affect you personally so you wouldn't know or understand exactly what we are going through. Be a little more sympathetic." Empathy, kindness and humbleness doesn't hurt.

    Hello all,
     
    There is a lot of mixed answers. The EO does not mention that K1 is affected however nor does it mention it is exempt as the only exemptions to this are spouses and children. Some lawyers are saying the K visas are not affected and some are saying it is; Just like some embassies.
     
    The most simple solution is to gather information from the government themselves, mind you, we might still get mixed answers. If all the US Citizens take some time to write an email to either their house representative or their state senate regarding where the K visas stand, we can get a more clear answer than the speculations going around and everyone's take on the EO.
     
    We are all in the same boat and we are all in this together. Lets be positive and lets make some noise. Instead of having each consulate have their own interpretation, as some already are doing so. For Ex. the London embassy saying that the K1 is affected as stated in their appt cancellation email. If we make noise regarding the K visas within the Gov we might get a clear answer and they might include us in the EO.
     
    Please no negative replies.
