  1. You mentioned the word "Delay". I am just mentioning a reminder regarding the 2-year vs 10-year Green card determination.
  2. I would delay the visa holder from entering the US until after 11-23-2023 (if you have a choice). Getting a 10 year Green Card is much, much, much better than getting a 2 year GC.
  3. AIT has usually been pretty efficient. Our interview (a few years ago) was scheduled for a couple weeks after receipt of the interview letter. BTW, why does your profile say China rather than Taiwan?
  4. USCIS is very clear. They won't recognize a marriage until after it has been consummated, and you can't consummate a marriage until after the ceremony. As I said, an early Online marriage results in a earlier date of marriage.
  5. Your choice. I'm just laying out the options and advantages of the online marriage.
  6. The advantage of an early Utah Online marriage is that after you meet, following the ceremony, USCIS will recognize the date of the ceremony as the official date of the marriage. The official marriage date starts the clock for determining whether your spouse receives a 2 year Green card or a 10 year Green Card after entering the US.
  7. No. I didn't say that. I said you have to meet again either during or after the ceremony for the marriage to be valid for USCIS. Once you consummate the marriage, it will be recognized by USCIS. I'm not sure about Thailand, but in some countries such as Taiwan, the marriage is not official until it has been registered in that country.
  8. One option, which I don't think has been mentioned in this thread, is to marry via a Utah Online Marriage, meet each other, then file the I-130. The meeting can be short & sweet, but a meeting either during or after the online marriage MUST happen before USCIS will recognize the marriage. Marrying via Utah Online marriage results in an official marriage certificate from the state of Utah.
  9. No, The I-130 is a new case. The I-129f case number, if denied, is dead.
  10. What's next? Discovery and request for summary judgement?
  11. This is the government's first response to the WOM, correct?
  12. I would take evidence of school enrollment..along with any other proof of strong ties to your country of residence. If asked, you must be truthful. That doesn't mean you have to volunteer information.
  13. It is strongly advised to avoid making ANY non-refundable expenditures prior to receiving and visually checking visa. Too many things can happen.
  14. I'm not sure what they meant by that. When wife got her Texas DL in 2017, she was able to do a direct swap of her Taiwan DL for a full-term Texas DL, no tests, etc. (the Real ID type). She had a 2 year Green Card, but her Texas DL was issued for 7 years.
  15. and working outside the US adds credence to an assumption that the foreign spouse is actually living outside the US.
  16. What sort of combination/appearance of the 2 flags are you considering?
  17. Exactly. Since my wife and I both have income sources, we each have a personal checking account at Bank A, and we have a joint checking account at the same bank. Each month, we both transfer funds to the joint account which is used for payment of household expenses. It works well for us, and it provides a good source of financial evidence. But, as you said, determine how you want to manage your finances, then act.
  18. In our case, a joint checking account is what we use to pay every-day household expenses. It provides a good paper trail for our expenses, and it is good evidence of co-mingling finances (which you will need a few times during the immigration journey).
  19. I would say "Approximately $60,000 a year". Quoting to the exact dollar might appear to be "over coached".
  20. Once she files a proper I-485 package, she will be granted authorized stay in the US. Even with the receipt notice, I'm not sure your apartment will understand. You might get a personal affidavit from someone which testifies to the fact that she lives there.
  21. **Moved to the Adjustment of Status from Work, Student, & Work Visas***
  22. You can't apply for AOS first. Adjustment of Status must be filed either along with the I-130 or after the I-130....but never before. Evidence of a bona fide marriage must be submitted right away with the I-130. Lease Health Insurance Will A few pictures Documents which show you living at the same location.
  23. Item # 4 under the I-130 package instructions explains that passport can be used. Note the word "or".
  24. Have you studied the guide? I posted this link in the very first reply to your post back in June.
