    She needs to tell the truth. Never lie to immigration . If I understand correctly she unknowingly entered into a bigamous marriage and terminated the marriage when she found out. Not sure if bigamous marriage is valid where they got married at but it may be important to him. She should have reported him to immigration at the same time but it is late for that . He will eventually be found to have gotten immigration benefits he is not entitled to and be deported ( he came based on an invalid marriage ) She needs to show that she did not know about the wife when she came into the US and that she didn't help him get to the US illegally.

    Do you want to stay in Thailand and just visit the USA occasionally with your wife? if so, she needs to apply for a tourist (B2) visa.
    If you want to move back to the USA, you petition for a CR-1 spousal visa for her. The process is here: http://www.visajourney.com/content/i130guide1
    You do not need to register the marriage with the embassy, but if you petition her, you will need to send the marriage cert as part of the paperwork. You will have three options in terms of sponsoring her financially for the spousal visa: 1. If your retirement income is enough, you can sponsor her on that. 2. Sponsor her on assets (savings, second property etc) 3. Get a US based co-sponsor, like you say. This does not need to be a family member, it can be a friend, or a former co-worker etc.

    No harm trying but seems a long shot for him to get a B2 unless there is a substantial change in his circumstances.
    Having a SO and a Child in the US is a big negative, not sure what sort of business allows 6 months absence, usually if it is your own you are lucky to manage a couple of days.
    Probably safest to assume you will be the one doing the visiting.

    Letter from employer, current pay stubs and tax returns for past three years are the norm. If you're sending copies of filed tax returns you need to send everything - W2s, all schedules not just copy of 1040.

    The chances are that your friend was probably told exactly what you said at the interview.
    I personally think that the COs have a selection of encouraging phrases they give to all visa denials to encourage them to leave without kicking up a fuss about their denial.
    Last time I got denied I got the "I'm sure if you sort out X and Y parts of your situation you'll be approved next time" line.

    I doubt it very much, on my last B2 interview the interviewing officer was using his computer to refer to notes from the first B2 I applied for in 2003.

    My parents just applied for a tourist visa to come visit me and they got it. Most of it is that they check the Ds160 form first, and base their interview on that. You just have to say exactly the same thing that you filled. No more, no less. And short answers, don't explain too much!
    Also, if you have the money to apply more than once in a year I'll say go for it, but the truth is that if your situation hasn't changed in a year better to wait. I have a friend who applied for a tourist visa and was denied, but the consul told him that if he applied in a year all the data in their system gets renew which means that he goes clean again, and it may be true cuz he has a 5 years visa and he comes every now and then

    You can translate it yourself if you are fluent in both languages. From http://www.uscis.gov/forms/forms-and-fees/general-tips-assembling-applications-mailing:
    Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

    The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

    Certification by Translator

    I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

    Signature_________________________________
    Date Typed Name
    Address

    It does not need to be notarized. Simply translate the document, and add the above certification statement at the bottom of your translation.

    I read and followed this site for months before applying for any visa and wasting good money. Everyone wants to be together as quickly as possible but you will find that immigration does not work to your timeline unfortunately
    Take some time, learn about visas, requirements, and everything that entails so you can be truly prepared.
    Also, if you haven't already please please research his culture, his country, and it's customs. I have visited my fiancé 5x. I read about the food, the music, watch videos, everything to learn more about him that I can. I cannot stress how important that is for now and your future together.

    OP, consider this post/thread and your other as an introductory course in family based US immigration. Now you will need to major in high fraud countries as your fiance is from what is considered the number 1 visa fraud country. So regardless of his character, he (and you) will have to prove convincingly that your relationship is bona fide.
    Your assumption about staying 6 months is wrong. A jobless, single male from a poor country will not be given such a long stay. And it is very likely that he cannot obtain a visitor visa. And that visa would not allow him to work in the US.
    Not having enough money to meet in person is not an acceptable reason for not meeting. The immigration process is expensive. If you can't afford it now, wait until a time when you can afford it.
    Some hostility toward your religious group in his country is not a reason to exempt you from the meeting in person requirement. If you do some reading here on VJ you will find many people who have had similar issues that were not held as compelling reasons. Meeting in another country is an option.
    You've heard a lot of information that you do not like. But the preponderance of opinions are the same. Take that feedback seriously as you revise your plans.

    If your boyfriend thinks he is going to show up here on a visitors visa and get a job that will work for him to adjust status on he has being doing a little too much of Indian hemp. The fact that it is inconvenient for you to meet in Nigeria will not fly. The place is too high fraud to let a visa go to a person you haven't met in person. Even the idea of meeting in Ghana is risky because they will want to see pictures of you with his parents. You are going to have to put on your big girl panties and get on a plane. There are many safe places around both Lagos and Abuja depending on where he lives near. The plane will cost 900-2000 and then you will need some money for expenses.

    This is correct.. You will be denied because you have never met in person. It is better to withdraw until you can meet.
    He will have to prove on his own merits to get a visitor visa. He cannot work with a visitor visa.
    He would have to find an employer willing to sponsor him for a work visa.

    Beware of Nigerians habit to think they can game the system , one young man called my husband asking for advise on a problem. He lied that he was married with a child to show ties to Nigeria to get a visitors visa , married to a girl here when he arrived and now is having issues producing a divorce certificate to explain the wife away. Immigration has seen all this silliness and will have his name on record for the K1 so won't believe he just wants to visit. Why doesn't he want to process the K1 ? Most couples from high fraud consulates spend the process apart.

    You do not have to have a divorce decree to file with a waiver. You need to either have filed for divorce, or have a legal separation (in Maryland called a "limited divorce.")
    When you wife/ex-wife files with a waiver, you are no longer involved. If she is called for an interview, you will not be called.
    You can, if you choose, contact USCIS and add information - positive or negative - to the file. USCIS will give it whatever credibility they deem appropriate. They are aware that some ex-spouses want to paint a rosy picture of what was essentially a sham marriage, and that some ex-spouses are bitter and angry and willing to twist the truth if not outright lie to damage their ex's petition.
    My own strong impression - based on two long interviews with one of the immigration officers at the Baltimore office - is that in cases of he-said-she-said, USCIS has a lot of discretion.
    You say your wife "doesn't have diddly for evidence." It's not clear, and maybe doesn't matter to you, what she has, but all she has to prove is that at the time of marriage, she intended the marriage to be for real.

    my dear you should dancing, because a wicked person like this, you should be happy that God has remove him from your life. let him be. cancel the plane ticket and also let the embassy know that this person will no longer need the visa which was issued, make sure to inform them so they cancel the visa. people like this are really not worth the time and effort. people that doesnt add value to your life, dont permit them to take away the value in your life. he will do the same to that new one also. what goes around always comes around. when you throw a ball to the wall it always come back to you. leave him in the hands of God.

    The embassy sees this situation enough to know how that portion of your income comes from that source. If there were to be a question it should come before the interview so you would have time to react to what they wanted.
    In cases I have seen there was no problem in using this type of income when the petitioner did as U K_fan indicates.

    Child neglect is one that needs to be disclosed. You will need to track down any and all documentation you can from that case.
    3. What Documents Must You Submit to Comply With IMBRA?

    a. If you have ever been convicted of any of the following crimes, submit certified copies of all court and police
    records showing the charges and dispositions for every conviction. You must do so even if your records were sealed
    or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no

    (2) Homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking,
    peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint,
    false imprisonment, or an attempt to commit any of these crimes.
    (3) Crimes relating to a controlled substance or alcohol on three or more occasions, where such crimes did not arise
    from a single act.

    along with the other 17,971 petitions that have been started over the past 3 years since I have been a VJ member. If it's not TSC, it's Vermont, or the NVC or CSC...When I sent my husband's petition CSC was going slower than a snail's pace and everyone was up in arms, then they shifted everything over to VSC and they slowed and then everyone wanted CSC. It's a government bureaucracy, it isn't perfect, nothing is guaranteed and immigration for a spouse/fiance/family member is NOT a right.
