ADW & JOP reacted to JFH in Trumps new merit based immigration policy
You see where the government sees the problem. Your father-in-law is bringing in 4. In 5 years time you will all be eligible for citizenship. And then you and your husband can bring in your siblings with their spouses and children, you can bring your parents, who can then bring their siblings, etc. What starts off as 4 in some cases soon becomes 14 or 24. They have to draw the line somewhere. Otherwise the quality of life for everyone here will decrease with housing shortages, overcrowded schools, job shortages, etc.

Why would it “break your hearts” if the family categories were abolished? It’s not like you’ll never see your father-in-law ever again. You won’t be banned from visiting. You’ll still be married to your husband and have your children with you. What exactly will you be losing apart from an opportunity? It sounds like this is all about you moving to the US just because you can rather than a family reunification. Hence the government often rumbling about scrapping these categories. There’s not much family reunification going on, which was the original purpose of the policy.

I am not sure how to answer all your other questions, but I was under the impression that your wife is no longer eligible for your mother-in-law's petition as she is now married to you and your mother-in-law is an LPR.

I am also from Toronto. There are a number of RMCP-approved places to get this done.

I went to a place called Red Seal Notary on Yonge and Sheppard two weeks ago. It was walk-in, took 20 minutes to take my fingerprint and sent off the requisition to the RCMP. I received my police record check in the mail the following week. Cost approximately $60.

Oh, and to answer your question, that CRC is not adequate, it has to be a fingerprint-based, so you have to apply in person.

    No problem.

Just let them know what it's for. I printed that travel.state.gov page just in case. He knew it was for an immigrant visa and processed it without any issues.

Just to follow up. I submitted my ITIN application on April 9, 2019 and received it yesterday May 20.

In total, it took 6 weeks, much faster than there quoted 10-12 weeks.

If only USCIS will surprise me like this...😜

I am actually doing something similar. Aside from meeting the curriculum prerequisites, you will need either a social security number or individual taxpayer identification number, which is a state requirement for tax enforcement purposes. You will need this in order to obtain your license.

I filed my taxes jointly with my wife this year to obtain an ITIN (at a small cost) in order to facilitate my own medical license process. I was told this process can take up to 6-12 months. My plan is to apply for a medical license as soon as I obtain my ITIN so that I will be able to look for work once I obtain my CR-1.

IMO I think the time frame they gave you was quite long, and I think you will get it sooner. I think they play is safe by giving you a longer tine frame, otherwise people would be calling and complaining about it taking longer than the time frame.

My wife and I got married last year in San Diego at the County Administration Centre.

She called 4-6 weeks to get an appointment, we showed up and they performed a small ceremony with my in-laws present. We were able to get our marriage certificate two weeks later.

I had a very similar situation to you. I am also from Canada, filing jointly for the first time with my wife, with an income greater than the foreign income exclusion maximum for 2018.

I don't know if you have ever visited this site, I found it very helpful throughout this process. They are also connected to an accounting service, but I ended up going with an accountant that was highly recommended buy my wife's colleague. I liked him, but I won't recommend him to you because he doesn't have a whole lot of experience dealing with foreign taxes. I think he had to do a lot of research on his own.

After a long discussion with my accountant and through some research, for example, on taxact.com, my understanding is that you can still use the foreign income exclusion (Form 2555) to exclude up to $104,100 (for some reason, we did $103,900, not sure why?), and then use your foreign tax credits (only federal taxes, not provincial) on form 1116 to avoid dual taxation.

I still reside in Canada so am not a resident of California. My accountant tells me that I don't have to pay Californian state taxes as I did not reside there in 2018. I asked him what would happen in the future when I moved to California but do some locum work in Canada where I would have to pay provincial taxes and he told me that I cannot use provincial taxes to exclude state taxes. Again, I am not 100% sure this is accurate. I was going to do more research when I cross that bridge.

I ended up filing jointly (I needed the ITIN in order to get a head start to apply for a California medical license which takes 8-12 months), but because there was such a huge disparity between my salary and my wife's (I think I was 4 times her), we ended up getting less tax refund for my wife had she she filed separately, however, as mentioned I had other reasons to file jointly.
