    As dependent ? Filing jointly with a spouse not living in US is different than claiming a child as dependent - basic requirement is that he/she needs to live with you at least half of the tax year.
     
    Also (from IRS publication 501) : 
     
    You generally can't claim a person as a dependent unless that person is a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico. However, there is an exception for certain adopted children, as explained next.

    You have no chance of obtaining green card based on the fact you have US citizen daughter. 
     
    Your Visa expiration is irrelevant in this case, it's important when period of stay you got when you were admitted entering US expires.
     
    And be careful about going back to your country with your daughter without other parent's permission - it will be considered kindapping.

    This is just witholding.  He is going to get money back assummed he overpayed once he files his return next year as married however of course he can claim whatever he wants. This is none of employers business after all.

    And I have a feeling that he knows exactly what went wrong and why his wife decided to cancel the petition- and I assume to plan a divorce. 
     
    And at this point OP is just fishing for info on how to immigrate to the US. With or without his wife.

    180 days from the time your authorized stay expired. You are way beyond 180 days from that time based on what your wrote.

    If you have an idea what you're doing (know how to make sure it's lighted properly and the crop and print it in a correct size) , do it yourself - you'll do better job than Walgreens where some random worker picks up compact camera and shoots your pic.
     
    I always did it myself, printed whole bunch of 2x2 for $.39 at Walgreens ironically (put 4 on 5x7 print and sent over)

    2. You have 6 months to enter US from time of your medical

    No. (you get plenty of misinformation in this thread). If by September 30th your visa has not been issued, then you are not going to get it.
