    Update: we received a notice of action yesterday about the I751 saying it was approved. However,  card will not be produced since already has a pending oath ceremony.

    About 2 months till change in online status and 3 month for interview. We applied October 24th and online status changed to “interview scheduled” by December 23rd with an interview date of Jan 31st.

    My wife just had her N400 interview today and she passed. She said the officer first looked over her pending I751 case and was told he approved it but she should disregard any update regarding a card production. He then moved to the N400 interview. She passed the reading, writing and civic tests. The officer gave her a white paper where he marked that she has been approved. Now waiting for the oath ceremony. Good luck everyone and I hope you hear some update soon if you’re still waiting.

    My wife just had her N400 interview today and she passed. She said the officer first looked over her pending I751 case and was told he approved it but she should disregard any update regarding a card production. He then moved to the N400 interview. She passed the reading, writing and civic tests. The officer gave her a white paper where he marked that she has been approved. Now waiting for the oath ceremony.     No email or text update, decided to check my wife’s N400 case status this morning and saw N400 interview was scheduled 3 days ago for end of January. Case filed in October 24th 2022. Still no update on her ROC since it’s been “moved to a new office”. I hope everyone else’s case move a little quicker as well.

    We just submitted my wife’s N400 online today as well. We got the receipt notice after few minutes and now just hoping everything moves. Good luck!

    Yes and yes. Biometrics were waived (they used what they had on file). You will receive a notice in the mail. We had similar situation and our noticed arrived 4 days later.

    My wife’s I-751 online status was updated 2 days ago to “Case was updated to show fingerprints were taken”. We sent the packet in October 2021 and we’ve never received any biometric notice. Does this mean they’ve used her biometrics from when we filed AOS? If so, are we still going to get a notice about it?

    You don’t need to file I-751 if you’re not within 90 day window of the expiration of the conditional green card. If you’re not naturalized by your 90 day window, then I’d consider filing the I-751 just to be safe.

    Yes it does. I filed online and uploaded his passport photo which is also the same one on the CoC. Thank you for your reply.

    There used to be a time when this was true. You only need one day of active duty to be eligible for military naturalization.  I went through basic training in 2017, turned in my N400 and N426 at reception before the start of training and I was naturalized on family day (a day before graduation). The policy was changed like a year or 2 years ago (sorry I can’t remember precisely when). Now all military member should have served 100 days (maybe 180) of active duty to be eligible for military naturalization. With that being said, it doesn’t hurt to have your N400 and N426 on you when you leave for training just in case but you will most likely not be naturalized in basic training.

    You’re very welcome. He’ll already be 25 weeks on active duty by the time he is done with school, if it was me, I’d wait to clock 180 days Time in Service and apply based on military service, plus it’ll save me that filing fee..lol.

    He won’t be able to attend biometric or any uscis ceremony while at boot camp. I’m not sure about navy boot camp but there used to be a time when uscis had local offices in US Army basic training locations. I submitted my N400 and N426 as soon as we got to basic training, drill sergeants took us to our biometrics and interviews and we got naturalized on family day right before we left basic training. This was when you only needed one day of active duty to be eligible for naturalization. With that being said, I’ll advice he graduates boot camp and arrive at his first duty station before applying. That way, his file will sent to a local uscis office close to his address.

    Based on what you explained above, your son has 2 options of applying for citizenship, he can apply through the civilian route (Which he will be eligible by June) or through the military. And as you correctly stated, he can’t apply through the military until he has served up to 180 days on active duty. Different between both options is- To apply as soon as he becomes eligible in June, he has to pay a filing fee and apply as a regular civilian even though he might be serving in the military. To apply through the military, he has to file a form N426 (Certification of military service), which will confirm that he has served up to 180 days on active duty, alongside form N400 and he doesn’t pay a filing fee.
