I didn't get any letter that my biometrics was waived but they did update my case thru the https://myaccount.uscis.dhs.gov/. When they updated my case to Fingerprint Review was Completed I knew that they re-used my old biometrics from my AOS.

This is for your son correct?

He will attend the CFO counseling at the location where you scheduled the appt.    Can't just show up at any location.

The Immigrant Data Sheet is attached to the DO NOT OPEN envelope ... but it appears your son received the new e-Visa .. there is not a DO NOT OPEN envelope with this new visa process.   There have been a few others before your son that received the e-Visa.    Bring what you have to CFO, they should be aware of the e-visa, your son is not the first to receive one.

Did you came here thru K1? If you did the only time you can get a SSN is when you have your EAD. You can get your own ITIN. Read thru the IRS website and I hope your husband requested for an extension to file taxes.

I say the only time you can get your SSN is when you have your EAD - this is because you already passed the 90 days on your I-94 which you could have used to get a SSN.

Did your parents get married after you where born and before you got your passport? If they did, bring your parent's marriage certificate and your birth certificate to the local civil registrar's office where you live and ask them what you need to do, also tell them that you were born out of wedlock. It does not take that long and not too expensive either. I had my bc's annotation done in two months. Cost me probably around Php1,500 - year 2013 tho. Have you been approved with uscis and are now on the NVC stage? Is your father in your birth certificate?

I did some reading and found this.

If you're born after August 3, 1988, Birth certificate already registered and child is under the surname of the mother and the father executed an affidavit of acknowledgment. If your father executed and affidavit of acknowledgement then you don't need to do anything else. You using your father's last name is totally fine. You can contact the registrar's office where you were registered and see if this has been done. I think they did because they we're able to get you a passport under your father's name.

If born before August 3, 1988, Child under the surname of the mother and acknowledged by the father through authentic writing. Under this you're also fine.

Just got an email today that says my new card is being produce. Is this a glitch? I'm thrilled and worried at the same time. I went to check on the case status and it says the same thing? How can it be this fast? Everything has been a slow process from the beginning. Has anyone has the same situation?

First email the embassy there and tell them of your desire to cancel the petition. Only you can cancel it. You can email USCIS too but they don't have any control of the petition anymore so.

You can send all evidence and all with the email if you wish as they may be able to put something in their files about him, but doubt can "ban" him forever.

Also, even if he gets the visa and managed to travel to the US... he can't adjust status except through marriage and sponsorship through you the petitioner, one fail safe of the K-1 so to say. So he would not be legal, not be able to get a green card let alone citizenship.

First and foremost, get in touch with the embassy immediately and have them cancel the petition before it gets issued. He may sit in AP for along time as a lot do, but don't chance it. Get it canceled now. I would contact them first before confronting him personally.

Sorry this has happened to you, but at least you found out now instead of later. This is the warning we at VJ give about knowing people because it's amazing the lengths they will go to to deceive people for their own gain. This is proof of what we have been talking about that others say we are crazy to think.

Folks there's some specific Philippines requirements here so your advice is incorrect.  Also this would be for marrying in the PI I assume, so the IO has nothing to do with it, its a Philippines requirement for a license

Up to 21 needs parental consent, 21-25 needs parental advice letter.

    Good luck!

File your I-751 within that 90 days window don't wait for the last minute. Very few get interview. And since November 1st, 2018 the new policy is less interviews long as evidence meets standards.

Once you file as others have said you will get 18 month extension letter. You may or may not get biometrics appointment.
We filed May 21, 2018, we got biometrics appoint just last month. Some get letter that biometrics will be waived so you never know. That's why you should file sooner rather then later.

Just be sure to have extension letter and expired green card with you when you leave.

Hi below is what I submitted:

-Joint Tax Transcripts for the past 3 years (2016, 2017, 2018)

-His retirement where I am a beneficiary.
-Joint Bank Account monthly statements for when we opened it 2016 to March 2018.
-Our lease but my name was not in it so I have both our driver’s lisence included to show residency.
-Monthly bills which is named to him and named to mine. We don’t have joint bills. I highlighted both our address to show same residency.
-We have children born out of wedlock so I included their birth certificate highligting my husband’s name as the father.
    -About 10 family photos.
-Statement from a common friend we have who is also our neighbor.
-Statement from his aunt when we rented her room when I first got here.

That’s about it. I have detailed everything in the cover letter. Hope it helps.

GreenGem reacted to TBoneTX in "New Card Being Produced" - Filed I-751 October 2018 (merged)
I think that you should try for an InfoPass appointment, taking all your documentation with you.
If not that, then call USCIS and ask to be escalated to Tier 2 or whichever.

The overlapping dates of the various approvals are not your fault.
Your non-waiver green card might have been approved well before you filed for divorce.
Only USCIS can answer for sure about what to do, but I don't perceive an emergency or any intention to deceive.

GreenGem reacted to dentsflogged in RFE I-485: for supposedly not getting married within 90 days after entering on K1?
    Mistakes can happen, sadly.

Double check all the dates and date formats in your AOS forms - my husband caught a few times in our package where I'd used "normal" (ie: everywhere else on earth) date format vs. US date format.

Also double check that the date on your marriage certificate is correct.

If all the dates are right and in the right format, I'd respond to the RFE with another certified marriage certificate, a copy of your i-94 to show your entry date, and perhaps even ask your celebrant and county clerk to write letters confirming the date of your marriage and the lodgement of the paperwork with the county clerk, just for good measure. Overkill perhaps, but better go for overkill now than risk USCIS doubling-down on their mistake.
