Hey!!

i have just got my 2 year green card

and I am filing for N-400 under 319(b)

im wondering if I have to file I-751 along with the form N-400 or not since I'm a conditioned green card holder ?

is it correct that I-751 only filed when you're in the 90 day window (90 days before your green card expires)?

thank you

You don’t need to file I-751 if you’re not within 90 day window of the expiration of the conditional green card. If you’re not naturalized by your 90 day window, then I’d consider filing the I-751 just to be safe.

Some spouses apply for their I-751 regardless, as there have been cases where they don't apply for their 319 (b) on time in order to avoid filing for I-751.
I would just to be safe!
