    Just had the interview today in Boston! We got the notice that they scheduled it on September 30th for an October 20th interview date. They had us (and most other couples) go in separately, citizen first then beneficiary. Interview lasted 20-30 minutes and they told us were approved! Just waiting on the status to change online and now wait for the green card!

    Thats not what I mean though. He's been with someone for a long time and I'm sure they plan on getting married anyways. I just mean they could do it sooner rather than later to try to help him get legal. Also he can't if he does the 10 year ban he wont see his mom or dad for 10 years how is that okay. They cant visit him they're illegal too.

    The inconsistency is strange.
    Some get approved on the spot, others have to wait.
    We had our interview this Tuesday. It seemed like went well. We however havent gotten any updates yet. The officer did mention they need have to do background checks and that we should expect something in the mail in 3 weeks.
    Very different scenario from what others experienced.

    I got my interview appointment in the mail today for the end of November ☺️ I’m a RI filer, filed mid January and have been ready to be scheduled for interview since mid March. Hopefully the end is near (at least this part)

    I agree with all the other posters. If you click through the immigration timelines search page on VJ, or through the case filing and progress reports you'll see a lot of approved AP over the last few months, usually as combo cards (myself included). I would get in touch with USCIS and find out why your AP was denied (I believe you should have been  sent a denial letter with a reason?
     
    I know this is a very stressful process, which feels like a black box right now, however you have also made it a lot further than many legal (and illegal) immigrants ever do. Looking at VJ timeline stats (here) it looks like the timeline for Albany, NY is more like a year than 35 months, so you might be closer than you think. The current processing time showing is 9.5 - 29.5 months. The first number is the time it takes to complete 50% of cases (the median). The second number is the time it takes to complete 93% of cases - so you could be a coin flip away from being  processed within the next 7.5 months.
     
    Getting your green card would provide you with a lot more future stability and entry/re-entry options - and you could still stay outside the US for 6 months at a time or even up to two years if you file for a re-entry permit. This year has been super hard for everyone, but make sure you don't make a decision now that would make things tougher for you in the future too.

    The issue for the OP is not that they're married to a USC, it's the AOS. They've already shown to be okay with randomly staying.  The OP doesnt need a visitor visa as a Canadian so it's a CBP issue if they see the history of the OP. 
     
    Personally I would reapply for AP. I think something was screwed up by the lawyer on the I-131. Unless there was overstay we don't know about, there's little reason for it to be denied.

    I find this not true. My friend who works CBP at San Ysidro POE admits people all the time with AP. I just called her and asked, and she said last night she easily admitted over 10 people who were returning on their AP/EAD card. She said she has received no instructions to just randomly turn AP card holders away. She laughed pretty hard at that one. I think you are misinformed about that. Now if USCIS is just denying AP, I can't speak on that, but I'm sure they are not just turning people with AP cards away at the POE.

    It’s not about  “ keeping your green card valid”.. it’s all about demonstrating you have not abandoned your US residency by your actions. Read the information on the USCIS website on “ Maintaining  your residency” ... that’s the critical issue. I encourage you to return as soon as possible if you intend to continue to live in the US as a LPR

    1. The category still matters for aos (example: certain things invalidate adjustment for spouse of LPR that are forgiven for spouse of USC) 
    2. i am not sure about it not mattering time wise as service centers provide different dates for IR and F2 categories. In some cases processing is significantly faster for i130s for spouses of USC vs those of LPR according to uscis processing times website.
     
    I think OP should notify uscis of the change in spouse’s status, if for nothing else for the sake of accuracy. There is only upside to doing so, worst case nothing changes.

    Thanks for your response pigrew, I saw an immigration lawyer said that I can have the documents sent to my lawyer’s office and that’s one perk of having a lawyer. I think it’s more difficult if you are applying for citizenship. I’ll have to wait till Tuesday to hear from my lawyer since Monday is a holiday. Thanks again

    Our interview was just scheduled!!! I can’t believe it! I’m shocked because our case status didn’t update saying interview is scheduled. It’s for the end of this month! My hubby’s birthday is a few days before so this is an awesome birthday present!
     
    For people who have had their interviews, where does the I-130 fall into place? Is that approved at the interview or is that a separate process?

    I got the approval notice for both I-485 and I-130 (in two separate envelopes) in the mail yesterday and the case tracker did update! GC coming soon!
     
     
    I can't believe they make you go all the way to Hartford - hopefully they can schedule your interview in Pittsburgh - seems like they process it very quickly right after the interview and I had a really nice officer for the interview.
     
    For the record- my EAD and AP never got approved. I filed for expedite back in May, faxed stuff in, and got denied 3 weeks later. I also had two biometrics appointment that was applied to the EAD and AP separately, in August and in Sept. But one of those must be absolutely useless since I didn't ever get the combo card.

    Another month another round of AOS submissions. Please be aware the fee increase, that was supposed to take effect on October 2, 2020, has been put on hold. No one knows with any certainty how long this hold will last, so please take this opportunity to get your October 2020 packets in as soon as you are able as the increase is substantial.    
     
    AOS Checklist
    Cover Letter listing Table of Contents (Check Payable to U.S. Department of Homeland Security - $1,225.00)  
    Form I-485 (completed and signed by non-US Citizen/beneficiary)
    Form G-1145  Form I-944 (Declaration of Self-Sufficiency with applicable supporting documents.)   
    Copy of beneficiary's Passport with biographical page  Copy of beneficiary's K1 Visa from Passport and entry stamp  Copy of NOA2 Approval letter (from K1 process)  I-94  Copy of beneficiary's Birth Certificate  Translation of birth certificate (if needed) Certified copy of Marriage License  Passport Photos (2) name written on the back  Copy of DS-3025  Be sure to use the correct filing code of (c)(9) if this code applies to you. The I-485 instructions explains all the codes in detail. If you are filing under a different code (other than (c)(9) the fee for your AOS will not be correct and USCIS will reject your entire packet.

    Be sure to double check for the current fees as fees do sometimes increase and they can change on a dime so please check. Additionally, check the forms as listed above i.e., current version and or edition date, there have been many changes to various forms. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter.
     
    Make sure you send long form birth certificates and not the short form.  Hope this helps in your preparation of your AOS. When in doubt ask questions.
     
    Please consider filing the I-131 and the I-765 even if you don't think you'll need them right now. You never know what changes your life will have on down the road, so I recommend you file these two forms from the start. There is no extra charge to file them (FOR NOW) with your AOS and it's much much easier to submit them all at once.  With the proposed fee increase each form will have a fee, so just in case this hold on the fee increases does not hold and you need to file the I-131 and the I-765 later you won’t have to pay for them.
     
     
    There has been much confusion coming out of USCIS, partly due to Covid-19 and partly self-inflicted. This confusion filters on down to the people filing for AOS. The above listing is subject to change at a moments notice so please check, recheck and check again BEFORE you send off your packet for any last minute changes.

    Because you have to do it right. The people who work at the lockbox go by a checklist. If something is different from that it will get rejected. They're not there to figure out what could potentially be meant otherwise waiting times would probably be way longer since you're not the first and probably not the last who did something like that.

    Quick Update. We had our interview last week and received our green card in the mail 3 days later! We had sent in our application at the end of March. My partner had been living in the US on a student visa (OPT). We also moved from the DC area to MA during our application, where our final interview was. We were surprised by how quickly this went. Hope everyone else has a quick process too!

    I have. I'm not sure what state that person was in, but that was probably a factor. I'm in Los Angeles, where we have a lot of support and advocacy for immigration. I know in lots of other states, that's not the case. But additionally, the person was technically out of status upon their arrest. Was it really necessary? Absolutely not, imo. The immigration officers clearly just wanted to "make an example" out of that person. But does that also mean such incidents are on the rise? Maybe, maybe not. Without proper statistics and data (which I don't have), it's irresponsible to say that that person's experience is going to become common place. As of now, their experience is a very outlying piece of data that is highly unlikely to occur to the average person, but of course, "highly unlikely" is not equal to "impossible". All immigrants should know their rights, ensure they have a lawyer they can call in case of emergency and have multiple copies of their paperwork to show when called for.

    Just wanted to update you--my husband had his AOS interview in Pittsburgh on 10/2. We were approved on the spot and received the i-551 stamp in his passport. The officer had said we'd receive the green card in the mail shortly, but our online status never changed. We just checked the mail and the i-485 approval notice and the actual green card (in separate envelopes) were in the mailbox! Our status still says "interview was scheduled" haha so I don't think the online status updates are reliable. Our online status had been updated for all the other steps prior to this last one. Hope you receive your green card soon!!

    grace period is not legal status. so many people get confused and lawyer advise incorrectly. In order for Adjustment of status one needs to have a status. Grace period allows people to find a new job or leave the country. she can find a new job and that will be ok in that 60 days. make sure to file AOS after a new job 
     
    she can file immigration petition and opt for consular processing as she is now Immediate relative due to mom being a citizen.

    Hello, everyone!
     
    Our AOS Interview is scheduled for tomorrow, Oct 8th-- after months and months of painstaking wait, we were thrilled and were looking forward to do the interview.  My husband, unfortunately, was admitted to the hospital on Saturday because of a Crohn's episode and we will miss the interview tomorrow.  I had called in to reschedule and was given a confirmation number for the request, which will take 30 days to process.
     
    Anyone here who can provide guidance/experience on rescheduled appointments?  I know this pushed us back so many weeks but would be good to have an idea.  It might also be a good time to file for renewal of EAD since it expires in January.  Sorry to be a downer but I really need support and I feel others just don't understand our frustration.

    For anyone with combo card and who has traveled out of the country recently: was there any problems re-entering with your combo card. My wife needs to travel back to home country to take care of a few things in a couple months. Just want to make sure things at the airports are going smoothly. Thanks.
