Canerican got a reaction from J+J in Divorced him / her
This is completely untrue. My now wife was divorced before we got married. All we had to do was provide proof that the divorce decree. Provide proof that both you and your fiancee's divorce's have been finalized and you should be fine. If you have any more questions, please feel free to ask here. That is what members are here for. There are many members who have been through the process and have first hand knowledge.

If you have no red flags you should be able to go K-1 -> AOS -> ROC -> Citizenship without a lawyer. Do not waste the money.

    1. At this link:  https://www.visajourney.com/content/751guide/ it states "A copy of your joint federal and state tax returns (including W-2's and other applicable Schedules and attachments). Sending an official tax transcript from the IRS (for Federal) is beneficial and often preferred as it reflects what was actually filed." When I completed my ROC I sent in tax transcripts. If you got to https://www.irs.gov/newsroom/how-to-get-tax-transcripts-and-copies-of-tax-returns-from-the-irs you can order your tax transcripts and they can take up to 10 days.

    2. Yes, you should include bank statements, car insurance, DL's, credit card statements from marriage to ROC. Trust me, when we did my ROC I was like we need to do every month. When I found out how much paper that was going to be I was like, "ain't doing that." We sent in quarterly statements for all the statements stated in the previous sentence.

    3. I'm sure I speak for everyone on this site when I say that we are more than happy to help you out. That is why we have this wonderful community. When I was going through AOS I had some questions and one of the members helped me out even giving me his phone number to call him, and I really appreciated that assistance.

If you do not have any red flags I would suggest that you do not waste money on an attorney. I have said this many times before on other forums. I just came full circle and obtained US Citizenship. I went K-1 -> AOS -> ROC -> Citizenship without a single lawyer. At the following link you will find the proof needed for your I-751: https://www.visajourney.com/content/751guide/

A little of topic but you have gotten all your answers but have you guys thought of applying for USC? He has been here long enough and can apply after the 5 year rule that way he can spend as much time out of the country he wants without any effect.

Canerican got a reaction from JFH in Divorce and Remarry: Getting to the US Faster on a K-1 Visa?
I think whether we have completed the K-1 or CR-1 we all understand to a degree what the OP and his spouse are going through. If you look at my timeline I immigrated on a K-1 visa which took me 12 months to get in hand and my AOS was about 5 months. So in total visa and AOS took 17 months. Then when I removed conditions I waited 7 months and from application to oath I will have waited 11 months. I say all this to say that this is a long process and will test your love for each other, but in the end it is all worth it. I understand that you want to be with each other as that was the same way I felt. Whenever I came to visit my then fiancée during the process I hated to leave but knew that the process would Work itself out and I would see her again on a permanent basis when the visa was approved. Trust me this process can get agonizing but it does not stop when your spouse enters the US. You have to let the govt know every time you move, you may have ROC (Removal Off Conditions) to apply for if you have been married under two years. When you have time together now whether it be in person or online, enjoy each other. I would also recommend self care. Take care of yourself in whatever way you do that because as I said this process can be agonizing.

I am a a detailed person so even on my recent N400 application I was very detailed and it was like that with the K-1, AOS, and ROC. I had take care of myself by doing other things as well as helping others on this website.

I hope this this post helps just a little bit.

Congratulations!!! As has been mentioned earlier your passport will be sent back with your paperwork for the point of entry (POE). The paperwork that you are not allowed to open will be marked "DO NOT OPEN" and state that only a US government official can open the package.

@vbms, I agree with t-ten that you can apply November 24, 2019 for your N-400. As he said do not apply exactly on November 24, but wait a couple of days to submit your application. Congratulations for getting this far and good luck with citizenship.

You become eligible to file N-400 on November 24 (= "Resident Since" date on your green card plus 3 years minus 90 days). However, it is advised not to do so on that day. Wait a couple of days, and then submit.

It all depends on the field office where you will be interviewing. Some field offices are slower than others. If you know what field office you will be interviewing you can check on the processing time at https://egov.uscis.gov/processing-times/. I know that it's not fun but its pretty much a waiting game until they schedule your interview.

I really am sorry that this happened. He could have got here and realized that he missed his family and did not see a future in the USA besides the other items you saw. Do you have proof of fraud? If, in fact, he leaves after everything is finalized that shows me he was not in the relationship for a green card and there is no reason to believe that you would get an annulment.

Again, I’m truly sorry this happened But fraud will be hard to prove, I believe, if all you have is promises he said. People go back on promises every day.

As as others have said, pull the I-864 so that he does not get a green card.

As @Bill & Katya said, “Your N-400 depends on the approval of your I-751.” These two applications are connected. If your I-751 does not get approved you cannot move to citizenship and I would presume you want to get citizenship as soon as you can. So, in that vain, the I-751 does matter.

When you get your N400 interview and attend, the IO will do an I-751 interview as well as an N-400 interview. Remember to take in originals of documents you sent for your I-751 and N-400 applications.

I agree. I have had to tell people time and again that this journey, whether it is the CR-1 (spousal), K-1 (fiancé(e), or any visa as a matter of fact; this is not a sprint where you will get something quick and be done. It is a marathon where you have to pace yourself or in this case develop patience to be able to get through the process.

Your endorsed CR-1 visa (stamped at POE)  IS your Green Card until the plastic one arrives.  Therefore, you are authorized to work.
