    Oops!  I meant July 2021 and had expired in February 2022, I swear I never know on which day I am and now I am living in the future! Lol

    I was on the same boat, I applied in July 2022, my green card expired in February 2023 while my N-400 was still processing. I have been working all this time as well and was wondering if my employer would ask me for a new green card since my file probably shows that I am expired.  I did some reading and researching and like Arken explained above, found out that your resident status does not change just because the green card itself expires. You should be fine. I had my interview last week and got approved and will take the oath next month.

    This is just based on my personal experience at the Guatemalan consulate, many years ago. I applied for a Tourist Visa while waiting for my K-1 to be approved and I was granted one, and was able to visit my fiancee (now husband) for Chrismtas that year. I was willing to take the chance, the wait back then was not that long and I did not mind losing the money. It won't affect your K-1 process.. Now that being said, I had been a tourist visa holder since I was a child and had traveled as a tourist many times before I applied for the B2 that time.  If I can find my post about that experience I will post it here, I was worried when entered the POE but I was truthful and stayed only for one week then went back home and waited for my K1.

    I think the computers that receive their application run on PST so submitting the same day you're eligible runs the risk of being to early because of the time difference.
    Why do people submit the very same day you're eligible? It's not like you're going to be out of status if you wait a week...

    Why do people insist on filing the very second they become eligible?  Filing a few days after the window opens causes no delay in processing.  All you can do is wait.......

    Each absence from the USA of 181 consecutive  days or more, creates an assumption the LPR broke continuous residency for the purposes of naturalization.
     
    It is likely these one of these  absences will result  in her N-400 being denied.  
     
    My advice is apply 3 years after she returns to the USA less 180 days.  So March 5, 2023 + 3 year - 180 days = March 5, 2026 - 180 days = September 4, 2025
     
    And don’t forget that she has to reside in the same state or USCIS district for 3 consecutive months before she applies.  
     
    Before leaving the USA for 181 days or more, she should file I-131.

    If you cannot attend your scheduled naturalization ceremony, return the notice, Form N-445, Notice of Naturalization Oath Ceremony, to your local USCIS office, along with a letter requesting a new date and explaining why you cannot attend the scheduled naturalization ceremony.Sep 24, 2021
     
     
    You may not be able to take the oath. USCIS may reschedule you for a later date. If you miss the ceremony two times without an explanation, USCIS will take steps to deny your application.

    So, you’re planning on lying on an official US immigration office application to get a TOURIST extension when your actual plan is to get married? Bad idea. Apart from the repercussions for immigration of misrepresentation, as others have pointed out, if the extension gets rejected (highly likely imo) you will start accusing unlawful presence and your tourist visa will be revoked,
     
    is this person a US citizen or a green card holder, by the way?

    IMHO, your reasons for an extension are weak and the chances of it being approved are low. You had 6 months to explore the US which is more than plenty. This will be their thoughts too. 
     
    Filing I-539 does not eliminate unlawful presence. If you’re okay with a very real and likely risk of overstaying and having your tourist visa revoked (which makes it virtually impossible to get another one), then file away

    How are you going to fund your stay? 
    And after 6 months of exploring the US... why do you need more time to explore it?
    Most people cannot afford to vacation in a country for 6+ months away from their regular life and without an income. 
    Your extension will not be granted immediately. And if it is refused you will accrue unlawful presence putting your B2 and your ability to visit the US again at risk. 
    Your new relationship is not guaranteed to succeed. It would be better to go home and maybe visit again in a year or have your new partner visit you.

    Not that you asked for relationship/ life advice, but please be wise and wait some more time before you tie the knot. You’re still on the honeymoon period and seeing everything with flowers and hearts. Get to know each other, especially if you’re from different cultures. Go back, have him visit you and meet your folks, and then think ID you want to marry this person. Marry later on and file for a CR1

    This is a good example why one needs to treat important documents with a certain level of respect. When you have a three-month window to file, it makes no sense to send it on the day before it's due. No offense, but being prepared is a huge part of the entire USCIS process, and is generally a major life skill as well.
    But like others have said, you have a lot of recourse here. Good luck.

    I noticed people were bigger yes, but what I noticed more was the large number of people 300lbs+. I also saw really skinny people so I can't say "All Americans are huge". I can say I saw one such person at home, but here there's many of them. I thought it was good though that the stores actually offered more sizes.
    I noticed the religion. I knew religion was big here but until I experienced it I didn't realise how big. I also noticed a lot of hypocrisy in that. I have seen true religious people, good people. I have also seen a lot of people who claim to be religious but break many of the commandments during the week and think just going to church on Sunday makes them good people. I've also noticed that I can't say anything involving the word God. I consider the terms "god forbid" and "thank God" expressions, but I don't say them anymore because people think I'm actually referencing God and I don't want to open that door. I don't want to get into that discussion. I haven't met one US born person who isn't religious in some form.. that is a shock.
    Patriotism and arrogance. Again I heard about it, but until I got here I didn't expect it was this "bad". Flags are everywhere. You have to be careful about what you say, especially being an immigrant, that you're not perceived to be "attacking" the US. A lot of people haven't left the country, some not even their own states yet "America is the best country in the world"... They haven't been anywhere else, it's great they feel that way, but it's rarely open to discussion.
    I never thought Americans were all millionaires, but I didn't realise how bad the government support was. I didn't realise there were so many homeless people. I never expected that having kids here would be as scary as it is (financially). I knew the healthcare stuff was bad but until I was able to learn more I just didn't think about it. I realise a little while ago that if Tony and I weren't together I couldn't survive here by myself... not yet anyway. I don't have enough of a credit history (it's getting better though), I don't have enough US work experience, I have no accommodation references (in order to rent by myself). It makes sense now why people jump from relationship to relationship... they need to in order to survive.

    If you're a 3 and she's a 10 odds are not in your favor of things working out.
    If your 60 and she's 20, well you do the math. How many times does 60 go into 20? Not many.
    The problem with some guys is that they go to a foreign country and hunt for the hottest "A++++++" woman, instead of finding and building a real relationship with an "A++" woman. You spend a week or two with the hottie and you're convinced "she's the one"...
    Seriously man, get a grip. Don't you think if she is truly the most beautiful woman in the world she might know a thing or two about men?
    I'll bet when you were with her in Columbia, the Pesos flowed freely out of your pockets. Daily trips to the mall to buy your "true love" gifts to show your undying affection. Hmmm, did you ever wonder why she picked YOU out of all the other men in the world?
    You don't put up with "her lack of love" because she's hot. You meet a truly good woman who really loves you and guess what? A 7 1/2 becomes a 10...
    You chose a woman to marry strictly because she is hot. What about her intergity, ethics, values, morals and scruples? Even the most beautiful woman will lose her looks over time and all you have left is her heart and soul.
    You were destined to fail right from the very beginning because your relationship was based on B.S. There was no mutual respect, no honest communication and no real compatibility. What did you really think would happen?
    Sigh...
    3 petitions and STILL you haven't learned anything about women (American or otherwise).

    People have a 1001 excuses for doing what they know is wrong, however I have never heard of a ####### spontanously leaping into a #######. Infidelity is a premediated act. It can be seen as the premeditated murder of your marriage. Excuses are just an attempt to defect the responisbilty for your actions.

    I'm sorry you're going through this but I do have a quick qn... why don't you go home? I know for 100% certainty if Tony and i didn't work i would have been on the first plane home, the GC just isn't that important to me because I didn't move here for that, I moved here for him.
    **Edit - yes you can TRY for VAWA. You might not get approved though, it's not guaranteed.

    Biometrics isn't an interview. It is finger printing - photograph and a form you fill out. Regardless no actions can be done to the case until this is completed and yes the process can be deemed abandoned if you do not show up.
    Return to the USA right now, go right away to the ASC center with the biometrics appointment letter and have your biometrics taken hope they didn't close your case for not responding/attending.

    I applied for numerous jobs at the beginning of the year and only a few of them requested references. When they did, I included 3 professional references that worked with me in Nicaragua, one of them was actually my supervisor. So, if they request references, I would suggest to include professional references from your previous job(s) in your home country Nowadays, the internet makes it easy to communicate - include their e-mails.
