A friend a mine came america through visa lottery.She got married to someone that has already married with 3 kids but she did not know that he has been married.So when they got to america 2010 .The lady discovered that he has kids and wife already.Then d lady left him within a month they got to america and she divorced him 2012 because he has kids and wife.so when the man filled for his citizenship she now included his 3 kids in the neutralization form N-400.So they called him for an interviewed.They now asked him why he didn't you included your 3kids when he was filling his application?He said because the lady did not allowed him to do so ?so she now told the lady to said so if they called her for an interview.I just need people opinion on what she need to do.

She needs to tell the truth. Never lie to immigration . If I understand correctly she unknowingly entered into a bigamous marriage and terminated the marriage when she found out. Not sure if bigamous marriage is valid where they got married at but it may be important to him. She should have reported him to immigration at the same time but it is late for that . He will eventually be found to have gotten immigration benefits he is not entitled to and be deported ( he came based on an invalid marriage ) She needs to show that she did not know about the wife when she came into the US and that she didn't help him get to the US illegally.

This will not be over quickly. You will not enjoy this.

It's very hard to understand the original post but if they got their green cards through the visa lottery then one of them is here illegally.

I assume that one of them got a green card through the visa lottery and the other one got his/her greencard as the spouse of the first. It's is incredibly unlikely that they were both selected independently through the diversity lottery.

So the problem is that they were not legally married since the U.S. does not recognize polygamy. So if the wife got selected in then lottery then the husband is not here legally. If the husband got selected in the lottery then the wife is not here legally.

This inquiry couldn't be more cryptic.

Filing complicated USCIS forms and petitioning the process is clearly not in your "friend"'s purview. If you can't clearly articulate the precise nature of your friend's issue here, tell her/him to seek someone who can try to solve this in an expert manner.

here's what i suggest:

1. write up a letter of attestation outlining exactly what happened.

2. get this letter of attestation over to the USCIS local office that is handling the man's citizenship interview. drop it off in the lockbox, outside of envelope writing, "Citizenship Adjudication Team" .

she kept a copy of the Immigrant Summary Data Sheet on HIM, right? if yes, it makes it very easy to identify him with his A# in the letter of attestation.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

He is here illegally and is deportable because his marriage to his (second) wife is not legal.

He was asked why he didn't include the 3 kids on the DV forms, why does he now want to include them on the

citizenship forms. He is trying to lie his way through and he will have a rude awakening.

To top it off he wants the ex to lie for him, pretending she knew about the kids and just didn't permit him to put the kids on the form

which will get her in trouble too.

She must tell the truth and he must stop playing games and most likely go home.

Lies never pay in the long run and bite you in the rear end, even all the way at the very last step.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

The guy is a fraud & should have been reported when she found out to cover herself

Her husband is illegal in the country (not really her husband)

Never lie to immigration it will come back to haunt you in a bad way, he committed fraud

misrep & had the idosity to apply for naturalization? he's on the fraud dept radar by now,

and it could also seem like this was an elaborate scheme by your friend & this man (to USCIS)

because the average women would be extremely mad about this plus kids, they would have

reported him back then or leave him...This will not be over soon because the 1st wife who

was also a lottery winner did not disclose her marriage & husband name maybe.

He's deportable & she may have some explaining to do

I still didn't get the story. If they got divorced in 2012 (technically they never were married) she has nothing to do with his N-400.

She doesn't but he called her (evidently they are still in contact) and told her to lie to immigration and pretend that she never wanted

the kids on the application (that would of course have consequences for her ) so that he somehow would escape the blame and put it on her

which is utter nonsense. No matter what she said and wanted, it's his application and he is responsible for the content with his signature.

He thinks they want to interview her to get to the reasons.

It all sounds like a DV "arrangement" for money to me with all 3 parties being in on it. The guy, wife #1 and wife #2.

He can't naturalize on basis of his fake marriage and he will be going home in my opinion.
