    Hi there,
Yes, the 751 NOA serves as an extension of your residency for normally 18 months from the date of your Conditional GC expiration date 😊

We filed for 751 and then N400 a year later and had a combo interview. So over the past several years we used an expired green card with a 12 month extension letter at first. Then we got an additional 18 months extension letter. Then we had to drive 10 hours to a USCIS center to get a stamp in the passport to travel.

Now just weeks away from an oath, we receive a 10 year green card in the mail 🤯

That's a different kettle of fish than the original question.  Better saved for another thread.

For the OP, I can assure you the CBP's first priority is not chasing down people who filed for ROC and don't have a letter in hand.

I agree with the above responses, this is nothing to get overly stressed about.  You filed the I751 within the 90 day window, and unless your husband has pending international travel, there is no need for the extension letter immediately.  If there is travel in the immediate future and the extension letter does not arrive prior to the CGC expiring, your husband can get an I551 stamp to show his LPR status.

    Relax!

Relax and take a deep breath. It's really not worth losing sleep over it. He will still have LPR status even though his proof of status has expired. You may receive the extension letter before his green card expires, or you may receive it a few weeks later. ICE will not come knocking on your door (and even if they would, you have proof that you submitted the ROC application).

Only the evidence of status expires.  His status as a legal resident does not expire.

    Nothing.
The card is proof of status and not the status itself. As long as you have filed, when the card expires the status as LPR continues.

Since the I-751 was received before the green card expired, there won’t be a deportation unless the petition is ultimately denied and all appeal paths exhausted.

Your husband should carry proof that the I-751 was received.  Electronic and printed copy.

See a doctor for the BP.  Your husband needs you.

    Hi everyone,
I love that everyone here is so helpful towards each other
I'm freakin out and have a question (bear with me while I explain):
my hubby's conditional GC expires Jan 30, 2021 and we just filed for 751 (it was delivered today by usps using priority mail express and signed by someone).
I see that many users have not received their notice and it's taking almost 40 days to even cash their checks (due to precautions uscis is taking because of covid and all)....

my questions is: What happens if we dont receive the notice before Jan 30th? Will my husband be deported?
What would be our options in case we dont receive the notice before his conditional GC expires?  I'm so worried right now, my BP has been high and my heart rate has increased...i haven't been able to sleep properly for the past few days

Thank you for your replies in advance 😊🙏

    UPDATE:

THEY RE-OPENED MY CASE WITHOUT HAVING TO GO THROUGH THE I-290B!!!! I AM SO HAPPY OMG, WHAT A RELIEF.

We over-nighted a letter to the officer that denied us explaining the situation and we attached all the proof we had. The Officer just called my husband cell and told him not to worry about it that he'll re-open the case and send us another interview date. He also was nice enough to provide us with his direct phone line for any other emergency. I am so happy omg! Thank you all for the support!

It is recommended to follow the instructions on the notice exactly as they’re instructing you because if they ask you for something that you didn’t bring, it’ll delay your approval. I myself made copies of absolute EVERYTHING i ever sent USCIS and brought copies and originals and plenty of bonafide evidence, copies of the originals submitted for the original aos package and brand new evidence and the officer instructed me on what to give her which was mostly everything except for original aos pack, renewals and evidence of aos eligibility aaaaaand just to gloat a bit the officer stated “i loooooove the way you organized your files!!” 💁🏽‍♀️ More i better than less in this case.

I tried that the first time thru. No outside food or drinks are allowed for security reasons supposedly. But the security said they would dispose of the 12 pack of Krispy Kreme so I wouldn't have to go back to my car.

I brought everything I owned to the interview. The letter said bring everything USCIS ever sent you, or anything you sent them. I used a dolly to transport the file box into the office.  Loved the look on the security officers face, it was choice, but I had everything. LOL Then had to reschedule, so I get to do it again next month dolly and all.

You will have to wait a few months, get a RFE (request for more evidence), and then submit what USCIS wants. And tell your lawyer he owes you a refund for being incompetent.

"The lady" is called his wife.

Since his wife did not attend the mandatory interview, his case was denied  He needs to leave the US as instructed.  There is no going through the process again.  He's done.  He needs to go home.
