    You may file an I-130 petition for her now, but no rush.  As long as you file the petition before her 21st birthday and she remains unmarried, she will be under IR2 (minor child of USC) category.  After she completes the visa process in Mexico and enters the US with her IR2 visa, she will immediately become an LPR.  As in, the moment she steps through the immigration line at the airport and gets the CBP entry stamp on her passport, she's already a green card holder.  No need to apply for a GC, though you'll still need to pay USCIS $220 to print and deliver the plastic card.

    There was a post not long ago whereby the petitioner (USC) and the beneficiary where both flying into the US at the same day and time, only from different routes. Unfortunately the beneficiary arrived a few hours earlier than the petitioner, and they were not allowed inside. I will see if I can find it.

    I had a very close male friend (who has for a year now abruptly cut all contact with me) who I strongly suspect is committing VAWA fraud. I hope he was not successful because if he is, he would have conned an innocent woman 13 years younger than him and barely an adult really…☹️

    I think it was Hacking who mentioned a case about somebody who had an issue as their spouse had filed for 5 different people, the main problem was that they were all filed on the same day.

    My theory at the time was it was the weekend and USCIS wasn’t operating correctly as is the norm on weekends.  It is now well into the work week and the A number is still not being accepted.

    Nope.  He can file as married-filing separately, with only your name......He cannot legally file as single if he is married....period.

    So you basically are admitting to having asked an employer to apply for a green card for you or a work visa, when you are on an F1 but you need to be full-time student and cannot work outside of the university (unless you use CPT or OPT post-grad but it's very limited)

    And I'm sorry, but employers don't go offering jobs to random students. You should have said that you are a full-time student and you would contact them when you finished your degree. If they wanted you to work illegally, then it was not something useful for your field of study. A reputable employer is not risking hiring someone illegally unless is like dishwasher or something like that.
     
    For 26 years old you sound very naive or unaware of basics of what a full-time student is. I recommend you study in another country. You won't be able to come back for 5 years.
     
    Maybe this place where you were studying has online classes or the new university can accept some of your credits. Or if your university as a "college abroad" program or exchange program, you could see if you can take classes at other universities that could count towards your degree (if you have very little left, this could be an option). Most reputable universities have exchange programs.

    Yes, but it's mostly a formality as long as you pass the background check they do. You need the interview to get the stamp on the passport.
    The reason why it's a formality is because the lawyers send a petition to USCIS and when it's approved, it's sent to the consulate. This is a very technical petition so the consulate has no reasons to go against USCIS. They ask some basic questions like "what do you do?" "where are you going to work?", things you already know about. Then they'll get the stamp on the passport.

    You sound pretty desperate to make it to the US by whatever means possible.  This is something CBP and consular officers are trained to recognize.
     
    I don't see you getting approved for a non-immigrant visa anytime soon, sorry.
     
    Not sure why you are invoking "justice," but no one has a "right" to be admitted to the US, except for citizens and permanent residents.
     
    Maybe it is the way your post is written, but you may want to consider whether your attitude makes you sound entitled or victimized.  Your future and your happiness are not owed to you:  you need to make them happen, and if that cannot include studying in the US, make other plans.

    You have applied for an F1 three times since January???????????    I don't see any chance for you to enter before January of 2027.   I would look for educational opportunities in another country.  You are fighting a very, very steep uphill battle which you have almost no chance of winning.  Good luck in finding peace and happiness.

    1. Travel to other countries,  especially Canada, Schengen Area, EU, Australia, NZ, and Japan.  
     
    2. I doubt it and their presence would if anything make it more likely you would be denied.

    Hi! The wait is almost over for me. DoS sent favorable recommendations to USCIS. The case was with DoS for 16 months (fulbright funded). Now I am waiting to get the letter from USCIS. Hang in there folks and good luck!

    In your case I make the rare call to follow her employer legal team’s advice, get married, and file I130/485/etc.  If you choose to go that route I certainly wouldn’t leave the country with her.

    so,  chances of a tourist visa are slim to none
     
    own a home / apartment in Morocco
    have a job in Morocco
    or 
    going to college in Moroc
    show he has enough money for the trip (like a bank account)

    Same question I asked him and he said, they thought it would affect their application. If he had mentioned the kid, would the kid be a US Citizen upon him naturalising?
