    His chances of ever obtaining a tourist visa are zero to none. He has way too many ties to the US and a denied tourist visa just adds to it. He most likely was denied due to being at a high risk of immigrating. Having a baby means nothing in the eyes of USCIS.
     
    Sorry to break it to you but the only chance your boyfriend has to be present at your daughter’s birth is if you have the baby in his country. There is absolutely no way you have time to get a K1 or a CR1 in time for her birth unfortunately. I would say if you’re ultimately trying to get together as fast as you can and you have the financials means for him to be out of work for about 6 months, file K1. If you can handle being apart a little longer and can’t afford for him to be out of work for that long, go get married and file CR1. I would do it fast if I were you. Less time apart.

    I completely agree with this. If he has a visitor visa and is in the US with you and he has his bundle of joy in his arms it may be hard to turn around and head back without know exactly when he will return.
     
    The biggest mistake foreigners make when applying for a visitor visa to the US is thinking they need to show why the need to go to the US when in actuality they need to show the opposite. They need to show why they need to return to their home country.
     
    In the meantime, you can study the K1 process and start gathering as much evidence of a bonafide relationship as you can.

    You could find the best hospital in Belize to deliver there so your boyfriend could be present.

    Many have been  denied for doing just that. If you hired that lawyer I would fire him.

    My advise: dont do anything like that if you do K1. I see many members on this group just do a small ceremony and got denied at the interview. So,it a big no and  you can do it after married.

    If your fiancée comes to the US with intent to marry you while having a visa that doesn't involve marriage (e.g. visitor's/tourist visa), you're both committing an immigration fraud and if something floats up at the POE or with USCIS, it potentially can cause some legal troubles up to a visa cancellation and US travel ban for your fiancée. Just something to think about. If you don't want to commit a fraud, then K-1 or CR-1 are the only options you have, unless there is DCF available in your country but I am not knowledgeable about it.

    When my husband and I were contemplating between K-1 and CR-1, my primary concerns were money. Considering that K-1 is more expensive and that I would not be able to work for a few months, it made no sense to go that route when I could continue making money back home while waiting out the immigration process. The other thing is that being from a VWP country, going over to see him during the wait, if so desired, wasn't going to be a huge problem. I have always felt that the K-1 visa might be more suitable for those who find it hard to obtain tourist visas to visit, as it allows the couple to be together sooner. So at the end of the day, it depends on what is important to both of you.

    Hey everyone, we were able to get Massachusetts Health care coverage. We just went to the local hospital and to emergency room and got signed up. Moesha had n cold from this Boston weather and changing of diet made her n little weak. We did find n Jamaican restaurant in the next town over and they sold some dry food too. I was able to get her fav fish red snapper at my work so that helped to get her back to the food she used too.
    Next stop Social security and marriage this month.

    I am from a completely different part of the world, but when I was getting ready to move, I was an emotional mess. And I don't think having my husband there would have been helpful. I probably just would have been even more stressed, trying to make sure he was okay and not bored.
    I needed my space to do what needed to be done, to go through all my belongings, to sell my things, to spend time with my friends and family, to ride around on my bike in my nice little town, to spend my last few days in my best friend's house drinking wine and talking all night. It was very hard for me to leave that life behind, and I was very emotional during those weeks. Maybe she just doesn't want you to see her like that.
    Give her some space. If those 2 weeks are what she needs to get ready for your life together, it'll be worth it.

    It will take 6-7 months to be approved. You will be contacted, never her. Then after approved it goes to the National Visa Center  (nvc) then to her country. Total process is often about 10 months.

    Thanks for the advice. But Are yall serious? She lives in another country thats why i am here. I have 12 days vacation at the moment and can only feasably visit her 1 time a year. 
    Are you suggesting that I visit her once a year for 3 years then marry her? 
    I posted here for the process info and not for decision making advice whats best for me morally. I think im a pretty good judge of character. 
    How many times have you met your over seas fiancee before marrying him her? The requirement is once within 2 years correct? Is there an amount of time frame?  And have 90 days to wed. 
     
    Btw...if this girl is faking and insincere she should be in hollywood with an oscar award. I just dont believe that her and I are not being authentic. Im pretty much past teenage infactuations.

    You have about six months to enter the US and then 90 days to get married. You'll have close to 9 months to pick a date and plan your wedding AFTER you get your visa.

    You should make NO PLANS until she has her visa in her hand. 
    Yes, we know that it's unromantic and not practical - but at current processing times you can HOPE for November, and maybe that would be the case, but I know some from July 2017 still waiting for NOA2 - if you add in an RFE or any sort of Administrative Processing time for any reason at all ( couldn't get medical in time, anything) - and it leaves NO room for error. 
     
    Those of us on here on VJ have seen people over and over commenting about how they spent $xxxxx for a wedding they now can't have because of they didnt get their visa in the time frame they were hoping for and are looking for suggestions on what to do - travel on ESTA, do CR1, etc - all because of a wedding. 
    Most people end up doing a court house wedding when their K1 gets here and planning a bigger wedding together later on. 
     
    It's up to you and your money what you plan, but it's generally NOT good advice to plan anything while waiting for the process.

    This is too long and the tone is too sickly sweet.  Just provide the circumstances of when you met, and provide the proof to back it up.  I attached a supplement as well, but it was this paragraph:
     
    "After meeting for the first time in November 2013, [Husband] came to visit me in the USA in June 2014.  I went to the UK in October 2014 and December 2014, where I spent Christmas with his family in [City].  [Husband] came to the US for my college graduation in May 2015.  I obtained a tier 4 student visa to study at the University of [City] and moved to the UK in September 2015.  [Husband] and I saw each other most weekends from September 2015 to July 2016 and also spent time with his family in [City] during this time.  We went to the US to spend Christmas with my family in December 2015."
     
    We were approved no problem, no RFE's.
     
    By submitting something like you've written, you're just giving them more to read through and making it harder to find the information they need.  A simple narrative stating the facts is all you need. 
     
    Also, I'd also advise you not to address the age difference unless specifically asked about it in an interview.  By bringing up that it's a cause of concern for people who know you, you're just giving them ammunition to question your relationship.

    SSN required for marriage application? First time I've heard that. I got married just fine without it. Tourists coming to get married in the USA certainly don't have ssn either.

    Don't make any plans set in stone.
     
    • you may get stuck (it happens. Just saw a case that got rfe with received date February 2017 got approval (noa2) this week. 
     
    • you may get AP 
     
    • something may come up in the health exam.
     
    • NVC may get a backlog again
     
    everything is a possibility.
     
    so if you're not ok with the risk of losing money (lots of people lost) or have chance to change the dates later; I wouldn't make plans.
     
     
    also noa2 August to wedding on November is cutting in close.

    Well, sounds like she's in it for a green card. I personally, would show her the door. Sex is a big part of a marriage I don't care what anyone says.  Hiding the fact that she is married is another red flag. Save yourself the misery and find someone that is proud to call you their husband.

    I had my interview today at the Atlanta Field Office. I got there at 8 for my 8:35 interview, traffic in Atlanta in the morning is a killer so strongly recommend leaving out early. There was an oath ceremony in the morning so lots of people which made for a long line before security. I got through security and was processed at the 1st floor reception at 8:15. Around 15 persons waiting for interviews. Called back at around 8:50. total interview took around 20 minutes. I had to provide evidence as I am filing by the three year rule. I provided our IRS Tax Transcripts for the last four years, a property deed for our home in Georgia, and our mortgage statements. The evidence that we submitted before she said wasn't needed, so she didn't need to see my marriage certificate or my previous divorce decree. She had me verify my name, birth date, address, workplace, citizenship and provide my drivers license. She took a picture, had me use the fingerprint reader. She had me read a statement. The Statement was "How many Senators do we have", then she asked me to write: "We have 100 Senators".
     
    Then she started reviewing my application and in parallel asking me the civics question, that kind of th me off as she asked one civic question then went ahead with asking me to confirm things on my application. The Questions asked were:
    What is the name of the national anthem How old do citizens have to be to vote for President What is the “rule of law” What major event happened on September 11, 2001, in the United States What ocean is on the West Coast of the United States Why does the flag have 13 stripes  
    After we finished reviewing the application she had me sign and made copies of my ID and evidence. Then she said that a decision cannot yet be made about my application, that she would have to review my evidence and if all goes well then i'll get an oath letter. So the wait continues but at least now i don't have to study for anymore tests :-)

    How the heck did it take you 6 months to prepare?? I did mine in like 3 days.
     
    Fill out the form, print evidence, get passport photos, and send the check.
