P.S. Once she gets inside US and has an ability to acquire a local attorney, the level of this game can go from "very hard" to "impossible".

Your failed relationship do not give you/your parents any right to commit fraud. You make it sound like (their) money would make the fraud ok.  No, it's not ok.

Sad reality if grandchild/grandparents do not meet, but it happens everyday, for different reasons.  Life is weird sometimes.

The reality of international marriages. The reality many of us and our aging parents live with. My parents have grandchildren and great grandchildren they will never see . Reality is harsh at times but this reality is pretty obvious and no surprise. Counting the cost before starting the journey is really important.. even considering possibilities “ that wont happen”.. because, guess what, they do happen

Leaving immigration aside for a minute… if you stay married and she comes here, your child will see that his parents are in a relationship where they don’t love each other. Kids pick on that. He’s going to believe that this is the norm for relationships. Stay with a partner just because. Is this what you want to teach him?
And don’t bring a baby here just because your parents aren’t willing to travel internationally. If money and health are not an issue, let them travel to see the baby. Why does the baby have to make the concession, and not them?! We are talking about a child that didn’t decide to be born.
Now, off to the immigration side of things: staying married just for immigration purposes is fraud. If you’re the one to inform the IO and are worried about the legal consequences, get a family lawyer from her country first prior to doing anything. And yes, if she doesn’t inform the officer then it’s on you to do so.

Your answer is condescending and totally unaware of where i come from, what my family history is, or what me or my family might have gone through in the past.

Fact: no one is entitled to immigrate to the US.
Fact: people can and do make decisions about whether immigrating to the US is more important than leaving family behind.
Fact: if you don’t like the current laws, you can waste time complaining about them on the internet, or try get something concrete done to change them.
And finally, FACT : I feel immensely privileged to have been able to immigrate to this country and become a citizen.

I don't see what she said as condescending or ignorant. She's just stating a fact. I have a sister who's a USC but has chosen to live in Ghana for the past 12 years with her husband and kids by choice. They don't want to migrate, at least not yet. Trust me, there are hardships, and poverty everywhere including big ol USA.

B2 is for tourism, coming for 6 months to look after a baby whilst the parents are at work so they don't need to employ someone else could very well be considered working. I wonder what she said as purpose of visit when asked at the POE.

Use the money you saved not having to pay for child care costs for her medication.

What a load of BS to try justify the fact that he didn’t follow instructions. Suddenly it’s a different reason, that he couldn’t get pictures?
is he planning to lie under oath to a consular officer if they ask him about kids and step kids?

What do you mean what are the consequences?  She came on either a B-2 or VWP, and for both of these, working while in the US is PROHIBITED.

Marriage itself confers NO immigration benefit.  She is not authorized to work until she has an EAD or Green Card.  This is one of the drawbacks to opting to do this the 'easy' way (i.e. jumping the queue) by having her adjust status rather than return to Australia to wait for a visa interview.  Them's the breaks.

Also be advised she will not have AP (to be readmitted if she leaves the US) for 9-10 months.

Many cultures have religious ceremonies that are viewed in the eyes of US Immigration as being "too married" for a K1 visa.  Do not put yourselves at risk.  Enter the US, marry, adjust status then have your religious ceremony in your own country.  People here are not joking when they tell you that USCIS can dig into your whole life and if they find out you did a religious ceremony prior to entering the US to get legally married, it may well jeopardize your whole life and the plans you have in the US.  The type of marriage and the impacts are the considerations that needed to be made PRIOR to applying for the visa type you applied for.  If a religious ceremony was that important, you should have considered a spousal visa, not a fiancé visa.

Your logic is precisely the opposite of what I would think and what I suspect most others would think.

The farther you are from your appointment the more likely you would arrive the night or day before.

    1. Book a hotel room as close as possible to your appointment place

    2. Leave your vehicle at the hotel when you go to appointment.

    3. Take a ride share if the distance is too far to walk to your appointment.

Have you done the research?  Your parents will not be able to work or leave the US for as many as 8 months.  They won't get a Green Card for a year or two.  If they are 65, they won't qualify for medicare for 5 years. I am always surprised that people who come to the US just for a visit can suddenly decide to stay and live in the US.  Good luck.

Also, keep in mind the cost of moving an elderly parent to the US can be cost prohibitive because that parent doesn't qualify for government sponsored medical programs, so health insurance is entirely on you, out of pocket.  There are definite advantages to her remaining in the UK with the NHS readily available.

A great, great woman and a pillar of strength for her nation. She saw 15 prime ministers come and go, from Churchill (born in 1874) to Truss (born 1975). She lost her father when she was so young, and defied everyone's expectations by being a competent, thoughtful monarch guided by her faith and belief in the power of the throne to unify her country. May she rest in peace, and may her people find comfort in the love she truly had for them. ❤️

No.  OP lived in the US with a J-1 for 2.5 years, then used ESTA to basically live half a year in the US.  OP visited for 3 months, stayed in Spain (or elsewhere) for 4 months, then returned to stay again for 3 months.  This was the abuse.

Basic rule of thumb is to stay out of the US for twice the duration between visits.  Even then, multiple max-stay visits will be flagged by CBP as being suspicious.

No idea where you’re getting that idea that the only possible way to have a relationship is through marriage. That’s not what people are saying. What they’re saying is:
    1) that you don’t need an attorney to apply for a B2 visa because there’s nothing they can do (you have to apply by your own merits showing strong ties to your home country).
    2) that OP abused their ESTÁ by staying for long, frequent visits.

Using it for frequent, long trips is abuse of ESTA.

That’s why OP was removed, and has now found out that it’s not a long term solution for maintaining a relationship.

Using ESTA to live in the US (for all intents and purposes), which is what the CBP believed at the time of the last entry, is abuse of ESTA privileges.  General rule of thumb is to spent more time out than in, and the OP has come - IMO - dangerously close to the latter.

OP, the only thing a lawyer can do for you is take your money.   If your ESTA was not revoked, I'd wait a year or so to come back.  In the meantime, get your partner to visit you in Spain.

Neither test here in Missouri is difficult. It is just an inconvenience. There are two separate offices that you have to go to. No unified DMV office in Missouri. I grew up in Illinois where you could go take your written, driving test and get your license all in one place. In Missouri there are private license agencies. The State Police gives the exams.

Disagree 100%.......  Some of us have been waiting for more than 3 years for Removal of Conditions......The I-751 is ineffective and causes a great deal of trouble......When only 1 to 3 percent of I-751s are denied, it is an indication of its ineffectiveness.

Not my fault.  It's COVID.  Had nothing to do with wanting our dogs and waiting until the last minute to look into it.  The definition changed.  It wasn't because I didn't want her to have the second one because they are poison.

    Joe's fault.  Yeah.
