I figured it would just be a matter of time.  I'm sure there will be fierce debate before it is settled.

We do not have to be married for me to get the $25K..just consider it a gift and write it off in your taxes for next year. Additionally, isn't is a known secret that the rich and powerful, have mistresses? Bill and Bezos had one. Heck, even the poor have baby mommas. So here are my bank details:
    Name of Bank: Visa Journey
    Account Name: Timona

I will be waiting for it.

Well, since it is her ROC, it has nothing to do with you apart from your signature. As such, I would concentrate on strong evidence that shows continuous comingling of resources eg quarterly bank statements, insurances, mortgage, rent, wills etc.

Did you give 50K to your wife or gf at the time? That might change how one perceives the transaction.

Yup- I can attest my baby gets 5 or 6 vaccines at a time for checkups.. and she’s only a baby.

Husband didn’t have any vaccine proof when he went for his medical and got everything in his country that was available and what they didn’t have he got done in the US at the civil surgeon. OP- your fiancé will be fine

Well, many immigrants have these all done together, myself included, and have been fine.( I’d actually had some done in childhood but lost records, which is also common.)

Lucky2Lucky reacted to Adventine in Hiring a Lawyer for K1
If their case is straightforward, meaning no criminal history, no visa denials/violations/overstays, they can DIY the process themselves. They just need to invest the time and effort to study the instructions. They can always come to VisaJourney to ask for help.

If their case has any of the complications mentioned above, they may need a lawyer.

Please don’t say that it could take up to a year after he enters to be able to work. They need to be aware that it could take much longer. I received my work authorization 19 months after I entered. I wish I would have taken the CR-1 route.

It is really unfortunate you did not research before you filed. There is no quick and easy process but gaining knowledge on what you are up against is so important. @Crazy Cat gave you great advice to cancel it and get married and file CR1 since you are just in the beginning of the process. Once he arrives in the US he would be able to work ASAP as that appears to be a priority since you mentioned work. With k1 it could be up to a year after he enters before he is able to work. Good luck and please create your profile/timeline

Lucky2Lucky reacted to Villanelle in Petitioners do Biometrics nowadays?
So the next bit of advice for them would be to first review the AWA list and make sure their offenses don't fall under it. In general AWA is abuse towards children but also includes solicitation (any age) and voyeurism type offenses. Providing the charges are not AWA- the next bit of advice would be for them to start gathering all documentation about what ever it was. This can take some time and if it was old it can be harder so you don't want to wait until the last minute!

I am assuming this is for a spouse/fiance visa and if so step 3 is giving the beneficiary copies of all the documents for them to review. The beneficiary needs to be aware of all the details so if questions are asked in the interview they can answer confidently and won't be caught off guard if the Officer brings up details they didn't know.  If the charges were for DV or another violent type offense the Officer may try to discourge the petitioner. In those scenarios the CR is the better option because as you know the K can not be appealed so if denied you start over.

Now they can also decide to interview the petitioner in addition to biometrics but typically biometrics is enough for them to verify the criminal record. Hopefully they disclosed everything they were supposed to. If they didn't they could be denied for such and would have to evaluate whether appealing or refiling is better.

Also if the charges are related to any type of fraud they may have a hard time establishing they are able to make sworn statements like I am entering the marriage in good faith.  In general immigration looks more favorably on those who admit the wrong doings and have learned from them and take responsibility so thats how both should seek to present it if/when asked about it.

I wish you had found VJ before submitting the I-129f. CR-1s are a much better option, imo, when the couple is already living together.

Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1
        More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)
Spouse can not work until she/he receives EAD (approx 6-8 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A denied K-1 is sent back to USCIS to expire

    CR-1
        Less expensive than K-1
        No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

It’s already very difficult to get a tourist visa in Tunisia to start with. In order to get a tourist visa you must convince the interviewing officer you don’t have an immigrant intent and you have strong ties to Tunisia which will prompt you to return. How will you do that with K1 petition pending which shows clear immigrant intent?

Additionally, according to the consulate’s website, they’re not processing tourist visas so that’s something to consider.

I personally haven’t heard of anyone getting a tourist visa with a K1 pending, especially during COVID when consular services are limited. The cases I’ve seen already had a tourist visa before the K1 process started.
