Barefootek reacted to JacobP in Immigration Suspension Executive Order - MEGA THREAD
Immigration could hardly be "more paused" than what it currently is for most of us here.

Barefootek got a reaction from Anmol Yash in Processing of I130 delayed because of coronavirus?
Thanks so much for replying and then taking the time to check on that for me. I linked to Visa Journey from an email with someone that has the same filing date asking if I heard anything and not from the link about the timeline. Saturday was rough since Ecuador closed its borders. My wife and 9 month old daughter are there and now I don't know when I will be able to see them again. I've been shell shocked since then and didn't even think to check my timeline.

I received an incorrect estimate today in the weekly email today. Mine went from April to May previously, and the email today said September 15. I clicked on the link and it took me to somebody else's timeline. When I clicked on my own timeline, it still said May..
Just checked your profile. The estimate for you is still the same as earlier 😊

Barefootek got a reaction from KartineeKartoons in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
Since the timeline for K1 visas appears to be about 4 months faster, would divorcing and remarrying be an option? I certainly don't like that option, but if it saves me 4 months then I might have to think about it. I have not filed anything in the US. Could we just have another ceremony there? Since her ID shows her being married, I am assuming the answer would be no on that one.

Pay no attention to the form expiration dates - these are for internal use only within USCIS. Provided that the form you are using is the one that is currently on the website, it’s the correct version to use.

our judgement comes from a place of knowledge and is an effort to keep someone from making a royal mess of things.
its a humane judgement.

I know lots of k1 waiting longer than spousal visas...
and with this case I can smell the additional scrutiny that comes with it..

Yes! Because we've all seen the posts by people who made poor choices regarding their immigration journeys, and come here after the fact to bemoan denials or prolonged APs. So not worth it.

This process makes you crazy, and desperate to make it as short as possible so you get these whackadoodle ideas, and you need a healthy dose of tough love to bring you back to being rational. So while it may seem like being judged, it’s to hopefully prevent someone from doing something silly and making a big mess.

Barefootek reacted to geowrian in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
Can it work? Yes. I don't think the CO would necessarily care too much either.
But is it practical? Heck no.
First, you need to be fully divorced and free to marry before you can start the process. Divorce is not something that happens in a day. In many states, there is a cooling off period before issuing a divorce and/or a waiting period after a divorce before you can remarry. You do NOT want to screw either of those up as the new marriage would be deemed invalid for immigration purposes and you would need to start all over.
I can't imagine anybody advising to actually do this.

Barefootek reacted to little immigrant in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
You'll lose 4 months if not more just by divorcing. I don't know what country you're all from but in the states it takes 90 days if not longer, in Germany it takes a year for example. Then you have to marry again and it will take a few weeks to receive the marriage certificate.
My advise: Don't do it. Just stick out the CR1. I really think you initially made a good choice with that one.

Barefootek reacted to Just Paul in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
Reminds me about when my ex wife wanted to divorce and remarry in a non community property state and then live in a community property state.
I see lawyers sending their kids to Harvard or Yale off this case.

Barefootek reacted to SalishSea in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
OP, in all seriousness, have you considered moving to your wife’s country instead? That may be a better solution for you, because for US immigration, time spent apart is inevitable.

By the time you have gone through the whole divorce process you would have already been approved for a spousal visa. Just go with the spousal visa, no need to complicate things further. 🤦♀️ Plus you would probably just get more questions about why you got divorced and decide to re-marry.

Barefootek reacted to Crazy Cat in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
Have you evaluated the real differences between a K-1 and a CR-1?
K-1
More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)
Spouse can not work until she/he receives EAD (approx 5-6 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
CR-1
Less expensive than K-1
No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
