    There’s a maturity needed to be.married. It’s not like seeing the latest TV in Best Buy and insisting on throwing out the old one so to buy the new one. My wife lost her equally paid  job during covid and that put us under immense pressure but the situation brought us closer and not me looking for a new partner. She needed me to be there for her during that low period of her life more than anytime of our marriage. 
     
    Do what you need to do to make your marriage financially happy: buy or rent a cheaper home, switch energy suppliers,  cut back on unnecessary spending, do whatever. In the long run, when she’s ready to work again you’ll both be glad you did. 
     
    Oh yeah, nice touch bringing in an immigration question to what is essentially a relationship issue.

    Seems like you're getting ahead of yourself, asking whether or not you are eligible to petition for a new foreign wife when you are still married to your current one.  Of course any US citizen can petition for a spouse, that's the law.  Whether the process is smooth or rough however, depends on the circumstances.  In your case, the timing of your naturalization, separation/divorce, relationship with a new love interest abroad, and eventual engagement/marriage and petition filing, could lead to a great deal of scrutiny.  So tread lightly and take your time, don't rush into a new relationship.  A word of warning:  if you already have someone in mind, from your home country, and have started a relationship with her, either in person or online, this would likely be discovered in the immigration/adjustment of status process and your US citizenship, granted through your current (bona fide) marriage relationship, could be revoked.

    It’s  an unfortunate reality both in Senegal and here that most women earn less than men..nonetheless congratulations on your promotion. ..bringing in double what she was making still leaves you financially safe ...but your marriage is definitely in trouble. 
     
    Maybe your wife feels secure enough to take a step back and look for work she enjoys . 
     
    Maybe she feels that if you could take a month off and visit Senegal last year..she can take a month or two off. Did she go with you?

    So, let me see if I understood well:
    you love your wife too much that your hurt is bleeding for writing those things but you being the sole provider is enough for your to ask for divorce? 

    How would you feel if was the opposite?
    If this happen in my marriage I would discuss and find a way together, but loving a person and not be ok to be a provider is really weird for me. 

    So, let’s say if she was the one getting more money and you could not find a job, a divorce would sound a reasonable solution for you?

    This really doesn’t sound like this is the only reason for the divorce. Be honest with you and with her, will be easier.

    Pics with family are most convincing.
    Group chat photos with family and friends are convincing as well.
     
    Pics evidence are useful for K1 or spouse visa applications.

    You can go to college, but you won’t get any federal financial aid until you adjust your status. State aid may vary. At least in Florida, you have to be a “citizen or eligible non-citizen” in order to get any state financial aid, including school-sponsored scholarships. However, some colleges do have privately funded scholarships for international students. Go to the financial aid office of your school to find out more.

    Hello, they want the divorce decree that is filed at court.
    In Utah for example, there is an official document you can get from the vital records office with stamp from court (for older divorces)
    Or, you can go directly to court, the clerk's office and get an official stamped copy of the whole divorce decree, that says "filed".
    The divorce decree is final when it is filed at court, the stamp from the judge is not enough, it must be filed to be considered as "absolute".
    The filing date is the official date of the divorce.
    We were afraid to get an RFE and sent this official document while waiting for NOA2.

    Do you have a B visa currently?
     
    If you do, or if you are able to get one, you can travel and marry here on that trip.  He can petition you for a CR1 visa, which is superior to the K-1 anyway, and then you can go back to Japan to finish school and await the visa interview.

    What your husband is going through is absolutely ridiculous. I flew back from Colombia in May with my expired green card and the 24-month extension letter. The airline agents would just take a look at the green card and notice it was expired and ask for the letter. That was it. I was using American Airlines. No need for a stamp on my passport whatsoever.

    I'm sorry you're going through all of this. It must be going through a lot of emotions right now, and I'm glad that you're finding support in your family and things with your husband seem amicable. Regarding the immigration situation, the consensus here is that, if you two are considering divorce, then you should file for ROC with a divorce waiver. You mentioned that your husband is willing to "stay married" while you go through this process in order to help you out. However, ROC is based on a bona fide relationship. The moment you decided to divorce, staying married in order to get an immigration benefit no longer constitutes a bona fide marriage. Should USCIS catch any wind of this during the process or interview, you'd be in for a world of trouble. Since you talked to your husband and now you both have considered divorce as the route to go, then you need to file for divorce in your state of residence and file for ROC based on a divorce waiver. You will still need to provide evidence of having had a bona fide relationship: joint lease, bank accounts, health insurance, etc., up to the point where you two separated, along with the paperwork that you two initiated divorce proceedings and a brief letter explaining the situation (better if signed by both you and your husband). A cousin of mine is going through AOS in NY. She got an RFE about three months after her initial filing, so that should give you an idea of how long you'd have to wait until you get your RFE for the finalized divorce decree. I'd suggest you apply for ROC as soon as you are eligible and then submit evidence as requested by USCIS.

    In Colombia, the hospital did ask for my passport to check against the paperwork, but that was the extent of it (no stamp). The doctor's office gave me a sealed envelope to take to the embassy later that day after the exam. I fail to see why a hospital would stamp your passport; it is a travel document. Maybe they've had instances of fraud and want to cover their butts.

    My husband and I have always regretted having gone the K-1 route. What others say is true: I spent six months without being able to do absolutely anything because I had to wait until my status was adjusted. I was really bored, and I also had to delay starting college here until I got my green card. I could’ve started a semester earlier or have come to the U.S. a whole 18 months earlier! You seem to have a pretty solid case, so I do advise you to simply marry and then file for a spousal visa; they’re taking almost the same as K-1 approvals, and you skip the added months of adjustment of status. If what you want is to have a ceremony in the States, you can legally marry here (if your fiancée comes on a B visa, not sure if Serbia is part of the visa waiver program, and then returns to Serbia to wait for the spousal one) or marry in Serbia (legal paperwork-wise) and then have the wedding here.

    The link you are referring to is for representatives.
    For citizenship via marriage, It's always a good idea for the usc spouse to accompany during the n400 interview. Some uscis offices may not allow it especially during covid/post covid but still one can stay outside. In case of any doubts by IO, you can tell him that your spouse is outside (wasn't allowed in). Sometimes they may then allows usc spouse to enter the facility after IO's permission.

    If you want to apply for it, go for it. If your spouse accompanies you for the interview, much better. Like you said, usually travel history of the USC isn't asked on N400 and usually IOs don't ask about that either. They usually ask if there's been any change on marital status (like divorce). So if not asked, no need to volunteer but if asked just be truthful. Good luck.

    This is another issue to consider, and a big disadvantage of the K-1.  You need to do more research on North Carolina law if that is where you intend to live.  NC requires that all new residents get a NC driver's license within 60 days, so you may be able to drive for 60 days with a foreign license, but after that you can't just "trade it in for an international driver's license," you will need an NC license and to get one you will have to show documentation that you are in a legal status in the US.  NC may require at least an EAD and that takes a few months after you get married and file for adjustment of status and work authorization.  You will likely not be able to drive for a few months, so consider that and all the other factors before making a decision.  Good luck!

    It is no longer "fastest" overall, and the AOS process for K-1s is a big negative.
     
    Most of us who did a K-1 even when the petition process was only 6 months (vs current 13 months) would have chosen a CR-1 in retrospect.
     
    "Fast" is not a reasonable criterion for choosing a visa in 2022.

    What form did you file?
     
    If you had a 10 yr card and filed an I-90 renewal, then do as @Mike E posted and get a stamp. Look up your states DMV req identity docs . In CA you can get a Real ID w just the I-551 stamp.
     
    BUT, of course that would require you to have a valid passport from your country of origin …unless at InfoPass you INSIST and obtain the stamp on something other than ..passport ( I.e. old stickers on back of expired card, an I-94 style paper) ..what has anyone obtained recently?

    You can register to vote right after the oath ceremony. There should be stands for registration when you exit the hall.
     
    I would update SSN records before getting the passport. And you might not be able to get a passport now, as most offices are just processing emergency applications. 
     
    Regarding driver license, unless you need to renew or get a real ID driver license, there is nothing to update.
