    I would NOT do this.  Once you are seen as married, the K-1 visa is void.....period.  Your marriage via a K-1 MUST take place in the US.  By the way, her visa isn't approved until all AP is finished and the status has changed to "Issued".

    It absolutely impacts the k-1. In Islam, signing the marriage contract and having an Islamic marriage "ceremony" makes you married in the eyes of U.S. immigration. My husband is Muslim and we were engaged and married in Jordan, been there, done that. It does not matter if anything was registered or not. You will be married after the ceremony. Period. Don't do it.

    Same! My gc expires tomorrow. Sent in my package last week. Being away from my friends and family is tough especially working a full time job, school and doing that with a 14 month old toddler so I understand perfectly

    Hi guys,
     
    Joining this thread as I am sending in my I-751 petition tomorrow.  Doing some last minute stress checking and writing up a cover letter that feels harder than it should.  Also sending mine in at the last possible moment before my green card expires.  Anyone else here filing extremely close to the deadline?  No judgement please, I have a one year old and don't live near family.  Time goes so fast when you have a toddler!

    Hi there, I did. I send mine out on July 29th from overseas, received on AUG 6 and my GC expired on the 8. Just had a baby so that’s my reason for filing last moment

    I concur with @debbiedoo.  My husband and I had an 8 hour time difference while we were apart.  Whenever we weren't at work we were on FaceTime, especially to sleep!  We would be shopping or visiting friends and family and the other would be asleep in the background .  My favourite part was when our schedules aligned at the weekend so we could take a nap together on FaceTime.  It seemed to lessen the distance for a moment.  And we just missed each other so bloody much!  Not everyone will understand it, but I am sure some people will!

    USPS delivers mail to addresses, not people.
    The mail is routed to a carrier route. The mail carrier handles the last hop of putting mail into the right mailbox.
    Get to know your mail carrier and treat them well.
    Disclosure: I do work as a contractor for USPS.
     
    Edit: Once you have been there long enough to pass identity proofing, I suggest signing up for a USPS account and joining Informed Delivery. This will let you see mail and packages designated for delivery at your location.

    No appeal for 214(b) refusal.
    They will not accept documents unless requested. They have no obligation to look at them, and many times they do not. The DS-160 has most of the information they need to make a decision.
     
    No such criteria or quota exists, but surely the CO's mood has an impact on items within their discretion (as does any decision ever). But mood alone is not a reason to believe you were refused.

    As a note, she needs evidence of her upcoming medical plans and costs, not past ones. Having paid for small bills in the past doesn't mean anything for a potentially very large bill in the future. This won't involve just her regular physician.
     
    Not to jump on the bandwagon, but....anybody else find it odd that a tourist is coming to the US to see a US doctor regularly (with no indication of an unusual, chronic illness)? Even if you have all the money you can imagine, it seems very odd to to do so as a tourist. Definitely more to the story here...

    You're gonna do what you're gonna do, and you sound like you have your mind made up already.  That being said, some other factors to consider:
     
    1) How many weeks pregnant is she?  Depending upon how far along she is, an airline will not permit her to fly w/o a doctor's order.  Flying from the Philippines to VA is not a short journey.  
    2) Finding an OB/GYN to take on a new patient in her 3rd trimester can be VERY difficult!!  It is a doctor's choice to refuse to take her on as a new patient for prenatal care.  (Emergency care cannot be refused, and delivery of course cannot be, but prenatal can be.)  
    3) Prenatal care and labor & delivery will cost tens of thousands of dollars w/no insurance.  If something were to happen and the baby is a premie and spends time in the NICU, you're looking at easily $70+K.  
    4) If border patrol denies her entry, she's going to have to go through a flight back home and, depending upon how many weeks she is pregnant, that's HORRID for her and baby.  
     
    If she wants you there for support for the birth, it would be much simpler for you to fly to her.

    Problems with timing. Three months until she give birth then she has to wait for the birth certificate then she has to apply for a passport for the baby and receive it. Even if she get the full 6 months when she enters the timing will be really tight. 
    Problems with you signing/co-signing for anything for her. You are the one on the hook. No matter how good a friend or family member they are I never trust anyone with more money than I can afford to lose. Have her pay you in advance (before signing the lease) for the 6 months rent. Even the best of friends seem to "forget" to repay their debts, especially when they are in another country. 
    Hope everything goes well for her and the baby as a normal birth can cost more than $5,000 and if complications arise we are talking a lot, lot more. Also remind her the US has the highest health care costs and one of the highest infant/mother mortality rates of developed countries.

    If she needs to get away from the child's father emotionally....can't she just move to another home in the Philippines?  Why does she feel she needs to come to the US to have the baby (considering neither birth parent is a USC, and assuming neither birth parent has any ties to the US)?
     
    If her plan is to immigrate to the US thinking she can automatically do so with a US-born child....she has a long wait on her hands before that possibility can happen.  And providing immigration reform still allows that category in the future by the time the child turns 21 years of age.

    As far as the question itself goes: if the baby is born in the US, the baby will be born a US citizen. Also, once the baby turns 21, he or she can file for an immigrant visa for the mother (as long as that option still exists then). (Assuming that she pays for all medical costs and does not overstay.)

    Stop reading the news, especially certain left leaning ones who promote fear and anxiety over nothing. If you see majority of the sob stories of GC's being deported, the title will be a heart string pulling one, but deep in paragraph ten of the article they will mention some crime that made them deportable (drugs, sex crimes, ect).
     
    If you obey the laws and do things like you should, then you'll be just fine. The laws for the most part are still the same now as they have been for decades. Main difference, finally those laws are being enforced.

    Not when it comes to passing on citizenship. You need 5 years residency, of which 2 must be after age 14, to be able to pass on citizenship at birth of the child abroad.

    I'll just add 2 things...
    It's not 10 years. It's 40 quarters of qualifying work credits. This could be in 5 years or less if they can claim another's work credits in addition to their own, or it could be forever if they don't work. It also terminates when they lose their green card, either of you pass away, or when they become a US citizen. The I-864 not only permits the government requiring payback of certain means-tested public benefits, but it is also a contract requiring that they maintain at least 125% of the federal poverty level in support. See the I-864 (https://www.uscis.gov/sites/default/files/files/form/i-864.pdf page 6):
    "What Does Signing Form I-864 Require Me To Do? If an intending immigrant becomes a lawful permanent resident in the United States based on a Form I-864 that you have signed, then, until your obligations under Form I-864 terminate, you must:
    A. Provide the intending immigrant any support necessary to maintain him or her at an income that is at least 125 percent of the Federal Poverty Guidelines for his or her household size (100 percent if you are the petitioning sponsor and are on active duty in the U.S. Armed Forces or U.S. Coast Guard, and the person is your husband, wife, or unmarried child under 21 years of age); and"...

    No you can't, but I don't think you understand what you have signed. You are not "financially responsible" in terms of being required to feed and clothe him. He's an adult and those responsibilities are his. You are responsible for paying back the government for any public assistance he may receive (such as Medicaid) whilst he is a green card holder. If he doesn't claim anything, you won't have to pay anything. He will be eligible for citizenship in 2 years if he has been a green card holder for 3 years already. If the decides to become a citizen, the sponsorship ends.

    Like another poster suggested, you can suggest moving to Cuba instead.  If she says OMG NO or balks at the idea of both of you happily settling down in Cuba you may have your answer.
