    hello!
     
    I just saw this thread,
     
    filed 485, 130, EAD/AP, from work visa, marriage based.
     
    PD is May 11 on old website and NOA1, May 22 on new website.
    Bio june 15
    RFE july 23 for Birth certificate
    ready for interview August 6
    no sign of EAD/AP, what is yall case status on the EAD/AP, mine is still "my case is received"

    Are you in the US now? If so you can submit AOS whenever you’re ready. If you’re not in the US at the moment you cannot come here on a tourist visa and file for AOS. That’s immigration fraud. You must apply for CR1 and wait 12-16 months.

    UPDATE:
     
    It was an RFE for his birth certificate, what we submitted with the application was his "adoption papers" (it's called acta de reconocimiento de hijos in Mexico) i guess. He told me it was like a birth certificate and it was the same thing he used to get his Visa. So, I didn't question him but since the RFE is about his birth certificate, that's how it clicked that I shouldn't have listened to him and I should have submitted both to be safe..
     
    But we will submit the birth certificate as soon as we get the translation online.

    as long as the EDITION date in the bottom left is 7/17/17, for now. 
     
    according to the USCIS website, "07/17/17. A new edition of this form is coming soon. In the meantime, you may file using the 07/17/17 edition.  You can find the edition date at the bottom of the page on the form and instructions."

    SO, if you are just 30 minutes from NM, it might be the best to live there..

    Currently no, I don’t have the intention to move to another state, but from where I live, New Mexico is only 30 minutes away. Last time I checked NM allows cousin marriage. The question is, must I be a resident of NM for me to get married? Will Texas recognize my marriage if I did it in NM?

    LOLOLOL.. That is soo true, everybody will starts their long weekend tomorrow.. Since I work in retail, weekends are ALWAYS ALWAYS busy.
     
    I'll wait until next week, hopefully though I get some kind of update..

    All that you can do is just wait. We applied on May 31st, 2017 and we just had our status changed on Friday, May 4th to "Interview has been scheduled". We are still waiting for the letter

    that is what it was!! USCIS has a version from 12/2017, I had the 6/2017. I didn't even see the date on the BOTTOM!!
     
    I checked the top part that's why I was so confused!

    Yes, it is very confusing but you have to check the bottom left corner for the date like
    the previous person said...

    The most recent versions are the ones on USCIS website. The date you have to look at is on the bottom of the form not the top. If you are sure you sent the most recent versions then you should  refile the same with letter explaining - that it was an error on their part. You can find the most recent forms here:

    The only difference will be that they will get 10 year GC instead of the 2 year GC.your husband will file i130 as their stepfather and it will be immediate relative.

    And it's recommended to file AP/EAD, it's filing fee is free if filed with the 485.
     
    AP, advanced parole so you can re enter US if you went overseas (for vacation or whatever) 
     
    EAD, employment authorization so you can legally work.

    You can technically file 90 days BEFORE your GC date.. So if you came to the US Oct 1, 2011, you can file July 3, 2016 (July 3 because there are 31 days in July and August)
    I am waiting for my interview date to be a citizen then I will marry my other half.. He overstayed his working visa..

    OP already found the love of their life and clearly has INTENT to immigrate.  so entering the US with a B2 visa and then getting married even the day before the visa expires IS VISA FRAUD.

    File for AOS with EAD and AP and explain to her that the EAD and AP onlyntakes about 90 days, just 3 more months of waiting.. 
     
    If she wants to talk to a kabayan, PM me. Maybe she just really want to talk to a filipina..
