Not sure where you would ever get this idea. I've been on VJ for a dozen years and this is very far from the truth. Most petitioners, are in fact, far below retirement age.

Most people are NOT refused entry, especially coming from the UK.

OP, this person's answer is not accurate and to be honest, it's a bit over dramatic.

If your father was born in the U.S, he is automatically a citizen here. There was nothing for him to apply for, it's his birthright.

Hi there, I spoke with many immigration lawyer say like 5-10 they all told me being single is the most risky given my situation. If you are married to US Citizen then can't deport you at any cost or revoke your GC. Even Illegals who marry US Citizens don't get deported. So the law very strict and protect if married with US Citizen Again all Lawyers said it will be hard to prove that I did any fraud as I had intension to work and plus if anything the employer did not hire you after you got the Green Card. Worst case I can apply for a waiver so my GC will not be revoked and apply again for citizenship. Also lawyers have said sponsor employment will never come up as in N-400 application I will be listing last 5 year employment history and I will state Financial Analyst which will be similar job as the GC file. The GC file was filed under Accountant by the sponsor.  Under US Law you are allowed to work in something same or similar even if you did not work for the sponsor. Finally if for any any reason IO officer want to check further about case they will have to hire fraud unit and call the sponsor. But if the Sponson company will be shut down this year, how can they find any proof why I did not work. Just saying I think I am pretty much covered. Also normally most times they don't go back 12 years back. Just saying this is what lawyers have recommended..

My thoughts are... You are very optimistic in thinking marriage solves everything. It's not true.

The best case scenario - employment will never come up. But because you got GC based on employment, the chance is it may come up.

A slightly worse case scenario - USCIS will try to take the GC away. If succeeded, you'll have to become an LPR again and may have to go through waiver process to become admissable.

The worst case scenario - you will lose the status, will be ordered to leave the country and will get a forever ban for getting any immigration benefit if fraud was found.

Immigration benefit is a privilege, not a right. USCIS, if can prove there was fraud involved, may strip all immigration benefits and never issue them again. Marriage to a US citizen is not a silver bullet solving all problems, especially if fraud is involved.

I'm not accusing you of anything, just listing potential bad scenarios and their outcomes.

    Hi,

    Yes this is allowed

Just be prepared for extra and serious scrutiny at the border. There will be a good chance you will be taken to one of those backrooms to be questioned.
If you already know your interview date at the time you want to enter the states, Have a copy of your interview confirmation with you.
When asked, inform them that after your trip you will return to home country to conclude the K visa Process.
Answer all questions truthfully and stay polite, no matter how they treat you.

Though this is all possible, and i have not found many stories where someone got denied entry and it mostly goes well, i would advise against it.
Most likely there wont be much time between the DS160 and the interview, so if you just wait a little longer, you could be with your fiancé permanently afterwards.
Personally, i canceled the trip i had planned in June and i will just wait for the visa to be in my possesion. I will also wait a couple months before i actually move, but i decided it is not worth the risk of getting put on a plane back to home country 😬

    Anyway, The choice is yours

I am assuming you mailed your naturalization certificate off when you applied for your passport. I would file for your child‘s N-600 right away and apply for her passport as well.

You do not need father‘s permission/consent to file for a certificate of citizenship but do need his support regarding any passport application.

I think there should never be expired Green Cards in the first place. Extension letters, stamps etc confuse other countries and airlines. USCIS should be printing limited term green cards whenever somebody is waiting for N-400, renewing GC or waiting for I-751.

I'm sorry you're going through this. USCIS can only assure you can leave and reenter the US on I-551 stamp. They cannot assure you can transit via other countries with the stamp / green card / anything else. Those are details the traveller must check independently before planning the trip.

Keep escalating to supervisor after supervisor, and if they continue to resist, demand that they call BA headquarters.

I'm also unsure what you mean when you say you're "almost there" as it sounds you have only just sent the I-129F.

Do you understand that the I-129F is simply the petition to apply for the K1? You can view the full timeline of events here:

An asylum seeker is granted the right to stay in the US while their case is being adjudicated.  It's basically permission to be in the US until they have a date with an immigration judge, but that's as far as it goes.  During that permitted time, the person must file the appropriate paperwork to request that they not be deported and be allowed to stay legally.  They only have a year to do this.  I'm guessing the 4 years is how long it could potentially take for that case to be adjudicated.

    The information is here: https://www.uscis.gov/humanitarian/refugees-and-asylum/asylum

But seriously, I'm with @Daphne . on this one - if you didn't know her previously, this whole scenario seems really hasty and somewhat suspect.

You're looking at the short term game when you should be playing the long game. Lying to CBP will come back to bite you.  Maybe you get through the K1 process fine, but then you still have to adjust status AND remove conditions.  After that, naturalization.  At any time, your hopes and dreams could be dashed because you made an unintelligent decision to lie to CBP.  Is your fiancé ready to move to Malaysia if you mess this up and get caught?

Don't lie and don't do devious things.  Immigration is a PRIVILEGE, not a right.  There are rules for a reason and lying to CBP is doing yourself and your partner no favors.

This is such a bad idea.  CBP are very well trained at detecting things like this.
What if they call your employer to verify your employment?
What if they see you have a 2 week trip booked and they limit your trip to 2 weeks?  Then you must return home with no job?

No one on here is going to condone or support your plan.  I suggest you plan a trip for 2 weeks, return to your home county, continue to work until you move to the U.S. on your K-1 visa.

    Good luck
