I fall in AWA category. I have received NOID. Any suggestions on responding NOID including a suggestion of a good/Experienced Atty in this matter as well as a Psych evaluator? I am faced with NOID and in need of expert advise ASAP. Any help would be greatly appreciated.

If you want the absolute best, cost be damned, you may want to look at Carl Shusterman: https://www.shusterman.com/ 

 

He, or one of his associate attorneys, would probably run you into the tens of thousands, but he may be the leading immigration attorney practicing in the US today.

 

There is also Laurel Scott and Lizz Cannon that come to mind, though they are more waiver attorneys than AWA. Perhaps there's something they could do for you though.

 

Be aware that it's going to be an uphill battle to overcome an AWA-related inadmissibility, and will cost you thousands of dollars in lawyers fees with no guarantee of success. Most attempts to overcome an AWA NOID fail, and you may wish to look into living together in a third country as a viable alternative.

This, in addition to contacting the lawyer and responding to the NOID research the process of immigration to your spouses country and/or a third country concentrating on those that allow criminal records including your specific crimes.

what is your AWA for? it really depends on what it is for.  but over the years very VERY VERY few have actually been approved through a waiver with a high lawyer.  it is an uphill battle and i would expect if it is very serious 10k-20k with a very top notch lawyer and you are looking at years . I think someone on VJ got approved after 8 years, but i could be wrong:/

This is an "ineligibility" related to a US Citizen's petition approval, not an issue or a foreigner being "inadmissible".   The attorney should have been hired BEFORE filing the petition.  How much time did they give you to respond to the NOID?

 

Did you properly disclose and explain this arrest as required by the I-129F are all you also facing a possible material misrepresentation?

In all seriousness. People do not think this is am issue. I won't judge what happened but this is an eligibility he can not overcome.

Usually, yes.  That's why the attorney consultation before filing is so critical.  It's actually critical to have the consultation before any serious relationship is reached with a foreigner.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
