    I'm sorry to hear this.   
    Yes, you can send an email to the embassy and inform them that you do not wish to continue with the visa process.   USCIS no longer holds the case but it wouldn't hurt to inform them too.

    I'm saying that in the process they're in, they don't pay any fees except the visa fee. 
     
    The petition fee was paid 7-10 months ago (approximately) and the AOS won't be for another 5-6 months depending on other factors. 
     
    Right now OP should not be paying any fees for the K1 besides the visa fee that you must pay to schedule your interview.   This is paid via different means to the embassy/consulate.

    Don't click there because those instructions are for immigrant visas.   A K1 is a non-immigrant visa.   
     
    Now you just wait until your CEAC status says something about being sent to Department of State (DOS)/embassy- I can't remember the exact wording.   After that, you can email the embassy for instructions regarding your medical and police report.  
     
    Then you pay your visa fee and schedule your interview and gather your documents for that.

    Because you are technically an employee of the staffing company (assuming that they assign work to you and you are paid by them), my suggestion would be to use their address.

    Relationships don't always work out, especially long distance relationships based on a few in-person visits like a K-1.  Based on your previous posts, you have had concerns for many months, but SHE really wanted to come and was able to convince you not to withdraw your petition, so now she's here and you have decided that it is over.  Be considerate and open with her, but also firm as she will try to convince you again not to change your mind.  She has only been here for a week, so if she had as good a job as you say she did, she will be employable when she returns to her home country, maybe even get her former job back since it has been such as short time since she left.  If she refuses to leave the US, there is nothing you can do other than not marry her, not live with her, not support her.  After 90 days of arriving, if she doesn't leave, she will be out of legal status and will have to leave with the ticket you are offering her, or stay and risk deportation.  With no money and no ability to work legally, she will most likely see the writing on the wall and fly home.  I agree with others that she has a share of the responsibility for this situation, and she could be taking advantage of you.  It's impossible to know for sure.  But do the right thing and explain how you feel, move her out, offer her a plane ticket home, etc., but do it in a respectful way to preserve your own integrity.  Don't get angry or be vindictive or she could use that against you.  This process is painful enough, so good luck and I'm so sorry that this didn't work out.  Good for you, for trying to make the best of a touchy situation.

    They really shouldn't be refusing to send you to tier 2... One tried with me and I just repeated that "I would like to speak with tier 2 please."

    Check for when your case creation date changes and it goes from saying "immigrant visa" to "non-immigrant"...when you see that, know it's coming!!!

    If you have an attny that you are paying for you should be asking them to do something- thats why you are paying them.
    You may want to get your congressperson involved or the Ombudsman. Not sure if they will help if you have an attny though or if your attny has to sign a release as well for them to help.

    My husband's did that as well.  I read here on VJ, and it proved to be true, that the post-interview flip-flopping CEAC status portends the visa being issued.  You guys are close!

    Hi all!  I had my AOS Interview at Tampa FL USCIS Office today.  Here is my review...
     
    Met with a lovely immigration officer (Riki) who went through the I-485 and verified all the information that I had provided in the form.

    Asked for my name and former names, my DOB, husbands name and his DOB, my parents names, current address, how long we have lived there for, date we were married and then we went through each of the immigration/criminal/terrorism questions which you have to answer verbally yes/no to. We were then invited to provide any supporting documentation to verify our relationship. We provided gym membership, health insurance, joint credit cards, car insurance, joint bank statements, birthday cards, 5 x photos from the wedding, copies of our wedding vows and facebook msgs and emails. She then invited us to tell her about us and our story which we didn't mind retelling as we love to tell our little 'fairytale'

    She then informed us that she had everything she needed for her review and that once they did a 'refresh' on my background check, everything to her looked good to be approved. Told us they have 90 days to approve it but that she normally takes less than 30 days to go through her cases and issue decision. She then said that I will receive a letter advising us of their decision and then a week later will receive the card.

    By the time we arrived home (approximately 2 hours after the appointment ended), I received a text notification that my case status had been updated for all three cases (AOS, EAD & AP). So I signed in to my USCIS account online and it advised 'New Card is Being Produced' for my AOS which means I have been APPROVED and it is on it's way! NOTE - Because my greencard was issued before my employment authorization/advance parole requests had been granted, they have now been cancelled by the immigration officer (she advised us that she would cancel them once she approved and issued my green card).

    So all in all, a easy experience (even though I was nervous... something about an 'interview' that always makes me a little uneasy haha), questions were straight forward and after only a short wait, I now have my green card on it's way! Happy Days

    Also just a quick mention regarding the I-693 medical. I had my overseas vaccination in Feb 2018 with all my vaccinations completed (except for the flu vaccine as it was not flu season in Australia). I provided a copy of my vaccination record (DS3025) with my I-485 submission and this was sufficient. I did NOT go to a civil doctor and re do any medical or vaccination part of the form for my interview as it was still within the 12 months of my overseas medical. The topic of the medical was not even brought up in the interview. Just wanted to add this in for others as this was something that I wasn't sure of and took a chance in not completing the additional medical just in case I didn't need it - which turns out I didn't!
