    Religious reasons might be your one saving grace there, yes... but I'm guessing they have lots of practicing Muslims that still were able to meet the requirement, right? I think it's possible, but will be tough. Just relax, wait for the RFE and then tackle finding a way to give them what they want. If it is about the meeting, then I think the religion reasons strategy will be your best bet, but I don't think it's a guarantee.

    Does that apply to you? Do the majority of Muslims from Egypt appllying for K-1 also not meet within 2 years? 

     

    Also, it's going to be hard to argue religious reasons when you did in fact, already meet... just not within 2 years.  They will ask how did you meet the first time that the religious reasons didn't apply?  It seems to be more about money, and not religion and I think they are going to sniff that out. I'd consult with a lawyer.

    They won't deny it outright yet, because they want to give you a chance to prove you met within 2 years. If you can't prove that, the denial would come later.

     

    In all honestly, it is a strict requirement, which you guys knew about, and you should have held off applying until you could meet the requirement. I'm really sorry for this news, but not sure you're going to be able to get around it.

    is it true that they are starting decrmber cases now? they could have forgotten early november filers 😭

    Historically the number of silent approvals has been 30% of the total, so just under half of the known approvals. 

     

    I have seen no indication that December has gotten started. I estimate the will start December closer to June 12th, and by then November will be > 50% completed

    It is not possible because it requires you to login with a one time password and add cases to your watchlist. I don't think they'd take kindly to adding 3000 cases :) 

     

    The old website didn't require any kind of login to check the status of a case

    No explicit photos please. This shouldn't need to be said, but I swear I've seen 2 posts on VJ where people did this recently.

    Like the guy who thought explicit photos showed it was more bonafide... lol, oh man. At least it made me laugh during this long wait for NOA2

    For the passport photos they just need to be on a light background, and the right size - the form instructions tell you the specifications.

    For other photos, just make sure to write the names of the people in the photo, the location, and sign the back of it.

     

    Also, please know that photos alone are not enough to prove a relationship or even that you met within the last 2 years. They help as extra evidence, but you must have something more concrete proving you met within two years. Copies of your passport stamps, and boarding passes of your flights are good to include.

    Flight confirmation and check in notices don't even prove you got on the plane... ah and no passport stamps is going to be tough. I wonder if the airline can send you something that states you had checked in and were on the plane?

     

    Can you show any credit card statements that show you purchased items in his city in the timeframes you previously said you visited?  Do you have any photos that have things in the background that would be able to show location and date somehow?  Photos with family members who can write and sign an affadavit on the dates and times they were with both of you together?

I filed October 25 2017 and last week my fiance and I received an RFE (this whole process is super stressful and I'm definitely ready for it to be over).  I'm posting because I'm just trying to figure out what I'm missing or what because the RFE is saying that we didn't provide proof of meeting in the last 2 years? But i included 15 plane tickets all with dates falling in the 2 years prior to filing. Lots of pictures that include us together at various holidays  where he lives, facebook comments, posts and instagram posts showing us together. The only thing I'm not sure of is all the plane tickets and whatnot are all in my name so obviously it doesn't show us flying together, but it's me flying from my city to his. So if that is the documentation I submitted originally, what am I supposed to include for my RFE? Honestly I'm super stressed and worried because I feel like I've submitted everything I have for proof and have nothing left to show us 'in the same place at the same time' short of what I've already submitted. Does anyone have an advice? What did you guys submit that seemed to be sufficient? This whole process is really making me anxious and I want to get this RFE submitted as soon as possible, thank you :)

    Send in copies of your passport that show the stamps of you entering his country during those dates.  And by plane tickets do you mean the actual boarding pass stubs, or just the receipts / what you got in email - because actually boarding passes work better. The copy of your passport with stamps should do the trick, assuming you met him in his country.  To be on the safe side, I'd personally take a photocopy of every single page in the passport, blank ones too, but some people will say that's overkill. I say for the extra few dollars / minutes it takes it's better to be safer. 

     

    Plane tickets dont show you were admitted to the country or that you met your person there either. Photos don't prove timeframe. Passport stamps show you were there, in that country, on those dates.

    I estimate December will start sometime after June 2nd but probably closer to June 12th. (I run the scans for November and) they are only about 12% of the way through right now, possible 15% with 'silent' NOA2s. They will probably do at least 50% of November before starting on December.

    The County I live in has implemented a Statue stating that as of July 2016 the court commissioners are no longer physically signing them, but electronically signing them. So I sent them back a Certified Divorce Decree that includes a stamp along with the documentation the court gave me showing that my County follows an electronically filed process.

     

    That's really all I can do when calling the court, so I would hope it's substantial enough, but the waiting game is killing me. 

    That makes sense, and you'll probably be fine.

     

    I had originally sent my lawyer the copy the court gave me of my divorce decree on the day of the divorce, but my lawyer caught the fact that that version wasn't signed. I had to get a new, ceritified copy with a signature and a special stamp on it from the county court and all should be good now.

     

    Don't worry!  A lot of RFEs these days are taking right at 2 weeks or so to finished up, give it a couple more weeks max I'd assume and you'll have your answer RFEs are good, because it basically means as long as you answer the question well enough you'll get your approval!

    What was your RFE for and what did you send them back?

     

    An RFE is typically going to be something like this:

    • You forgot to answer a question on the form
    • You didn't submit enough evidence  you have met in person, within the last 2 years
    • You didn't submit enough evidence that you intend to get married within 90 days of entering the USA
    • You didn't submit evidence of a divorce if you were previously married

    Stuff like that.... RFEs are all about making sure you have enough evidence to meet all the criteria for applying for the VISA.

     

    Think of it this way, with each step having additional verification / things they look at to make sure all if good.

     

    Step 1) Basic verification of form version, money, signature is correct (NOA1)

    Step 2) Are you eligible to actually apply for this visa?  (NOA2)

    Step 3) Are you eligible / deserving to actually be given this visa (Interview Approval)

    As well, I called to check on the status of my RFE Evidence Received status and the call back time frame was 480 minutes.. yikes! 

    When you first send if your application they check for a few things and will immediately reject it if:

    • You used a form that has been replaced with a newer form
    • You submitted the wrong amount of money
    • You forgot to sign the application

    There might be a few more reasons, but it's that initial first check that all of the "Rejected due to..." statuses come from.

    Agreed on calling USCIS, posting on a forum here won't help too much for this.

    Come visit us in the November thread! They are processing November right now, so you'll probably get some type of update soon. It's perfectly normal to wait this long, just keep being patient!
