If you want the absolute best, cost be damned, you may want to look at Carl Shusterman: https://www.shusterman.com/

He, or one of his associate attorneys, would probably run you into the tens of thousands, but he may be the leading immigration attorney practicing in the US today.

There is also Laurel Scott and Lizz Cannon that come to mind, though they are more waiver attorneys than AWA. Perhaps there's something they could do for you though.

Be aware that it's going to be an uphill battle to overcome an AWA-related inadmissibility, and will cost you thousands of dollars in lawyers fees with no guarantee of success. Most attempts to overcome an AWA NOID fail, and you may wish to look into living together in a third country as a viable alternative.

You need to resolve the issue of the fact that you are still married before you do anything related to immigration. From my understanding, an annulment in the Philippines can take years and a lot of money.

And after that, you may be questioned on why you tried to hide your first marriage. As mentioned, the CO could use that to issue you a denial due to misrepresentation. Like I said, they really really really don't like to be lied to or have important things like that not being mentioned.

Highly unlikely you will get a tourist visa anytime soon.

In the future you can apply for a fiance or spousal ONLY if you are free to marry. Meaning your marriage to you husband is annulled or divorced.

Word of advice. You are dealing with immigration. As you can tell they are very thorough is investigating your life. For you benefit, do not withhold ANY information about your life in future visa applications. Do not try to hide the fact that you are/were married. And do not try to hide the fact that you have kids. Especially kids that live in the US.

Legally the hopsital cannot let you work until you have your EAD.  You are not legal to work right now.

Working without an EAD is a good way to sabotage your AOS process and get deported.  It doesn't matter what the hospital says to you, they can NOT protect you.  Even if they say you can work, DO NOT.  They don't make the rules.

Simply put, don't work till you get your EAD or you could end up regretting it and living with the consequences for the rest of your life.

OK, so it will take 90-120 days before you will see the EAD card based on what I have been reading.  Don't work before that.

You are not allowed to work until you have employment authorization (EAD) or you have the green card in hand. When did you submit the AOS paperwork? Did you submit an I-765 petition along with the I-485?

I agree that that letter did not do them any favors, in fact it does appear to do the opposite.  If I were an airline employee, I wouldn't let her board with it.

Exactly! You best get right with the folks standing between you and your airplane seat and you and U.S. soil. USCIS isn't the arbiter of pass/no pass at the airport. Why anyone would fly with an expired green card and no stamp is a mystery to me. My opinion is that you didn't want to wait, went with a phone promise, and now you're upset and wanting to sue someone. Your experience is good advice for others thinking of rolling the dice with nothing more than a "yeah, go ahead buddy, you'll be good" wink and a nod. I'd be amazed if it didn't happen to you. The airline did its job - you weren't legal.

If this is supposed to be a copy of the letter you received after you sent in your I751, it does not say it was accepted.....It actually says you filed too early, which would explain why you never received the 1 year extension letter
If that is not what this is, then I am confused

I have told our story on here many times when people ask about traveling abroad on AP or with an extension letter for ROC.   Upon checking in for our flight home from a vacation to Mexico, Frontier airlines refused to issue my husband a boarding pass while traveling with the AP/EAD combo card.  At the time the combo cards had been in use for about a year but frontier airlines in Mexico was not familiar with them so they would not issue him a boarding pass to return home.   They told us they would only accept an unexpired green card.
After filing many complaints, what I learned from this was that even with proper documents, the airline does not have to let you board if they have any reason to think there is any possibility you will be turned away at the border.
I always advise people to make sure the airline they are traveling home with is familiar with the documentation they will be traveling with.

You are wasting your time and energy expecting some kind of recourse from the airline or USCIS.

Sorry you went through this, but without the extension letter the airline did nothing wrong.  It is a heavy embossed letter in color that specifically says that it extends your GC for one year.

The biometrics letter is just an appointment.

Thread is moved from General Immigration Discussion to the Working & Traveling forum (topic is travel).

    (Moderator hat off)
When it comes to travel, don't consult USCIS -- call the CBP instead.
In disputes with airlines, "I need to speak with your supervisor" is the phrase to repeat.

There’s a reason behind the stereotyping though. Of course not everyone from the same country is the same but there’s a certain cultural similarity to a majority of the people from any given country.

I think that not giving an updated I-864 if your spouse’s income changes comes very close to misrepresentation. The law says that your US spouse must meet the financial requirements for their household size to sponsor a foreign spouse or get a joint sponsor. If your spouse just got terminated, she no longer has a salary and hence cannot meet the financial requirements.

Also, one of the main questions they seem to ask at the interview is “what does your spouse do for a living”.... My suggestion is to bring a new I-864 supplemented with either assets or a joint sponsor.

In the sense that it is basically material misrepresentation, then sure if you are into that kind of thing.

OP, you are going to need to provide the embassy with an updated I-864 with correct information.

This information is easily found, you need to put some effort into it, there are guides on this site, surprisingly under.....guides.
You can also check the USCIS site.

Check those out then come back to ask what you need clarification on.

Women from eastern Asian countries tend to be well versed in VAWA compared to eastern Europe, South Asia, MENA or Africa.

But scammers come from every country including the USA who scam beneficiaries.

The country can be important, and yes it's because of stereotyping. It's nothing to do with some countries being "good" or "bad" though, you're right, there's good and bad in all countries.
But knowing the country can give an idea how to proceed as it can suggest how the spouse might proceed in their scam. Some countries tend toward the spouse just disappearing under the radar whereas some countries tend to be more prone to abusing VAWA to achieve their aims. Scammers are coached in ways to attract USC victims, and then once married they are coached in how to accuse their spouse of abuse if the spouse doesn't cooperate with getting the greencard.

OP, withdraw your AOS, do not lie. But just as importantly, NEVER spend any time alone with your spouse, or any time only in the company of her family or friends (they're just as likely to lie for her as she is). Keep records of all communications you have with her, especially any where she's asking you to lie for her.
There's also a good chance that if she feels that you won't help her then she may try to convince you that she wants to be with you. No matter how much you might like to believe her it will just be the next part of her plan.
