Boyfriend visit on Tourist Visa

Hi Everyone,

 

I need some advice for my boyfriend who wants to visit from Belize. He applied for a tourist visa about a year ago to come visit (we had known each other 1 year at that point and had not met). He was denied and was told "we don't think you will come back" because he didn't have a job (and still doesn't). I had written a letter explaining our connection (did not mention we were dating). He is a hospitality major, and I am in the hospitality field and we met through school connections. I noted I was going to show him California and how travel and tourism works here to better his career opportunities in Belize. We have now been together 2 years and want to try again for the tourist visa. 

 

The question really is - should we be honest and say he is coming to visit his boyfriend? My gut tells me no.... and he does have family that lives on the east coast but he isn't "out of the closet" to them so he didn't really want to put them down or he feels he would have to explain himself. But I personally think that's the best bet to getting approved. Any thoughts or advice on getting his visitor visa approved?

If asked, he must tell the truth.  Misrepresentation can be a serious offense.   Sounds like nothing has changed to improve his ties to his home country.  Don't expect success. 

Remember, all visitors are assumed to have immigrant intent....it is up to him to overcome that assumption.  Lying is not a legal option.

My advice:  Don't waste the money.  Don't lie.

If his circumstances (lack of ties to his home country) haven’t changed, expect the same result when trying again. He needs to be honest and there is nothing that you can do to increase his chances.

Hard stop right there. The answer is, yes you have to be honest. It does not matter what comes after that question... you asked, the answer is, and will always be, "Yes, you have to always be honest."

Absolutely do not do this. Never lie to immigration. And we do not condone this type of activity here. You don't have volunteer the information, but if asked he has to tell the truth 

 

 

Also, your letter did not help. Letters of invitation like the one you wrote hold no value. So it likely did not do anything to help his situation. It is mostly a waste of time writing them. 

 

Lastly, if his circumstances has not changed since the last interview, he can expect the same result. He is still unemployed with no previous travel history and a American grilfriend. He is considered a high risk.

To answer everyone about the lying, He wasn't going to lie, I guess I mis-wrote that, as he was going to state the reason of visit as to visit his family here (true) but then also visit me, (ofc answering that if asked, but not volunteering that up as the reason for visit front and center).

 

Now we have been meeting up in Mexico for a year now, 3 trips (once every 2 months), so he now has some travel history and proof he returns each time. Do we think that might help his case a little?

 

and FYI we are a gay couple to anyone who didn't catch on, which is a challenge in his home country since its not as accepted as it is here in the states (not sure if that helps our hurts our situation lol)

It is very likely that the CO will ask if he has BF/GF/Fiance in the US.

It really isn’t. Best bet is to show his circumstances changed, not who he intends to visit. From what you have wrote he is still unemployed and that’s one of the biggest factors. Young, unmarried, unemployed male with a US citizen romantic partner and relatives in the US trying to get a US tourist visa for the second time - I personally think chances are slim to none.

needed to get approval of tourist visa

1  job

2.  money to make the  trip (his own money)

3.  own property in his country

4   no letter of invitation 

5.  no ties to a bf here

 

u have met,,  apply for the K1 to  marry here / that has a bigger chance of an approval if u have the needed income to support the visa and him

This is the excellent example of why writing a "letter of invitation" not only does not help, but it can actually hurt his chances. With this letter he is actually showing more ties to the US than to his home country. IOs are not stupid and can read behind a few lines.

He has to build ties to his home country by getting a job, a lease, etc. Even then, it is still not guaranteed.

Your gut is wrong. Again, no need for the letter. Let him apply on his own merit, and if asked, then he would of course have to say the truth.

Do not lie to the department of state or USCIS, EVER.   Misrepresentation can result in a lifetime ban.

 

Over this past year, he should have been working hard to strengthen his ties to Belize, because that’s how tourist visa applications are judged.   If he still doesn’t have a job, why not?

 

A letter from you will not help.   He needs to be completely transparent about who he knows in the US when they ask, and they will ask.

 

His chances remain slim in my opinion.   You’d have better luck going there for a visit.

Being a gay couple is irrelevant.   He is coming to visit you, and he needs to be honest about that.   Any misrep now could seriously harm his chances for an immigrant visa, if that is your future plan.

He isn’t getting a tourist visa with no job and even if he did have a job,he has strong ties to USA through you and his other family and also he was denied already so unless something major changes the outcome will still be the same.

 the invitation letter hurts his chances more than anything.

only way he is coming to USA is through a k1,spouse visa,job or DV or any other option but just not tourist.
