    Of course you can not enroll in Medicaid ; you and your sponsor should know this as he completed and hopefully read the affidavit of support. Get a job or have your husband get a second job if you are concerned about expenses.

    You can’t compare your case to anyone else’s and you also cannot judge a case based on surface-level information that’s may or may not even be accurate. Each case is unique. One couple might actually need a binder of evidence and still gets asked for more, whilst other couples are so low risk that commingling finances are convincing enough. 
     
    Your case is already approved so I’m unsure why this would matter to anyone but the adjudicator. Be happy for those with uncomplicated approvals and hope for the best for those still waiting. That’s all there is to it.

    OMG guys!!!!!!! A couple days ago I received a phone notice that my Removal of Residence was approved, so it seems that it got approved without requiring an interview. Then yesterday I got the mail notice, which I was expecting to be a printed form telling me that my i-751 was approved and that they would be sending the green card soon... I almost didn't read it.... LOL
     
    TO MY SURPRISE, the form said that they also approved my N-400 and that they will not send me a green card as I will just need to take the Oath and get my naturalization certificate instead! WOW. I didn't even need to go for an interview and do the test! I assume because of the COVID they might want to do social distancing, so they might be sending approvals to a lot of people to help reduce the backlog.
     
    So I applied for the Naturalization 90 days before the expiration of my temp green card, so I think this doesn't put you on ahead of other people, because my approval time has been on par with people that has similar expiration dates to mine. I applied on January 26 of 2019, but my expiration date was April 26 of 2019. You can check my timeline for comparisons, I always put updates there.
     
    Here is what the notice says for those who want to know how they phrased it:
     
    "We have approved your I-751, Petition to Remove Conditions on Residence. Our records also indicate we have approved your form n-400, Application for Naturalization, Because we also approved your N-400, you will not receive a new Permanent Resident Card (also known as Green Card). Instead, once you have taken the Oath of Allegiance, you will receive a Certificate of Naturalization, which will be proof of you U.S Citizenship. If you have question regarding this process, please contact USCIS."

    Just wanted to give a quick update. My oath ceremony is scheduled for Jun 17 at the New Orleans USCIS office. The notice mentions, among other things, no guests, face mask requirement, and that I need to bring my own pen. Excited!

    Biometrics: Dec 27, 2019

    Girlfriend? An I-130 is for a spouse. You must be legally married.

    Two options:
    1. Submit the copy of the expired passport and hope USCIS accepts it. In the mean time have your wife apply for new passport so its copy can be provided in case USCIS asks for it later on.
     
    2. File i130 after getting the new passport.

    You also need to switch banks if the one you use doesn't accept a foreign passport. What kind of bank doesn't accept a foreign passport? As an immigrant I would have zero patience for that and would have moved on to another bank.

    Oufffff!!! Thank you Lord.. Thank you for protecting us under this unprecedented time. USCIS just called me and schedule my naturalization oath ceremony for Wednesday 20th,2020. Was really impatient and prayed hard. I’m glad I will be done with this immigration stuff. May God bless America. They asked for me to wear mask when I Will come to the office.

    There is no need to "be a bigger person". There is a need, however, to be safe and avoid any unnecessary problems in the future. It seems he used her, threatened her, reminded her that she is on the hook for I-864, and realistically, from where I stand, she should truthfully relay this to USCIS and let them decide.
     
    Yes, this is coming from someone who spent 5 years removing conditions because my ex lied to USCIS, so I have great perspective.

    Yes.
    Divorce is not a reason for ROC denial. If you are divorced before January he can file at that time. 
     
     
    Arrest, no.  Conviction, possibly, as a conviction for domestic violence is in most cases classed a deportable offence.
     
    Innocent until proven guilty beyond a reasonable doubt is still a thing (thankfully).

    An arrest does not matter. A not guilty verdict does not matter. A dropped case does not matter.  
    A conviction (or plea of 'no contest') matters. 
     
     
     
    Unfortunately (and thankfully) that isn't up to you. He isn't an amazon package you can just return if it doesn't work out.
    I'm not in any way dismissing what you say has happened, but it is an unfortunate statistical fact that many marriages don't work out, and why should the ex spouse be able to dictate what happens to the immigrating spouse from then on?
    Having been on the receiving end of a bitter, violent, narcissistic ex-spouse who did go to USCIS with a pack of lies after we parted ways, it isn't pleasant and may cause problems (and indeed still is for me), so you could do this if you wish, but really, just get the divorce done & dusted, move, get on with your life and be the bigger person.
     
     
    Note that you remain on the hook for the I-864 until he is a citizen, ceases to be an LPR, or has accumulated 40 quarters of work - even if you are divorced in the meantime.
    There is nothing you can do about this.

    Just for clarity to other readers, it would have been filing for them at the same time, not accompanying. The latter may imply being a derivative beneficiary of the mother's petition, and that does not apply for IR/CR cases.

    Oh mein its sad you didn't know she could have accompanied her mom on her IR1/CR1. You can petition her the same way you did her mom. Its really not that hard. I did mine and my kids on  separate petitions years ago. SO file form 130 for her and now that can be down online so go ahead. It should take between 10-12 months. Good Luck.
