    Did you ask if they accepted any other forms of ID? During my AOS phase I would often be asked for a state ID which I didn't have, but my usual reply would be to offer them my foreign passport plus my marriage certificate to prove my name change, and I never had any problems. When they ask for a state ID they usually just mean "an ID with a photo from an official source", like a passport, greencard, EAD...

    With a K-1 you cannot work until you have your EAD. When you apply to adjust status after you are married there is currently a 5-7 month wait for employment authorization. If your fiance is struggling already financially how will you cope when you are added to the household and cannot work for months?
    With a CR-1 you can work upon entry to the US.

    Unfortunately this status doesn't necessarily mean that you will have your interview soon. I know people who had their interviews a few months after this status update, but others have been in this status for over a year.

    You... don't need a state ID to be seen. Imagine how people who are just visiting US wouldn't be able to go see a doctor or go to the hospital because they don't have a State ID?
     
    I imagine they require a "photo ID" and I assume your wife has her passport.

    Be sure to mention when asked, that she DID overstay.  Under the circumstances you describe, I don't think that will be held against her.
     
    Are you, the OP, also native Filipino?  Your explanations come across "Filipino", which is to ignore the elephant in the room when it might be a little embarrassing.  The elephant in this case is the marriage problems you barely mention.  You would be wise to deal with those before doing anything, BECAUSE she will eventually be asked why she left the US, and she will need to answer truthfully.  Her passport expiring is not a reason.  Filipinos and other foreigners renew their passports in the US every day, and all around the world.  She should NOT try to get a Consular Officer to believe THAT was the reason she left.

    You have too. That's the immigration rules for you. Just because you don't want to wait, doesn't mean that rules will change for you.

    Basically the best thing to do (and probably the only one) is to get marry in her country, apply for CR1 visa (10 - 14 months processing time) and then she can move to the US.
     
    Having her come to the US with intent to adjust status is immigration fraud. Don't do it. No one will assist you with that.

    You can only edit posts for a little while after posting, so it's not possible to edit it now. I am sorry your husband and his ex created such a difficult situation for you. I hope you can focus on healing first and eventually will be able to find a solution.

    Never be ashamed in admitting stuff like that---first of  all., YOU weren't the one who did any of this...your husband did, before he met you.
    Second of all, no one on VJ is going to know your true identity.
    Third, most people in this thread knew it was about you from the get-go, anyhow...we see a lot of "friends" on VJ, not hard to figure out.

    What's also interesting is that both you and your friend have husbands who both left on Voluntary Departure right around the same time (according to your posting history).
     
    Suffice to say, both you and your friend are in a bit of a pickle now.  Both of you should consult immigration lawyers.  Or share the same one.

    Divorce issued in one place is valid in all other places.    Just like getting married in one place is valid in all others.
    If you came in on a K1 but were already married you committed fraud.

    No one here can advise you on your personal financial circumstances. If he can afford to quit and doesn’t want to drive a truck anymore, then why not quit? He does realize that you won’t be able to work for many months after your arrival, I hope. 
     
    One thing we can advise on is how you answer questions. There is only one answer to give when questioned by anyone in the immigration process - the truth. If he has quit his job and is unemployed when you have your interview and you are asked what work he does, you must tell the truth that he’s unemployed. This is a free country and it’s not illegal to be unemployed. Nothing wrong with quitting a job. There’s everything wrong with lying or distorting facts in this process.

    These message boards have a culture of not judging other people's relationships too harshly, and that is generally good.
     
    But this situation crosses some legal and ethical lines, and I don't think it's helpful to continue providing visa advice in the same way that everyone here would to an adult. OP is a minor who, by her own admission, has run away from her parents. Her fiance is a 24 year old man who has crossed international borders with a 17 year old girl, and has paid for her transport. I'm not a lawyer and I don't know the precise definitions of human trafficking. But I kinda think the K-1 vs. CR-1 discussion is moot here, even under the best of circumstances.
     
    Does anyone know of resources that Naomi could connect with that would help defuse this fraught situation? International mediation services, or something like that? It sounds like she will need someone to help mediate discussions between herself, her family, her fiance, and various governmental entities. Naomi, you're going to be fine -- I'm not implying that you are a victim. But it sounds like you are in over your head. I'm hoping someone will be able to recommend people you can talk to, who will help empower you to make some short-term plans. You can always think about marriage and other long-term plans after that.     So when you fill out DS 160 for the K-1 interview, you will be answering the questions again, such as your marital status, have you been married before etc. If get married in august and say “no”, you’re committing a fraud. If you say “yes”, automatically denied. It’s this simple
